  3. As a Lloydtsb customer I know these are the Charges for returning the direct debit unpaid. I have also noticed the charges vary from time to time.

    Part Refund

    Hello, I too have an account with MBNA now sold to LINK. I was claiming back charges from when it was still with MBNA. Charges plus interest came to £366.97. They have replied saying they will credit the Link account with £90, a GOODWILL payment. Do I accept this or ask for the full amount to be refunded? Any suggestions to what I should write/email/phone and say to them? Thanks.
  5. Hi, My husband had an a/c with Lloyds plus an overdraft facility of £500. They tool the o/d off and started to charge him unauthorised borrowing fees taking the balance of his account to aprox £2000 Dr. The account is now closed and with collections. I have gone through all the procedures, sent the letters working out that his charges plus interest at about £1700, the rest of the balance is made up of overdraft usage fees. During the time the charges were being added my husband contacted the bank regularly asking for his o/d facility back as this would have prevented the charges. They refused. Now after my LBA they are still refusing to reimburse anything saying the charges are in the contract, etc, etc, etc. We are paying a regular amount to settle the debt through Payplan as we have put them on our payment plan. I am now not sure what to do, is it different if your overdraft facility has been taken off you? Can we still claim? Please help!

  7. Hello again, This is the letter I am sending to Nationwide re the £100 Compensation. Thank you for your letter dated 27 April 2007. With regards to the charge for £1151.13, I have enclosed a copy of the statement detailing when it was deducted. It war debited on the 24 March 2004, detailed as “Additional Charge”. There was also an amount of £138.76 debited on the 8 October 2004, with the same narrative. I have no idea what these charges relate to. The fact that neither yourself nor the solicitor knows what these charges are tells me that they are unlawful and should never have been applied to my account. I have requested a breakdown of these charges to no avail. Furthermore I have never received any notification of any of the charges. I feel that the whole management of this account has been badly managed from the start. Nationwide have not behaved in a proper manner with regards to dealing with or trying to help “The Customer”. As I said in my previous letter, the whole situation from the date we started to have problems in October 2001, then on to the CCJ being added (it should never have gone that far) I have always made you aware of our situation and continued throughout to make payments on a monthly basis. I have suffered a great deal of stress and anxiety dealing with all this, with no help from anyone. I am hoping that this could be rectified and I can be in some way compensated for the unprofessional way the company has dealt with my account over the years, without involving The Financial Ombudsman at this time. I ask you to please look into this further and hope that we come to some agreement to clarify the need to put what has happened into perspective and understand how all this has affected me personally and financially. I look forward to your reply. Regards BRIEF HISTORY OF ACCOUNTS WITH NATIONWIDE: Nationwide B.S. Mortgage from December 1997 to May 2005 Payments always maintained and on time. Personal Loan for Home Improvements took out 20 June 2000 Payments maintained and on time for 18 months OCTOBER 2001 Unfortunately, due to no fault of my own I discovered we were having Financial Difficulties. I contacted National Debtline and was referred to F.C.L. Federated Credit Ltd. They wrote to all our Creditors with our details and our offer of token payment. I had wanted to continue to pay the full instalment to Nationwide but this was a personal loan and my husband had a secured loan that had to be a “priority payment”. I kept in constant contact with Nationwide to let them know our position and continued to pay token payments through FCL. DECEMBER 2002 Our debt was passed and referred to Payplan to carry on our payment arrangements. On the 4th December I had a telephone conversation with a lady named Emma, at Nationwide. She told me we had the option of making a one off settlement payment of £9000 to be paid by 20 December 2007. (Obviously this was impossible) Also that Payplan had to contact them before that date or the account was to be passed to their solicitors. Nationwide continued to charge throughout this time. All our other creditors had frozen interest and charges. We continued to pay monthly instalments to Nationwide/McClure Naismith. Payplan had contacted all our creditors with a new income/expenditure forms and offers of increased payments. These were all accepted MAY 2003: County Court claim forms received. At this time I was advised that we need do nothing as because we had a “payment plan” in position, no further action would be taken. (I later discovered that this was incorrect). Unfortunately a CCJ was added in June 2003. Having a County Court Judgement now added to our financial position and made matters worse. NOVEMBER 2003: I received a letter from Land Registry, informing me of an application to enter a unilateral notice in respect of an interim charging order dated 30 September 2003 on my property by McClure Naismith on behalf of Nationwide Trust Ltd. I was so upset and angry at this, we still had our mortgage with Nationwide, why were they so against us. I contacted various Departments of Nationwide by telephone, to ask if there was any way that the loan and the mortgage could be merged. This way Nationwide would be guaranteed to receive their money, the loan would become SECURED (this is what they were trying to do anyway) and it would have greatly helped our financial position. After being passed from pillar to post, nobody wanted to listen or help. FEBRUARY 2004: On 9th February 2004, my husband And I attended Bury County Court to defend our case. Before we went into the courtroom, a gentleman (who we later found out was the Nationwide representative), told us that it was a foregone conclusion that the Charging Order would be made final. The Nationwide rep, put the case forward, in which he told the Judge that N/W had been unaware of the payment plan and our financial difficulties until December 2003. Fortunately, I keep copies of all documentation and record details of every phone call. Judge Swindley looked at all my documents since October 2001, which included the first letter to N/W in October 2001 complete with follow ups and proof that an offer of payment that was accepted and that we had continued to pay monthly instalments ever since. The Judge was very angry; he stated that “Mr and Mrs Brogan had taken all the steps necessary to attempt to discharge their debt. Nationwide had accepted our offer and had been receiving regular payments” He went on to say that the evidence from Nationwide was in fact, UNTRUE and should never have come to court. The final order was dismissed. The N/W rep said he thought we should pay the court fees! The Judge did definitely not agree and ordered N/W to pay the costs. Looking back at this, I would think that the same thing would have happened regarding the CCJ. It would never have been put on if we had attended court. 2005 We continued to maintain all our payments but we had to pay very high rates on everything due to our CCJ. Payplan advised us to re-mortgage and it was at this time, after numerous letters and phone calls I discovered that Nationwide had never removed the C/O. It should have been removed over 12 months earlier. In the next few months I had to contact Land Registry, The Court and Judge Swindley who advised me what action to take. After many more letters and forms/phone calls etc. Plus having to wait for Nationwide/McClure Naismith to respond to Land Registry (McClure Naismith refused to speak to me) it was EVENTUALLY removed. But the damage had been done. I had been signed of work with anxiety and stress, referred to a therapist and prescribed anti-depressants. We had, had to borrow money from our family and friends and by the time the re-mortgage completed we were in a worse position financially than we had been before. JUNE 2006: I requested a statement from nationwide. The rest you know. I was devastated at all the charges that had been added. Over the next six months I sent countless letters and emails asking for an explanation. I received no response or acknowledgement whatsoever. JANUARY 2007: I was again signed off from work with stress and anxiety due to my constant battling with N/W and trying to sort out our position. I further requested a statement which covered from June 2006 to date. I was told I could only have these if I paid another £10. This was not for a DUPLICATE statement, but for an original that we had never had! THE CONSEQUENCES: County Court Judgement Interim Charging Order on property for 14/15 months after it had been dismissed in a Court of Law. Thousands of pounds of INCORRECT charges. Incorrect amounts and information on Credit Report Lack of any communication from Nationwide/McClure Naismith. Humiliation of McClure Naismith refusing to speak to me. Months/years of suffering financially. Absence from work due to stress and anxiety caused by this. Arguments caused within my family due to this. Very high interest rates on any borrowing. Time taken writing numerous letters, numerous phone calls. Total lack of empathy or customer service. This all led to and then further added to my now lack of confidence, stress and constant health problems and the inability to, as yet, return to work. I feel the offer you made is inadequate, hence my need for further advise regarding the situation, before I reply to the Financial Ombudsman with the outcome. With reference to my calculation of charges, I have calculated from December 2001 when the “late payment fees” were first added, to June 2006. I do not have any statements or advises of the charges that have been added since then. Any comments please?

When I contacted the financial ombudsman At the moment I am drafting a letter to Nationwide acknowledging receipt of their offer but also detailing ALL the problems I have had with them over the past 5 years and the total lack of communication and customer service. It has led to both Financial and personal problems. Maybe I should seek Legal advise? I am just worried about doing the wrong thing! Bernadette
  9. Hello, does anyone remember me and my NATIONWIDE problems? If you do, would you believe I am only just getting somwhere!!! After my constant letters never getting any replies, I went to the Financial Ombudsman. They sent one letter to Nationwide telling them that I had contacted them with a COMPLAINT. Guess what, I had a reply! The first reply dated 13/03/2007. They apologised and confirmed that they had been adding Late payment charges since 2003(Incorrectly), and in this instance the charges would not apply. The amount they were removing only covered 2 years charges which was only half the amount that had been added. I replied to them with all my calculations plus asking them again what the "additional charges" of £1151.13 and £138.76 were for. They did not know and neither did the solicitor! They asked me if I had any more details. I sent THEM a copy of my statement. I also explained in more detail everything I had gone through with their company over the last 5 years. I have now received a letter telling me that they have calculated that a total of £5015.30 has been applied to my account since January 2003 and that it will be removed from the balance. Apparantly the "additional charges" were legal fees. They then went on to offer me £100 compensation for the inconvenience caused! (that is also for the fact that they had put a charging order on my property, when a judge in Bury Count Court had refused to finalise the interim charging order) causing our remortgage to take seven months. I had to write to the judge and get this all sorted myself, through land Registry and the judge., to eventually have it removed. £100 COMPENSATION? I have 28 days to reply. Any advise please?   10. Hi, Iv'e just read this section, TOO LATE. I, like you, Natalieliedickinson, LET THEM IN, But I was even more stupid, I told them nothing was on HP as we were in so much financial difficulty, I would never even try for HP. He made a list, gave me income/expenditure form and left. I sent the Inc/Exp form back with a cheque for £50 plus an offer to pay £50 per month(this would only be possable if my husband gets a job soon) He as been unemployed for 4 months for the first time ever in 25 years. I work Part Time and my wages only cover the mortgage payments. They have cashed the cheque but say they will not accept the offer. I am still in contact with The Council Tax Department as I am in the middle of claiming council tax benefit. Have I been completely stupid letting the Bailiff in? Can they take our belongings?

  13. Hello All, I'm back with an update. Received statements from Nationwide.......... They have been charging me "Late Payment Fees" since 20 Dec 2001. And I have never received any notification of these charges or any statements. The charges add up to about £4500, but Two charges are just on there as "Additional Charges" One is for 138.76 and one is for 1151.13??? I have sent my letter asking for it back today plus an explanation of the Additional Charges! Bye For Now B.
  14. Hi, I Have asked them for £180, they have credited my account with £80 taking each charge down to £12, they say as a gesture of goodwill!
  15. Hello, I sent the LBA to Capital One asking for £180 back in charges. On the 14th Day I had heard nothing....But phoned up for a balance to find I had,had a refund for £64 and one for £16, That is £80 I think!!!!!! I have had no correspondence as yet telling me I have a refund of £80 and I wonder what has happened to the £100. Perhaps they will refund that too??? Any Ideas? Bernadette:confused:
