  2. also - will i need a solicitor with me on the day should it get as far as court?
  3. silly question i know but the interest i claim for, is it times six for the 6 years or just x 1 of the % ?
  4. just penning the letter to send today - can you have a quick look and tell me if you think its ok? see below THANKS! Dear Mr Jeremiah Thank you for your letter dated 14th August 2006, however I must remind you that only FULL and UNCONDITIONAL settlement of my claim will result in my withdrawing from this case. I am enclosing copies of a further 6 letters informing me of charges incurred since my original claim. Although I understand that strictly speaking that the issue of these would need to be dealt with in a new and separate claim, I would like you to consider reimbursing these along with my initial claim in an attempt at saving both parties the hassle and cost of a new further claim. Yours sincerely
  5. o.k thanks. do you think i still have enough time to settle by post ? the court hearing is on 30th august. and what to do about the charges to my account since i made my claim ???
  6. hi all just recieved another offer from the bank which includes the amount owed and the court fees but dosen't allow for any interest. i've submitted my doc's for court ( they had to be in by 1st August) but i dont think the bank have as the court haven't sent me anything. also they made another 3 charges this week. do i cut and run now seeing as it's only 2 weeks to the hearing or should i fight to the end ?
  7. O.k on the questionnaire where it say do i need to postpone claim for a month to try and settle the claim with the other party , do i tick yes or no ? should i just get on with it ?
  8. So i've had a copy of their defence. what now ? i'll take the earlier advice not to call them but do i fill in the questionaire or do i still sit tight?
  9. only recieved the questionare today, haven't filled it in yet.
  10. Well there is another one of my mistakes, i didn't want to seem greedy so i only put in for 4%..........ouch !!! Can you believe these people actullay charged me £27.50 for being 2p short of my standing order to a cancer charity, it just shows them for what they really are.
  11. o.k i'll do just that, i'll sit tight. though i suppose i should just hold out for the original sum + the court fee if it's offered and forget about any interest ?
  12. sorry people i was waiting for my other half to type that in for me. Thanks for that. Should i look to make contact straight away or is there a reason to wait a while?
  13. hi people i think i've made a massive error in my claim to the small courts, as i have now received a copy of the defence this morning and in it it states that i have not entered all the details of what charges and when. My statement basicly said that i would like to claim the charges for returned direct debts and cheques that my bank had made over the last 6 years as i believe them to be profit making and therefore illegal. Have i blown it ? i can see that it is my own stupid fault. but i'm really quite poor with anything in an admin way and realise i shouldn't of cut corners. guess i just got over exited when i got the offer of half the money back. Assumed that it proved their guilt and that they would crumble once they recieved the small claims form. Careless i know. Can i still turn it around ?
  14. Hi all the woolwich have now put forward a defence ( of which i've yet to get a copy.) Does this mean i'll have to go to court ? Any tip's anyone?
  15. hi peeps, so i've still had no word from the woolwich they've got about 10 days left to reply, any one know how long they normally leave it ? it was on the 17th of last month that they were served the claim.
  16. Thanx Michael, will do
  17. hi, the woolwich have now acknowleged my small claims form that has been served on them by, putting an "x" in the box saying they are going to defend the all of the claim and giving some trainee solicitor name. Is the the norm and does it look like they will see it through to the end ? What do i do ? Please help !!!
