  1. It is the part in the POC regarding 'the claimant claims:- interest under section 69 I dont know what is the interest etc

Hi There, There is a bit on the POC that i am unsure what info needs to go in there (3) Interest under section 69 of the County Courts Act 1984 at the rate of 8% per annum from the date of payment of the Charge to date in the sum of £[xxx.xx ], and at the daily rate of [ xx ] until judgment or sooner payment. Could any body help me. I would be very grateful Thanks

  4. Hi Goldlady, I just paid for loan which had PPI was included in the payments. I am not sure if i was led to believe it was a condition. But i didnt have any idea you couldnt claim in the first 30 days. I have finished paying both loans now. Do I ask for a copy of any credit agreement to do with the loans etc.?? What would be my first move? I will take a look at the reasons on list. Many Thanks
  5. :-? Hi There I am not very clued up on the anything to do with PPI, the only thing i know is that i had them with my first two loans. Thinking back at when i took my loans out (this was back in 2005 so forgive me if i am vague), i do remember within 30 days of taking out the loan i was made redundant, struggling to make ends meet I phoned up to make an application for my PPI to kick in and help me until i got a new job. I couldnt beleive it when they said i did not qualify for anything as i cannot claim within the first 30days of the PPI this left me with the serious issue of having to find money from nowhere to make my payments. But that was the only time i would have ever needed the PPI and i could have it, but i still carried on paying for the insurance. i did feel very conned at the time when they said i could not make a claim. Does this qualify me to be able to claim back anything???
  6. ok I have wring a letter to request my Credit agreement as i dont have this. Also gives me a reason for including my NEW condition that i want default removing (they havent had any correspondence with this inalong with the full charges interest blah blah . I will file for a claim once i have the agreement. In the meantime i will prepare it. thanks x

  8. Hi there Thanks for your responces I havent sent a rejection or partial payment, but i could see other people have sent a part payment letter. If I have more options before taking to court i obviously want to take to those. In regard my default , yes they can take it off, i havent mentioned anything about this but now you have said and looking at my credit report it stills shows. Can i take partial payment and still request a default removal.
  9. Hi There, I am new to this site and have been scrolling through for some information that could help me writing my claim form out. I recently stated a claim with capital one on an account that was opened in 2004. To cut a long story short i recieved bank chargses totalling 302.18 (including interest) i fell into trouble with this account, paid the charges and the balance - capital one closed my account and through a default in there for me as well. I stated a claim to recover the monies and have received two letters saying they will offer me £64. I am not happy to take this offer. I now at the stage of filling a claim form out and i am not sure what i need to include.. Where do i stand if this account was closed with a default . I would be grateful for any feedback x
