  2. i suppose my only option is to pay, i do want to reduce, am assuming halifax will use cabot to get the credit cards and loan back as well, and if one is £85 its unrealistic, £85 for all a month is something maybe. so I fill the form in and then send it off, I suppose they will want my financial details, just mine because its my debt?

Halifax withdrew our overdraft without warning Easter 2011, we had no money to pay, they threatened to take money from our other accounts so we took all our money and moved to a different bank. I did complain I was basically told tough, that overdrafts are short term.   6. no the CCA request was for the credit cards, I just dont know what the CCJ is for, it just says Halifax, doesnt say what part or what I owe

Hi, really hope you can help, background first - I had a loan account with Halifax until I met my now husband, he joined it and became a joint account, Halifax gave us a very large overdraft of £4,600 (we were both earning well), and we had a credit card each, plus a loan through RBS. However Easter 2011 Halifax withdrew our overdraft with just a letter, it had been okayed in the February when they looked at it, and without out warning it was gone, it left us with a £4,600 debt overnight, we were getting married in the October, so we decided to remove all of our money from the bank and move to Nationwide, and have not had credit from anywhere since, by choice. They tried several credit companies to get the money out of us, and since then at some point i did the CCA on them, cant recall when. Heard nothing from them about the overdraft account, or the 2 credit cards, get an annual statement for the loan, and a statement for another account i had with them. out of the blue I received a claim form from Cabot and admit i ignored it, as I had all other letters, I have never had a letter from Cabot saying they bought the debt, just this claim form, have had another letter come, which I cant find now! saying it went against me in court and I have to pay £85 by 05/01 or else, they say they can enforce me, I assume send bailiffs round, which i want to avoid, we dont have anything to that value. first what do i do, and 2nd i have noticed the debt, doesnt say what its for, just an amount, if its my credit cards I didnt think it was this high, if its the overdraft then its a joint account why arent they going after my hubby as well. can anyone help me please, i have had my head in the sand a bit, my hubby has aspergers so is unable to help me, and feeling a bit overwhelmed by it all
  9. I have followed all advice, have done complaints sent the cca letters, have slacked off in last month due to organising a wedding at same time! Halifax nearly took all Of our wedding money which is why we Emptied the bank account. Have sent recorded delivery letters, ignored calls etc etc. I have played my part but it's just Halifax, all the other debt is sorted and they all played Ball, some were very caring! It's just Halifax chasing overdraft, credit cards and the loan.
  10. this all just goes on and on, our credit cards, loan and bank are with Halifax, however they just wont answer any of our letters, they keep selling the 3 debts to companies who just get more aggressive and threatening with each letter - the latest says because we havent contacted them, they are looking at court then go on about what they could do, like taking it straight out of our wages, i have offered them a monthly amount and they just dont reply!!!! any ideas

HSPF and Capital one have replied with our agreements that we signed, however HSPF have still sold our debt to a debt collection agency. i tried to complain to OFT etc but had a few pc problems, Capital one said that the letter they sent showing us our signed agreement is a document they can ad will use in court against us, most of them didnt reply its been weeks now! bit delayed in acting before cos of PC probs.... what the heck do i do now, still cant pay anything, still broke, Halifax make me laugh cos they are daily writing to us about our overdraft and then sending us statements for an old aco**** ......

HSPF = i have sent them 2 letters now by recorded delivery offerign them 50.00 a month, they have each time said they wont accept it and have asked us to phone them, however before i could phone (not that i would) or write again they have sold the debt to a Abbott Commercial, i am so cross because HSPF have just ignored us. i will send the CCA to Abbot but is there anything i can do about HSPF and them ignoring us.
  13. hi, i have had some letters back from some companies, no replies from others, HSPF the loan - have refused our £50.00 monthly offer, they are demanding that we ring them, they are also demanding and they used the word demand! a list of all names, addresses, and amounts we owe and are paying to all the companies incluing utilities that we pay! they have said that we need to speak to them to set up a relaistic payment plan. Halifax have ignored all of our letters and have now told us that we have broken a redit agreement and that they are sending our file to a solicitor becuase we have broken the terms and conditions of our account, however they took the overdraft away, because we havent paid the £4,600 when they said we have broken our credit agreement. EOS have replied and said they have sent my request for the CCA to their clients, but then EOS also said on a different letter that they are sellign my claim to a different collection agency. as yet i have made no offer of payment to anyone, i thought i had to wait for the CCA to come back, (except HSPF offered them £50 and Halifax £5) whats my next plan??? thanks

Hi have sent letters to all now, most asking then to prove they right to collect, one to loan company with payment request and standing order details wanted etc. Then one to Halifax telling them to sod off have offered them £5. Most I will offer a £1 till things are better, have forbidden them all from phoning me and have said they must write or email, although I have not supplied my email address. Thanks though, I don't feel as controlled now by them because I know they could go to court but I am not ignoring debt just waiting on their replies.
