  1. Hi, they defended the case, and judge struck my case out without a hearing. said, there was no chance of me winning
  2. I've today sent them a CPR 18 Request via Special Delivery I know there is a risk here of them turning up with the documents, but if they cant, this will also go against them wont it?

  4. I have claims in the court which are stayed, tomorrows findings will not see all our claims to now be heared? So you saying, if we win tomorrow we can then go overdrawn and the banks wont be allowed to charge us?

  6. After exhausting all avenues on trying to get the creditor to remove default and evening receiving a letter from them saying the original lender can’t provide the credit agreement. Original Creditor = Peoples Bank – Debt 1998 (Signed agreement) Around 2001 City Bank International took over Peoples Bank 2004/5 the defendant purchased the debt from City Bank It would appear Peoples Bank when they sold the company lost the paper work Despite this, the defendant said no legal action to enforce the debt would be taken but the default will remain. I issued a Section 10 notice pursuit to the data protection. This was ignored So 23rd April the county court accepted and issued the above claim but with some amendments. Now need to write up my statement of case, as the defendant told me they would dispute it. Don’t know how they intend to as there only way out would be to produce the credit agreement if they can’t then I would assume I would win the case here. What are your thoughts on this?? Would need a little help with my statement of case aswell as this would be tricky
  7. Hi what are skeleton arguments and how would you write them? its more for my own notes then anything. so when i talk about my case in court, i know what needs to be said and talk about any issues so i dont forget etc
  8. going from what ive seen on here, someone needs to take legal action simply getting fees refunded wont fix the problem as they will just do it to the next person. do you know, where i can find the judgement info on other cases?

  11. Question if i may 1. If a judge thinks you owe the money but no agreement can be produced, and the law says it cant be enforced. Can a judge still make an order as he thinks the money is owed ? I know you are going to laugh at this but when applying the law to court cases it can have many outcomes depending on how the law was Interoperated by the judge

  13. If Judge John Deed was the one looking at the agreements, we would all win, but Sadly this is not the case so should we all be scared of the outcome??

  18. We need to come up with our own scripts that will wind them up!! if we all use the same script, everytime they call we use it, they would soon notice that every call they make is hit by the same questions lol

  22. hi I am living with my mother of which she uses E-On Pre-payment meters. so there is no way there can be any bills from Npower and Certainty not in my name. Can Npower cut off supplies to that of another supplier ?

Hi, After experience I had the other day I got a call from someone claiming to be Sky And for me to confirm my details as per data protection etc. After I confirmed my address he then went on to say he is calling from interim Justine regarding an account. I said, I thought you said you where from Sky (He lied) so I would confirm my details. Anyway moving on to matters at hand here. I received a Letter today from Debt Managers Ltd claiming I owe over £500 to Npower. I have lived at my current address now since May 2007 and I am not the bill payer for this address. I sent Debt Managers LTd the below Letter in return. Do you think this is the best way to handle this?

The worst bank out there for this has to be Lloyds TSB Bank whereby they charge £15.00 per day for unplaned overdraft usage this is what winds me up a direct debit gets returned unpaid due to (a) your wages are late, (B) you dont have enough money. The Bank charge you £30 for returning the payment as unpaid to which there fee puts you into a overdraft to which you did not agree. they then charge you £15 per day oh and the company who should have been paid, Also charge you a late payment fee of say £20 so for example if your wages are 5 days late you would have to be £105 Bank Charges + £20 to the Payee Company totallying £125 Do you think this is fair? I for sure dont
