  3. I'm so frustrated, I taught my friend how to do all this and he hit capital one for £1000 really easily. Bc have so far refused to send my statements despite every letter sent from here and returned £203 which is about half of the amount I can prove from some of the statements I have. so I sent a Letter before action for estimated interest which they have ignored. I'm all set to send my court application which I have filled in based on estimated charges.. Any thoughts before I do so.
  4. Sent SAR got 1 1/2 years statements plus microfiche. Sent an estimate for £1000 before the information com ruled on them. Sent another letter in light of the info com ruling, three weeks ago threatening to report them. Have had nothing back since. Do I just go for it on estimated charges now and/or do i report them to the information commisioners.
  5. yes and i had to pay back the £2405 I ended it after 5 years.
  6. I have read through the faq section and can't find an answer to this. I took out a mortgage with Abbey National in 1996 that paid me 5% cashback amounting to £2405. This was to be repayed if the mortgage was ended before 6 years. To me this sounds the same as an early redemption fee but it obviously differs in the sense that I was given £2405 by them rather than getting a reduced rate of interest. Is it worth me trying to get the £2405 back?

  8. 1. Sent £10 and letter. Got some statements and microfiche letter back. 2. Put in an estimated claim for £1200 (I have proof of £400 from statements I have) 3. They replied with £203 paid into my account. Claiming difference between charges and £12 oft fee this figure has been based only on the statements I have. 4. I reply saying not happy want the full £1200 5. Following day Microfiche arguement explodes. 6. Today i get letter saying Thats your lot To clarify you incurred 3 x £15 and 12 x £20 on your barclaycard account. This term barclaycard account doesn't appear to include my bc visa I think and is just more lies from them. Question is what now. Do I proceeed with estimated or demand full statements now the microfiche arguement doesn't hold.
  9. Thanks for your help I will include some of this in a letter. I have written a reply offering £500 as full and final settlement to the money I owe and agreed to pay it immediately (Haven't sent it yet). I have done my complaining to the various institutons and replies from them should enhance my case in court. My real question is can I actually get money off this debt because of what they have done to me?
  10. I've put in an estimated claim, this may actually be more than the statements should I keep going with that and argue about the statements in court or should I get my statements. It may not be in my favour.
  11. im into the third letter now telling them they have 14 days to pay my estimated charges. Do you think I should ask for my statements again and if i got them would i have to start again with my claim.
  12. yeh im already three letters down the line with bc and so far they have paid up £200 off the £1200 im demanding. What i meant was is it best to start the ball rolling against cahoot whilst I still owe them money or wait til the end. I think you are suggesting get started now.
  13. I had a debt counsellor call at my house chasing me for £1000 for car arrears plus his made up costs of £293. I live with five other people. One of them answered and said he knew nothing about it. The debt counsellor then proceeded to put an open letter through my door (potentially for all my housemates to read and discuss) then proceed to put the same letter through the neighbours door. This obviously has upset me and made me paranoid to go out and affected my health and made me feel like the whole street etc know my business blah blah blah. So far I have written to 1) his company - no reply 2)The car finance company - who have decided out of goodwill they will knock £200 off if i phone them to settle (inc his costs still) so technically still charging me £93 for him to spread my details round the village. 3) Information commisioners re data protection act - this can not result in me gaining financially can only get his company a warning or in trouble etc. 4) Credit services agency. he has broken various rules on their website that his company have agreed to. By the way this is worth a read. I am currently planning to let them take me to court for this debt and there stance appears to be to bully and threaten mewith various means and long titles and threatening letters. Frankly they seem to be blowing in the wind as the letters contridict each other. I have two questions. If it got to court would the debt collectors actions gain me any financial advantage eg could i offer them half. Can I or do you think it is worth my while taking the debt counsellor to court for his actions towards me and the effect it has had on my happiness/health? At the end of the day I may as well just pay them if there is no financial gain to this. However I am staggered that there can't be consequences for going to someones neighbours house and informing them of your debt.
  14. I owe £870 left on my loan which finishes in April. I'm doing well with barclaycard and ready to start on the next. Any advice on whether I should start this now while i still owe them money or whether I should pay up first then go for it back.
  15. Hi Eggster's I'm well on my way now with Barclaycard having got £200 from them I have accepted part payment and continued my claim. I'm now looking for my next victim however I started Barclaycard as I don't owe them much. With Egg however I currently have a loan which was created by merging an old loan with my credit card. My fear is if I start on egg can they call in the loan. If they did this I wouldn't be able to repay it. Can't find this anywhere in the faq's
