  2. Dear Caggers I have just received the standard debt collecting letter from this company telling me they are noe dealing with a debt I have had with Natwest for a number of years. I have an agreed plan which I pay via internet into my old Natwest loan account number. This shows up on the statements they send me periodically. I have never heard or dealt with regal Credit before, and they have sent letters threatening to send one of their door step collectors etc etc. What can I do to stop them, as far as I am concerned I have only arranged repayment direct with the Bank. Should I just ignore the letter? What I want to avoid is if they start to make lots of phone calls to my house. I seem to remeber there is a letter I can send to them warning them off doing this? Any help will be greatly appreciated.
  3. latest update I have received another letter from Fairfax with an apology about the phone calls, and also what my repayment offer is. I will await their reply to cca request and if it doesn't work I will offer a £1 pm as per my other creditors (which was what the Halifax agreed to in the first place!) Also no phone calls for two days!! Many thanks to you all (esp Abs) and your support - it makes the difference between feeling stressed and almost criminal, to being a happy human again.
  4. Quick update - RESULT I have today received a letter from Fairfax stating they have removed my phone number from their call lists and all future communication will be by writing. I have still reported them to OFCOM etc anyway. Have also cca'd them as well. Now to work on them accepting minimal repayments ! thanks for all your support and advice I now feel I have some say in my life.
  5. Would it be better to send SAR request then? Would this put the account in dispute and not allow DCA to chase? Also does anyone know what to do when DCA ignores telephone harassment letter? thanks to you all once again
  6. Hi I am now in unauthorised waters due to the charges added by the bank, although the total owing now seems to have stopped increasing. I had the facility to increase the overdraft via the bank's internet banking site back in the day when I had a regular income and could live within the od limits. I don't remember them sending me anything outlining the terms and conditions etc. I just remember it all seeming very easy to increase my own overdraft up to a maximum level without needing to speak to anyone at the bank. Thanks for the info regarding and amended cca (is there a template for this?) what I find frustrating is the way debts are passed form pillar to post, making it very unclear as to whom I should send anything to. In the last 10 days I have sent a letter to the Halifax (no Reply), BLS Collections (no reply), Fairfax (no reply). Who should I cca? Should I even bother anymore with these companies or just ignore them all? once again thank you all for your advice and support

  8. I have a debt of £5k as an overdraft with the Halifax which when I was employed was no problem to service on a monthly basis. Since losing my job two years ago I got the Halifax to agree a token repayment of £1 until/should my circumstances improve. I have not had any luck finding another job and am trying to make a go of being self employed. The point is I do not have any regular income or any assets having lost my house and car etc during divorce. I have other debtors to pay and they have all agreed the token payment. Halifax have now involved Fairfax Solicitors who are threatening me with letters and phone calls. I refuse to speak to them on the phone. What letters etc can I send them to fight back? I have cca / sar other creditors to good effect but can these be used on my current account overdraft? I thought they were for loans? thanks
  9. Update I have now had my first phone call from Fairfax but I didn't confirm my address etc so they couldn't proceed any further due to data protection act. Is there a way of stopping them calling? I seem to remember a letter template for this but can't find it. I am going to refuse giving details over the phone everytime they call until I can stop them. I wrote to BLS collections and copied the Halifax asking why my debt is now being administered by Fairfax but am still awaiting a reply. As the debt is for an overdraft what legislation can I use to help me fight this? I pay a token £1 on a £5k debt as I am long term unemployed. Any help would be gratefully received. How do people cope with the stress of being chased by DCAs?

  11. Hi Everybody I am being chased for full payment of a 5K overdraft I had on a Halifax Rewards Account opened in 2006 in my name only. The balance by the way has gone up to £5234.07 from £4835? For the last 6 months I have agreed a token repayment of £1 per month into the account via internet banking with the Halifax. (my circumstances have changed drastically since opening the account divorce/unemployment/losing my house). I do not have a regular income and this is realistically all I can afford after living expenses. I have similar plans in place with several other creditors and they have all been no problem to deal with. Today I have received a letter from Fairfax Solicitors demanding full payment within 14 days or they will issue legal proceedings. As I have not dealt previously with them over this debt I have written to BLS Collections the administrators of the debt asking them to explain what is going on. They know I have no income to spare and that I have no assets such as a property or car to sell. I am going to wait for a reply from BLS before I tackle the Solicitors. It annoys me that DCA can just ignore the payment plan agreed and dump this on me from no where! Can anyone advise what might be the next course of action for me to take? Does anyone out there have any experiences similar and if so what did you do? thanks for taking time to read this.
  12. Thanks for the info debtinfo it has made me feel much better about things. Now all I need to do is raise the money for the court fees and I'm on my way. Hopefully my sanity will reappear as well!
  13. Hi All This is my first posting although I have been a member since 2008! I am sitting at the laptop with the banckruptcy forms in front of me and my brain scrambled. I have been struggling with debt for the last 5 years and have now hit a brick wall emotionally and physically when dealing with it. Currently I am looking at total debts of 45k all unsecured. During the last 5 years I have tried informal arrangements organised by myself, informal arrangements organised by debt management companies, all of which have not worked. Also I have experienced divorce, job loss, losing my business, which all contibuted to me not paying my debts. I am now in a new relationship of 3 years, and am living with my current partner in her house. All my debts were accrued before this new relationship. We have agreed the only option since being made redundant in April 2010 is bankruptcy, and have done some research. I have some questions which another Cagger may be able to help with. 1) Do I have a beneficial interest in my partners house? I am not a joint owner nor do I pay the mortgage but I do share household expenses 50/50 eg food, gas, electricity, council tax. We have no joint credit or bank accounts. 2) I will be getting a monthly payment from an income protection policy I have had for 2 years to cover any redundancy. it pays me 60% of my previous monthly salary which equates to my half of the household bills. Will the OR want this money? 3) Being unemployed I have decided to be self employed and start a business. How does the OR view this? Does anyone else have experience of this? 4) I already have two basic bank accounts - will I have to close these? One recives my JSA and benefits, the other one is little used and has no balance. 5) I have made payment under pressure over the phone to very persistent DCAs who were phoning my house several times everyday, and my mobile whilst at work. As Iused to work away from home a lot it was always my partner who got the house calls and she wasnt very good at dealing with the stress of this, so I paid just to shut them up and save my relationship. How does the OR view this? :???: I hope my fellow Caggers will e able to help or point me in the right direction. thanks
