  3. Hi all Is a Credit company allowed to sell on, or assign, a debt to a DCA whilst the borrower is in dispute with the seller & credit company?

  5. I was sold a holiday points scheme & this was financed by a credit aggreement, controlled by the Consumer Credit Act 1974 (Sect 75) Payment for various items were demanded long before the date that I was told that any payments were to be made (eg property maintainance). I then "smelt a rat" & found that many lies had been told on the original presentation. I contacted a well known association & they are being very helpful & supplying good information, but other people's experiences would be welcomed, too.Under the CCA 1974, I refused to start payments on the credit agreement due to being sold by misrepresentation. The credit finance co. concerned did nothing to try & rectify the situation & have now referred the situation to Link Financial (already mentioned several times on this forum) for the recovery of the debt. This apparently, according to their corresponence, breaks the protection of the CCA 1974, holding the lender equally responsible for the mis-selling. Has anyone else here had this experience & would they like to relay any results. Regards
