  1. Hi seems to be a mixture of agreements
  2. If you are making a full & final settlement make sure the payment is made by a third party (i.e. partner or parents). If you pay a creditor less than the amount you owe it is not regarded as good consideration.

  6. Shouldalways send the Statutory request letters by Special Delivery. Costs more but they seldom "get lost" in the post as Royal Mail has to refund the fee in the event of non delivery.
  7. So not issued online then. Was there a copy of the Consumer Credit Agreement they referred to attached?
  8. Was the claim form issued in Northampton?
  9. service is normally deemed two days from posting. Its only court claims that have the 5 days for service.
  10. I would have thought that if they are in breach of your s.78 request then they aren't supposed to issue court proceedings:cool:
