  1. just going back to the address thing? if you called them r.e the cert and they sent it, then they should have confirmed your name address,postcode due to DPA?, what address has the insurance company got recorded for you? Ask for the telephone recording etc if your correct address & theirs match, then this looks like a delivery issue and can be used in your defence. Under Article 75 of the RTA the insurer has to deal with the TP claims, but they can then pursue you for the outlay. If there are claims people on this forum, they might be able to advise further.
  2. DOC does not apply for driving in the EU, you will need to check the territorial limits of your policy. Some companies charge for EU cover and that will only cover the inured vehicle as this has to go on the GC. Again some companys offer 90 day trip cover to the EU but again this only applies to the insured vehicle as the cert will have the bail bonds,EU insurance agreement etc printed on the reverse
  3. as the docs had arrived. albeit with wrong address, you should have contacted them to amend it to the correct address then there would be no error in the issuing of letters. in regards to rippedoffs comments r.e ins companies should be unable to cancel without the return of the cert is totally unworkable, it is now stated in letters that if a policy is cancelled, the cert is invalid and remains the property of the insurance company and should be returned, it also quotes the RTA.
  4. DOC has always been open to abuse, but this benefit is slowly being closed off. Even though some companies do say that the DOC is only to be used in an emergancy, there is no definition of emergancy in the policys, so a hubby could drive the mrs uninsured car, but please take note the TPO cover only covers TPs whilst the uninsured vehicle is being driven, when its parked up on public highway etc its uninsured. Wording has recently changed (about time to) about using DOC to release impounded vehicles. but again there are ways round this for a minimal fee, like temp cover for 1 day is about 7 quid and the car is covered to drive away.
  5. some stolen car claims are not as open and shut as people think, they have to follow up any police report etc, where the car was stolen,where it was found,damage,signs of theft etc. the number of times "my car was stolen from outside the pub at about 12:30am,it was then found wrapped around a tree,with the keys in the ignition, I didnt realise it was stolen until the next day,when my hangover went". if you call and ask what is the present position with the claim, they should tell you what stage they are at, i,e a claims accessor will call you,we are awaiting for the crime reference number, etc

None of the insurance act on their own policy wordings, if you look it does state that if your are paying by instalments and you miss a payment they will cancel within 7 days from the due date, no company follows this advice they will chase for nearly a month and then cancel when it suits them and charge the extra.
  7. Think you must work for the same ins company as me (recently up for sale:)) From the work I do their claims handling is appalling. Colleague in work had his car written off and they didnt even tell him! just got rid and offered 3k below what he paid for it. Not even an offer just the checks in the post. Some parts of the group have a self authorizing 10k limit where they just pay the claim without any sight of V5, Licence, MOT.

I think he feels if he holds onto the log book the ins company cannot become the legal owner if it is deemed a total loss until he accepts a better offer, although they should make an first and you can then counter their offer with a local ads for the same type of vehicle at the price you think it should be.
  9. i Thought they couldnt do that? if a customer had to say produce evidence of insurance to the Police etc, we cannot refuse to issue them a letter if they were on cover at the time and were fully paid. I know Tesco has recently introduced this practice r.e withholding ND if there is a premium outstanding.

How many years did your son have before he went to the company? if he has always been insured by that company and has built up a number of years, you could ask for a letter to confirm how long the policy has been in force and to note the number of claims made etc up to the date of the missed payment etc As far as I am aware they have to provide you with this information for the period of cover you have paid for.

As per above, if the company has applied for the money by DD and its not there then they will send letters etc. However, if you have cancelled the DD instruction at the bank, this can be seen as a cancellation by you of the policy. Some companies do have this written in their policy wording under the payments part, but Ive never know a company to follow this wording to the letter, they would like to try and get the money 1st
