  1. Many thanks ODC. So I have a further year of fighting than I originally thought
  2. Hi All When my phones were received, it was not my signature. The delivery bloke went to a neighbour who signed for them. DD were coming out my account, cancelled them when moved due to no network coverage. I have not made payments in 2 years and 8 months, they now chasing me for this alleged debt which was after I moved. How long it be until the alleged debt is statute barred? I was in Scotland when phones were taken out, moved to England so which land law would I come under, 5 or 6 years? Scottygal
  3. If it was me, I would send them the following for all accounts, amend to suit, do not sign it, send PO not cheque and send it recorded delivery http://www.consumeractiongroup.co.uk/forum/general-debt-issues/20758-creditors-dcas-letter-templates.html template N.

We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act. We understand a copy of our credit agreement should be supplied within 12 working days. We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act. We look forward to hearing from you. Yours faithfully Mr A N Other

  7. Send them this prove it letter and edit to suit, send recorded delivery. NEVER speak to them on phone, just bullies Your name and address HFO Services Limited PO Box 342 West Byfleet Surrey KT14 6YX Date I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY OR ANY COMPANY YOU CLAIM TO REPRESENT ACCOUNT IN DISPUTE Dear Madam Re Account Ref You have contacted me regarding the account with the above reference numbers, which you claim is owed by myself. I would point out that I have no knowledge of any such debt being owed to *company*. I am familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question. I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods. Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment. I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question. I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions. I look forward to your reply. Yours faithfully Print name only
  8. DEBT and nice people do not match LOL, only nice people are on here to help. I know it is a horrible position to be in, especially when it ain't entirely your own fault. Hey Ho though we shall fight on and take things as they come.
  9. Yes they do add commission But if you do decide deal directly with T mobile and refuse to correspond to the hounds it will do Westcott out of their commission I am in work also, well meant to be LOL Good Luck Doll
  10. Have you ever received a letter of assignment from T mobile about the alleged debt or just notifying you that Westcot collecting on behalf? I cannot be 100% on it but I THINK Wescot are just a debt collection agency. I am sure someone will advise you better on that when they have a look. Scottygal
  11. Sorry for being bit rude but could anyone let me know where I can get a template letter to send the s10 please? Thanks Scottygal
  12. Lois Keep everything you get from HFO. Have they sent you a copy of what they have agreed to take from you or was it just all done over phone? If it was I would write to them asking for conformation of everything IN WRITING. As for T mobile, maybe it would be good to contact them directly because sounds like Wescot were only collecting on behalf of T mobile. I would still dispute the amount as it seems ridiculously high. Scottygal
  13. Bit much for a mobile account, must be full of charges. Not to sure on that side of things sorry but I am sure someone with much more knowledge than me shall be along to give you better advise. Good Luck Lois, keep your chin up and always smile Scottygal
  14. Hi Lois I am in a fight with HFO for exactly same thing. Did the letter they sent you say it has been assigned or being managed by HFO **** for collection? What postmark was on envelope? HFO sent me out letter making out is was from 3 but was their postmark LOL but was NOT an assignment, only saying being managed by HFO. Do you dispute any of the alleged debt? I would never had gave them card details, heard of occasions when they have taken more than meant to I have been fighting them and will keep doing so as I will NOT give in to their bully tactics and threats, full of hot air and very rude. Go by the good advice you receive on here from many very kind and helpful people. Scottygal
  15. Exactly Harry, I admittedly applied for the huge loan under pressure from controlling boyfriend hoping bank would turn me down, unfortunately they accepted and money was there same day. when asking reason for loan I said to buy car and clear credit card which I was not allowed to do when money was there. Maybe some people out there will say it was my own my fault, but nobody knows how bad a situation and mess I was in at time, always had do what that swine says. Thankfully now I am out it but there is no way I can pay this back, hence why I was asking could I possibly ask bank to write debt off due to circumstances? Up until that time of insanity I had an excellent relationship with my bank, unblemished record. Sorry for babbling on but I feel better when I come on here for a rant Any suggestions folks? Many Thanks Scottygal

  17. Thank you so much bank for your advice. I will do that as soon as I can afford the £10 to send as that is a lot to me on my very tight budget. I dread to think what they will send as I had banked with them for ocver 20 years, be similar to a yellow pages Scottygal

  22. Hi Red First thing to do is to send them this below. DO NOT sign it, amend to suit, send by recorded delivery, send PO not cheque. 1 High Street, Newtown, Kent R21 4RH June 28, 2006 The Loan Company Company House, Church Street, Newtown, Kent, R1 7HG Dear Sir/Madam Re:− Account/Reference Number 4563210025897412 With reference to the above agreement, we would be grateful if you would send us a copy of this credit agreement. 23. Thanks so much, if it wasn't for this site I have no idea where I would be. I just hope the people who will help me (should it get to court) are very patient as I am the proverbial blonde. Seriously though I ain't got a clue on legal stuff and how to word stuff in forms, not my strong point I'm afraid :o. Scotty
  24. Not had any calls since Sunday, must be something going on LOL. Until they correspond by letter only I will keep ignoring. Just hope they do not go for a CCJ against me like they threatened me with. Thought of court protocol terrifies me (health problems). Scotty
