  1. Thanks tomtubby. I have printed off the form and am about to fill it in. I phoned the bailiff but there was no answer so I sent a text instead. Hopefully they will allow me to pay off this debt in the way I agreed upon originally. It seems that even when you comply, you still get shafted and threatened and bullied into paying much much more.
  2. I have posted on here before with the same problem, but things have escalated today and I just need some advice please. I have a council tax debt which is quite substantial. I allowed the bailiffs a few months ago into my home because I wanted to sort this debt out and pay for it. So I signed a walking possession agreement. The agreement states.... "£100 by 25/04/08, then 3 months at £100 per month. Then balance by the 25/8/08" This in effect means I will pay £400 over the course of 4 months, April, May, June and July then the full balance by the end of August. I have kept to this agreement in that I have paid them £300 and owe another £100 by the end of this month. The problem being that I made one payment late. (May's payment) The bailiffs are saying that I have defaulted on this agreement therefore it is void and are coming to remove my goods unless I pay the full outstanding amount. I had some good advice from here before, it was tomtubby if I remember, stating that the agreement doesnt specify when the payments of £100 should be made therefore I have not defaulted on it. Anyway, I have received a call this morning from a B+S bailiff. He is coming round today to remove goods. I argued that I havent defaulted as per the agreement but he wasnt buying it. I am sure he will turn up today.... what do I do? I cant refuse him entry because I have signed the walking possession agreement... what other ammo can I use. Please help! Also, if he does remove goods, can he take my computer? I am a school teacher and have lots of work on there, including private information such as pupils results/class lists/coursework grades etc.
  3. The solicitor hasnt said anything about it. At the end of the day, they have been given 2 redemption figures, plus their fees and the estate agents fees. They simply want me to pay up so the house can be sold and that they get their money. But like I said before, its a case of financially I am seriously going to struggle finding the money. I feel gutted that I have to pay to sell my house. But with the current climate I took the highest offer going. My initial calculations left me with a shortfall of only about £500 which I could manage. But since then I have been charged left right and centre. Even silly things like a £15 charge from the mortgage company for a redemtion figure add up. Particularly as my solicitors have just requested a second, up to date, redemtion figure. Thats £60 in total for the 2 mortgages.
  4. Im sure eventually they will catch up with me if I did take that route. But in the short term, perhaps a year or so I can get myself back onto an even keel. Its a desperate course of action I realise that, but one that appeals more and more that I think about it.
  5. But the house has a buyer, which is why I am tempted to do it as the shortfall wont be much higher than it is now, plus I get the chance of paying over time. I had already tried to reduce the estate agent fees, but to no avail. As for the solicitors, they are only charging £400 which to be fair is very reasonably already. I could probably quite easily 'disappear' until I get my finances back in order. I earn a reasonable wage and just need breathing space. I am moving in with a friend so there wont be any trace of me anywhere. I dont plan on giving out my new address really
  6. I would appreciate any coments regarding the following... I am seriously in debt. With mortgage, credit cards etc. So decided to cut loose, sell the house and try to start again. I have defaulted on my welcome car finance loan, and with my egg credit card and am constantly being harrassed for money. I have a buyer for my house, though there is going to be a shortfall of around £2500 when all goes through. We are approximately a week away from completion now, but I received a phone call from my solicitors stating a problem.... This problem is to do with planning permission for a front and back porch, but can be overided with me paying approx £250 for an indemnity insurance. I do not have this money... in fact, I do not have the original £2500 shortfall that I need (most of that is from estate agent fees and solicitors costs) and am considering 'walking away' to save me the £2750 I now need. My credit history is already shot.... so another dent in it wont do me any harm. Because I have a buyer willing to pay for the house does this sound like a 'near' sensible idea. My gut instinct says just walk away. My sensible head says stay and sort it. Help.
  7. I desperately want to take on SPML also, They are now managed by Capstone Mortgages but for over a year now they have charged me £50 per month plus interest. Not to mention the odd £40 asministration fee's I can see on my statement, but have no idea why/what they were charged for. I fell into arrears just over a year back. They put a claim for repossession in and they were granted a suspended order. I have worked my butt off since then to pay back all arrears, and even though I only missed 2 payments originally (about £2000) and am now paying off between £150 and £300 a month I still owe them about £700. This is due to all the extra costs they keep putting onto the account. Luckily I have now sold my house (pending completion) and have the drive and energy to pursue these people. They pretty much rob you blind and take advantage of the fact you are vulnerable financially. Its not on, and the more people who challenge them the more chance we have of making them 'think' about what they are doing. Any template letters to get me started would be greatly appreciated.
  8. Firstly, they cannot just take your belongings, they need a walk in possession agreement which must be signed by you. They dont have it, As long as you keep everything locked they CANNOT forcefully, or unlawfully take your goods. Just refuse them entry and you will be fine. As for disputing the claim or trying to resolve the issue I am unable to help im afraid. Though im sure someone on here will help you like im hoping they will help me!
  9. Hi all, Im new to this forum and really hoping someone out there will be able to help me with my problem. A couple of months ago I received a visit from the bailiffs about unpaid council tax. I let them into my house and signed a walk in agreement with them. I know this was probably a stupid thing to do but I am trying to face up to my debts, pay them all off and start again. Anyway, the agreement was that I pay them £100 a month until I sell my home (it was up for sale at the time, I now have an offer and am just waiting for the process till completion to finish) and then pay the balance at the point I sell my house (using the equity) Anyway, I paid the first months no problem, but then just plain simple forgot to send the cheque off in the second month. My house is currently subject to a repossession order and I was so caught up with all that that I just forgot about the bailiffs (Bristow and Sutor) Anyway, I received a letter telling me I had missed a payment and that I was now liable for the whole debt. I phoned the company immediately, apologised and was totally frank and truthfull with them. They told me there was nothing they could do and that I had to pay the full outstanding amount otherwise my goods would be taken. Eventually I talked them round to accepting a payment by cheque of the missed months £100 plus the following months £100 as a gesture of good faith that I intended to pay. They did tell me that this would help but wouldnt guarentee that they wouldnt take my goods. Today I receive a phone call from the bailiff saying that they are outside my house and that i needed to go home to let them in. I explained that i had paid £200 in effect paying of the arrears so that the agreement was back on track but they were not having it. So I phoned the company direct... again, no help at all. They claim that I had broken the agreement and that was that, and that they were not in any position to call the bailiff off. Now im worried sick! Apart from the fact that the contents of my house are worth diddly squat I really do not want someone to take my television, sofas, wardrobes, computer, washing machine and other stuff so that i will be basically living in a shell! I feel so badly done by and just dont know where to turn for help! Please help if you can Thanks
