  1. Hi Dx, I realise this has taken sometine to respond, but I appreciate the advice. I am starting to try and rebuild my account as best I can to see the full picture. Additionally, I have seen that you can complain about misselling account packages. It is my recollection that when taking out 1 or 2 of the loans/refinance, I was sold the Royalties and then Gold packages as they offered better interest rates. In all my time with any Royalties account, I never used or had reason to use the package benefits. Also, many DD rejection charges and OD charges have resulted from the account charge being added. Obviously I don't have all of the facts yet, but would appreciate any further advice Thanks again so much for opening my eyes a little bit more cbd
  2. FOS upheld my complaint in Decemeber and MBNA had until 2nd Jan to respond. They have since disagreed with decision stating the FOS has not assessed the facts of the case correctly, citing other decisions. They say I would have needed the protection. First and foremost my complaint was that the internet application would not allow me to continue without it ticked, I did not want it. Also my employment hasn't changed since the application, and I have always had full sick pay, critical illness cover, and would be entitled to redundancy. They are so full of crap and just stalling IMO!
  3. Sorry, it was their solicitors Irwin Mitchell not a DCA. The wrote saying although the CO in place RBS still would like to resolve the matter, and to call to discuss a settlement figure or payment plan.
  4. Hi dx, Sorry it was Irwin Mitchell who are writing to me. Dont have paperwork with me, they say "As you aware there is a CO on your property relating to this debt, however, it is still our clients wish to blah blah.... ....a settlement figure or payment plan."
  5. Hi, RBS have a charging order on my property. I reclaimed the PPI and they have offset against what was owed (I got the interest though) and subsequently the balances on my Credit file reflect the reductions. Additionally, the DCA have written and confirmed the new amount outstanding, and are still suggesting calling and getting a further reduced settlement figure/arranging a monthly plan. I presume that you cannot reduce the judgement order per se, but maybe they should update as part settled?
  6. I put in an SAR to BC back in 2008 when reclaiming Charges. They supplied the last 6 years to 2002 of which about 2 years came from a microfiche. I would expect that they go back more than that as banks have used microfiche for a long time to store old records. I remember using them in the late 80's when I worked at RBS.

  8. So BC have replied to my CCA request. They say they have supplied me a reconstitued copy of the credit agreement and terms. All I have is a copy of the conditions from 1998. In it there is not one mention of PPI anywhere. As they have based their rejection on the basis that I applied on application, but are unable to supply a copy of the original, does this act against them sufficiently to get it upheld?   9. Ok, another update. Having not received anything in the post, I have chased RBS and apparently they have sent my cheque to my old address (the address my old dormant account is registered) as opposed to the address they have sent every other bit of correspondance to (including interest payment). I have text my tenant to see if I can get my post, but could I demand that RBS cancel the cheque and give them my bank details to pay it to me electronically? Is there any form of data protection issue I can raise too? Many thanks cbd
  10. 8% direct to him. Is the loan that is in arrears, the one the PPI relates too? If yes, then they will offset. If it is a previous loan that has been paid off, then the money should go to him.
  11. Ok, an update for anyone who may be interested or in the same boat. I have today called RBS, they have clarified their policy with regard to redress. If the loan account is closed/repaid, then they can offset against any Overdraft If the loan is open and in arrears, then they can offset against the Loan They have sent a letter to me 1/9 (hopefully receive soon) explain the set off against my overdraft and that a cheque will be sent for remaining balance on the current acount (c.£1800). Now my problem with this is that the o/d amount of £1014 is made up of charges leading upto the default and 2 years worth of interest. Can I still reclaim these (and older) bank charges? many thanks!
  12. I appreciate the reply ims. How it looks to me though, is that they have offset the redress for the loan which is in default, which I understand. It would appear that the other 2 PPI premiums have been credited to the dormant current account (offsetting c.£800 o/d made up mostly of charges) and there sits a CR balance of c.£1000. I have no access to this account, so can I insist that the unrelated premiums are paid to me by cheque (as they did with the interest)? All seems strange, as if they wanted to clear the arrears in full, then they should not have sent me anything and offset the whole lot in one go, thus satisfying the CCJ and Charging Order!

  14. So have MBNA caved in on the pre-ticked box online, or are the merged threads confusing things? I have today sent my file off to FOS as nothing from MBNA.
