  1. Computer throwing a wobbly!!!!!!:? I thought it was for a credit card- in that case I'm not too sure what prescribed terms are needed- I should imagine it mightn't differ that much- but more experienced peeps will advise. This reply will bump it back up to the top. Good luck:)
  2. Sorry to say Shane but it looks enforceable to me (just my opinion- others may disagree)- It's not a very good copy but it does seem to have the prescribed terms and your signature. Have a look at this originally posted by Rory and check that it has these terms. Sorry:( In order for a credit agreement to be enforceable it needs to contain all the prescribed terms. The prescribed terms need to be within the 4 corners of the agreement and not in a seperate document marked terms and conditions. The prescribed terms for a credit card are: B Repayments A term stating how the debtor is to discharge his obligations under the agreement to make the repayments, which may be expressed by reference to a combination of any of the following- (a) Number of repayments; (b) Amount of repayments; © Frequency and timing of repayments; (d) Dates of repayments; (e) The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable. C Rate of interest A term stating the rate of interest to be applied to the credit issued under the agreement D Credit limit This may be a term or the manner in which it will be determined or that there is no credit limit.

  5. Hi king63 which letter are you looking for - what is the account- loan/ credit card. Is it the one to request your agreement-the CCA? You would get more help if you start your own thread then it won't get swallowed up in PJ's thread. You will find your way around here....... eventually!!
