  1. I've tried to look for a statement but can't find one. I'm sure it was over 7 years ago. Would it be classed as statue barred?

  3. I have had the catalogue since about 2001 but don't use it anymore, and haven't done for years. Surely as it is a CCA account I should be able to request a copy the same as loan companies?
  4. I have a debt with J D Williams and it has been passed to Lowell, then to Advantis. I sent a letter to Advantis with £1 requesting a copy of the CCA. I have now received a letter back from them stating that a catalogue account is not covered by the Consumer Credit Act 1974 and therefore a contract is not required to open the account. Is this correct? If not, how can I reply to their letter saying that they are wrong? Thanks in anticipation of assistance
  5. I am at the stage where I am so annoyed with Lloyds that I'm lost for words! Basically, a lovely payday loan company applied to my Lloyds account for the full balance, thus making me very overdrawn. I contacted Lloyds and asked how they can authorise such a payment that would make me overdrawn on my account, that didn't actually have an overdraft! I was basically told that the payday loan company can use a "special retail code" that basically forces the payment through so they can get their money. I then had to set up an arrangement with Lloyds to pay back the money owed. In the meantime, I have had to set up an alternative account with another bank to be able to manage direct debits etc. Now, the same thing has happened again, despite me cancelling my debit card with Lloyds. I was basically told that even though I have cancelled my card, any previous arrangements with companies would still be honoured! How ridiculouse is that She said to me that the transaction could have been in the system whilst I requested my card to be cancelled. I said that wasn't possible as I requested the card to be cancelled 2 weeks before the transaction on my account. I stated that I was not amused by this and asked for a copy of their complaints procedure - to which I was told that they don't have anything they can send me, only tell me how to make a complaint! I asked for the correct address to send a complaint to, and was basically given - Lloyds TSB Bank plc, Box 1, BL1 1LT. And that was the full address??? I have since checked on their internet page and found a different address. How incompetent are they to not be able to supply a copy of their complaints procedure, and then give me the wrong address??? Words just fail me!!!!:x:mad2: Has anyone had to make a complaint against Lloyds, and if so, how did they get on? Thanks for your help Sue
  6. I too took out a loan with QQ and phoned them to try and make an arrangement. I got the same response, saying that they couldn't agree an arrangement, but just to ring up and make payments when I could. The next thing I know is that the muckie hall ppl call me at work! I said to them that I do not know who they are and to write to me. I then received an email from QQ confirming the debt had been sold to muckie hall, and also had an email from muckie hall asking me to call them. I didn't. Then I get a letter on 13th August telling me that I must pay the debt by the 17th! It says that if I didn't make payment by 17th they would approach the County Court for recovery via a CCJ. I didn't think that this was allowed, as I haven't received any default notice. Is this right? I need to know what to do next as I would like to send muckie hall a letter telling them to do one!
  7. PDE have been the only company that refused my offer of payment and demanded an I&E AND a letter from my employer! They took the money anyway. They are quite rude and patronising when you ring them as well. I was basically called a "debtor" instead of a "customer" when I mentioned about the "Treating Customers Fairly" FSA guideline. They are pratts!!
  8. I have had problems with Payday Express and now they have taken £490 out of my account and the money wasn't available! I missed one month to rollover the loan and pay the interest of £80. I emailed them on numerous ocassions to say I wanted to set up a payment plan. All I had back was an email to say to call them. Then I spoke to them last week, and explained that I had financial problems and family issues and couldn't pay the whole debt and wanted to set up a payment plan. They wanted an income & expenditure breakdown, and a letter from my employer to say why my income had reduced!! As if I was going to ask my employer for that! I just replied to them to say that I wasn't going to ask my employer for a letter as this matter was personal to me and I didn't want work to know about it. I was so annoyed at their lack of understanding and help, that I hung up. Now, I have looked at my bank account today and they have taken £490 from my account, via my debit card details, and I only had £7 in the account. Now it has caused me so much stress as my account is now overdrawn and I will be charged. Not to mention the fact that I can't pay any further direct debits out or payments for mortgage etc until I clear the amount overdrawn. I phoned Payday Express and basically all they referred me to was the terms and conditions. I have looked at these, and it does say that they will keep trying my account for the money. How can they get away with this????? I was willing to make an arrangement and they just go in and take money that isn't there!!! They haven't even given me chance to do anything! I would like to hear from anyone who has had the same experience, and managed to do anything about it.
  9. Good idea, but I don't have the money for that kind of thing. I have a case with a solicitor at the moment which has been going on for 3 years nearly, which is to do with my late mothers estate, and a barrister is involved. I know their fees aren't cheap, so this isn't an option at the moment. Thanks for the advice though.

  11. I asked for confirmation in writing and got the guys name who I spoke to. He said he would confirm it, but still waiting! I will give them a call again and chase it up. However, I have had a letter from Eversheds to confirm that the hearing isn't now taking place. Best to get GE to confirm the arrangement though I suppose as well, just to be on the safeside! Thanks for your thoughts on this.

They agreed an arrangement to pay off the arrears over 24 months at an extra £38 per month. I know I could have probably fought over the interest rate, but I was making myself ill over the thought of going to court. Do you think I have done the wrong thing? Do you think I should have held out and tried to sort something? My idea was to ask the judge to change the terms under a time order. GE told me that their interest rate isn't governed by the bank of England so basically implying they charge whatever they want! I know.....I am a panicker!!

  15. Link STILL continue to call me, mainly on my mobile and leave messages. I did speak to them once, as they had left a message with just a name and number. I said that I hadn't had any notification that they were now dealing with the "alledged" debt. They said over a week ago that they would send a letter confirming this. Still waiting! I'm still ignoring calls. Until I am told they are dealing with me, I don't know who they are and don't have to confirm anything to them.....data protection and all that. After all, I haven't given them permission to call me! Toys well & truely out of the pram!!
