  1. Hi All, A family member is very ill and im willing to help to deal with debt on there behalf with letter writing etc. Is there s standard template out there worded correctly so that i am able to take on the correspondence side and to negotiate on there behalf with there consent, and that will also allow them to deal with me directly? They have been ill for some time now and debt has started to pile up due to there poor health. We did not know until now and it seriously need sorting out. Many thanks.

  3. Hi All, Hope someone can help or advise. Couple of years ago now i had a nasty road traffic accident and have been on Incapacity Benefit. January this year i went to a medical and not long after the DWP contacted me as i did not have enough points to continue to receive IB. So benefits ceased. At the time i decided to appeal. I also had no form of income and still not well enough to goto work, and im still signed off by my doctor but i managed to get Income Support after making an complaint. As a month passed and i felt a little better, i want to get back on my feet slowly. So i stopped the appeal as i was thinking about some voluntary work to get me back into the swing of things this coming summer. As soon as i stopped the appeal, the DWP told me that i was now no longer entitled to Income Support and it has ceased. I then had to make a new claim but for the new Employment and Support Allowance which was successful. The DWP now tell me that i have to repay back what i received while on the time of Income Support which is nearly three months. If i would of known, i would of back dated my claim but again how could i if i was already in receipt of Income Support? Im now looking at paying back Housing Benefit as well ontop of this. After lenghly telephone conversations with the DWP, they tell me that there is nothing i can do, yet i am in receipt of a medical certificate ever since. Can anyone advise or point me in the right direction? Many thanks.

  5. Was it explained why it was unenforcable? Strange that these companies can wipe debt if its unenforcale, yet when it comes to the joe public we can not...?
  6. Steven, many thanks for the reply. By the looks of what you have said and other in similar circumstances, looks like these Cahoot CCA's are enforcable. Your right in saying that both sides are printed one one A4. Thanks.

  9. Thanks for your replies. Andy, i will try what you have said, thanks. craigers, at least im not alone. To be honest with you regarding the signed year i do not understand how i signed it a year before to be honest... you can understand when going into a new year but were talking about 10 months later... lol. I thought they would of picked that up on sending back CCA?
  10. I have had a further letter from the DCA of FORMAL PAYMENT. Im going to try another CPR Request now... but can anyone please tell me if the CCA is legal or Enforceable? Hope someone can help... Many thanks.

  13. Hi alanalana, Many thanks for the reply. I have already done a full SAR about a couple of months ago now due to challenging a CCA on a Halifax Credit Card. Halifax could not supply all information, nor a agreement for the load and PPI details was included. But does have other loan details. I also sent a reminder but did not get any further information. Shall i do another SAR? And i will now have a read up on the information you have supplied. Thanks.

Hi All, Back in 2003 i took out a Halifax loan known as a 'Personal Loan Agreement - UNSECURED' in the region of £9,610 as i borrowed a second time round and already had a previous loan which this one took over. This also included loan protection known as 'Insurance Loan' which was around £2,600 then a charge for credit for insurance loan of £960 brining the total to approx £3560 and the loan was taken over 84 months. This loan has only just been payed off and half by the insurance company after a no fault accident which is another story after Halifax trying to take me to court when i had insurance protection but i was far too ill at the time in Hospital. At the time i was not told that it was optional or other insurance could be taken out elsewhere, do i have to have evidence of this? I still have my second agreement and it was applied as a single premium at the start of the loan. Do I start with a CCA request and have i a case for a claim? Sorry for the questions and your help would be grateful. Regards Jay
