Hi am just asking for a bit of advice, I have recieved the defence from the court submitted by Cap 1 and it is that they don't owe me anything cos they have already coughed up (still waiting for the cheque). I have had another letter from frederickson international demading money (letter no 3). I have phoned them and explained what is going on and that i dont owe them a penny. But they want, at my expense to send them copies of all the details before they will back off or they will take me to court. These people are very agressive; now what I want to do is let them take me to court and then i can turn up with my water tight defence and leave them with egg all over their boats. It must be Cap 1 duty to inform these parasites that I don,t owe any money and never have? By the way the family court is a bit different to the small claims see previous posts, i don't think i will win this one.

It is clear that you have no claim against us and while we do not accept liability for the claim, I am prepared ,in an effort to resolve this matter without the need for a court hearing, to refund the full amount........if i haven't got any grounds for a claim why not go to court then? I look forward to hearing from you shortly in response to this offer so we can avoid taking up valuable court time........so why take up valuable court time then, why didn't you just pay up when i first asked instead of waiting for me to issue a claim in the court and then taking the time to acknowledge it ?
  11. I only claimed the 8% that was enough for me I just wanted rid of this debt.
  12. I filed my court claim on the 28/10 and got my letter offering settlement today, no defence filed on moneyclaim. It is purely a guesture of good will and no liability is accepted and it is in an effort to save the need for a court hearing.They also look forward to recieving my reply soon to save taking up valuable court time. Happy days.
  13. I think I will do that tonight but I still can't see how they can demand money when the debt is in dispute and the subject of litigation. Obviously the different departments in Cap 1 don't talk to each other at all. I never actually got a reply to my letter disputing the amount that they say i owe them.
  14. Just for devilment I think I will write to them. I think I should ask on what authority they are acting for Cap 1 and if such an authority exists I require I true signed copy before I will recognise any correspondance from them. After all I could write to anyone on headed paper and demand money if I had their details, how many times do we have it ramed down our throats about identity fraud. What do you think?
  15. Thats the address it's P.O. Box number. I am sure I can find their offices because they are a bit shy about putting their office address on any public website. A trip to companies house methinks for the finance directors home address.
  16. Thaks for the reply I was going to write to them but then I thought, why? As I said to them they could have found my details in the Cap 1 skip. I have absolutley no proof that they acting for the above company and untill I hear from the creditor that they are acting on their behalf they can whistle.
  17. Has anyone had any dealings with this lot. I had I letter off them on Saturday demading payment for Capital One of £317. So phoned them up and tried to explain that they can't just write and demand money after all they could have found my details in a skip. Then I proceeded to explain that I was in litigation with the company and as the amount is in dispute anyway I won't be paying you a penny. " But you do realise that you could have a CCJ against you if you don't pay us now" I then told him that "I am suing Capital One for more than the amount I owe them anyway so please proceed and I suggest that you contact Capital One if you intend to send me any more demands for money before you are legally entitled to do so" "But sir this is serious" "Goodbye" Any one else had any similar payup or else letters?
  18. Carry on as per the procedure, would they still pursue you for any money you owe them even after they closed the account and sold the debt to someone else. If you can't claim retrospectively for these charges then they can't hound people for 6 years for the money you owe them. I got mine back from these sharks and you will get yours, stick to the time table and use the court if need be. Good luck. (not that you will need it)
  19. I've just had a look at my account online and what a surprise. Two charges of £25 debited on the 25th. But wait there is more. Two charges of £25 refunded on the 26th, so are they not charging at all now or just the customers who haven't made a claim against them.

  22. I sent a schedule of the charges with my LBA and then I got the go away letter. So I then filed the court claim and sent one to the court, thats all. They know how much they have charged you because I am sure they will check their figures against yours after your first letter. Just remember they are not just paying money back to us, but they have a full time lawyer now to deal with all these court claims. So they only need one schedule of charges with your LBA and then one for the court. Good luck (not that you will need it)
  23. From all the other claims that have been settled it looks like it's about two weeks from the acknowledgement of the claim untill you get your cash. The Money claim site says a defence has been submitted and my case will be transfered to my local court and I got a cheque today. So sit back and wait for your money.
  24. It took 103 days from sending my DPA request to banking the cheque. But It was about 3 weeks after recieving the info before i sent the first letter, so it would have been a bit quicker. I was sweating a bit because I did not have the money for the allocation questionaire which might have been a problem. As I said I am going out for a big drink tonight!!!! Good luck with your claim.
