  1. AOL would not take any instruction from him because the AOL account was in my name and they said they would only speak with me. He thought by asking the bank to cancel the payments that this would suffice. I think AOL have now suspended the account because they are no longer receiving payment. Obviously the bank could not do anything as mentioned earlier. The simple solution would have been for ex to contact me to cancel the AOL account! Now that our account is over our £100 overdraft limit because of this, the bank have charged x 3 £75's in charges which has made the account £303 in the red. To avoid a default notice, I am having to make repayments to the bank. I just wondered if I had any recourse to claim money back from either AOL or the bank. Many thanks for your help.
  2. I believe it is. My ex has used another server for a few years now but the payments to AOL were taken out until November last year. The bank did repay two of the payments to the account but this was when the account had gone overdrawn. The card must have been a visa debit as the payments came out of our joint current account. Unfortunately I have been kept in the dark about all of this, until I received letters and phone calls from our bank saying the account was overdrawn. The overdraft was caused through continued payments to AOL after the bank was instructed not to pay. When I spoke with the bank, they told me that it had nothing to do with them, and that the agreement was between myself (being the card holder) and AOL and as long as AOL took the payments, the bank would honour them. The card must have been at the very least 3 years out of date as I left 5 years ago.
  3. To be honest I can't remember. It was five years ago when I left the card with my ex-husband. He tried to cancel AOL but of course because it was in my name, they wouldn't speak with him. It would have either been a Visa debit or credit card.
  4. Can anyone let me know if AOL can take payments from an expired bank debit/credit card? If they can, is the bank at all liable for honouring the payment knowing the card had expired?
