  1. Hi I took out a barclaycard late 2007 and i have had quite a few charges of 12 pound for late payment fees and also overlimit fees. I have tried to claim these back but they have said that as my agreement started after april 2007 i can not claim them back. Now i told them that when the judge made the decision in court the 12pound fee was just a guide line so that you can reclaim all of the fee back. But they have said that due to my terms and conditions being signed after April 2007 i have a different set of terms to the people whos card was taken out before April 2007 so i cant reclaim them back but if my agreement was signed before april 2007 i could poss reclaim them back. Does any1 know if this is correct? and do you know what the difference in the terms and conditions are? Any help is much appricated. Thanks
  2. Hi padaxes not all claims management companys are like this but i agree the vast majority are. What you should do if you haven`t allready is ask for a copy of the terms and conditions. In this it will state the amount you would have to pay if you cancelled. then work out how much you can reclaim back then work out there 40% fee from this. If it is a lot more than the fee to cancel then go ahead and cancel and do the claim yourself. Another note is you can cancel after 14 days from you signing the documents with no fee. Hope this helps
  3. Hi davey You would struggle because the insurance company would say you should have made your claim over 2 years ago. Allthough this should make your claim to reclaim your PPI premiums back as they obviously did not tell you the benifts of having the Policy or the Terms and Conditions. Nickk
  4. Hi chinny Im not to sure regarding it being applied for over the internet as ive never had anything to do with loans being applied for over the internet. So if anyone knows anything about this any help would be appreciated. I would still send it to the FOS as all it will cost you is a stamp and they might still uphold your claim. Nickk
  5. Hi Alana At the moment the Fos are allocating claims to a case worker which was registered with them in april so i would think prob about 3 - 5 months for a decision for your claim. Regarding the d & n being signed the vast majority do not have a signature so u are 1 of the unlucky ones but as you say no mention of medical history so that shouldn`t be a problem.   7. Hi The first thing i would do if you haven`t allready is put in a claim for your credit card charges. They will pay you back what ever they have charged you over £12 straightaway, when you have received that carry on with your claim and they will pay you the £12 charges back aswell. In regard to the ppi i think you will struggle in making a claim as they didnt tell you it would cover you for unemloyment and the insurance company will just say its been to long since you should have made the claim so they wont pay out. However you could poss claim back the money which you have paid in relation to the PPI if it was mis-sold i,e you didnt know you had it or was told you have to have the PPi. Hope this helps Nick

Hi Regarding how much you will get back can not realy tell how much as all you have is the total amount you pay per month for the loan and ppi included together plus if you have paid it off early you should have been given a rebate but thats not guaranteed to have happend. The best bet is for you to send them a Subject Access Request which you can find in the stickys under Full S.A.R. You should then receive all of the paperwork for all of your loans with them i.e. credit agreements you can then roughly work out how much you can reclaim. As with all providers they will not uphold your claim so you will have to pass it onto the FOS or if the loan was taken out before 02/11/2004 you will have to go through the small claims court. Once you receive any paper work back from welcome come back and we will help you from there. Hope this helps Nick
  9. Hi Chinny In the box which says - please tell us what your complaint is about put in I wish to lodge a complaint against the Payment Protection Insurance levied on my account. Please refer to the attached documentation for further details. Then in the box at the end of the form which says Client Testimony - put in the following but delete or change for your circumstances. The policy was mis-sold to me because of the following reasons – 1 I felt pressured into taking out the policy. 2 I was made to feel that if he did not take the Payment Protection Insurance Policy then he would be refused the loan. 3 I was not made aware that the Payment Protection policy would only cover me when there were 2 persons on the loan agreement. 4 I was not made aware that the Insurance Policy would not cover the full term of the loan. I was not made aware of this fact at the time the PPI Policy was sold to me. If I had been aware of this I would have either have not taken out the policy, or found a policy elsewhere which would have offered the appropriate protection over the full period of the loan. 5 I was not made aware of the full cost of the insurance policy as they I was not made aware that I would have to pay interest on the Payment protection Policy fee. 6 When I signed the paperwork with them the full terms and conditions and Policy Details were not explained to them and it was not made aware to me that there were certain exclusions within the policy which could affect me either at the outset or during the life of the policy. It was just said that the PPI would cover me for unemployment. 7 I was sold this PPI Policy and the premium was added to the loan amount. Effectively this made me borrow more, which then had to be paid off throughout the full term of the loan, including interest on the loan amount and also the PPI which was the same rate as the loan. If I had been made aware of the above points I would have either not taken out the policy, or found a policy elsewhere which would have offered the appropriate protection which would have also covered the full term of the loan.   10. Hi Firstly you will need to send Lloyds a S.A.R which you will find in the stickys. When you get some corresponse back from them come back and we will help you from there. You are not alone with the provider stating that they never told you it was compulsary in order for you to get the loan. This is the same in a lot of PPI Policys. Nick

Hi aa The majority of providers/brokers didnt ask questions regarding the suitability of the PPI Policy however some companys do complete a Demands and Needs Questionaire but the questions on this are simple i.e age at end of Policy, Employed/unemploed, Have you sought medical treatment over the last 12months, Do you have a policy which will cover you for this loan, would you like to be covered. However you will fnd that the vast majority of these do not need to be signed. So the Provider can complete this with the info they alleady know about you so if you cant remember compleing one i would challenge the provider and ask for a signed copy but im not sure of the relavent laws regading this i.e. if it has to be signed.
