  1. Hi Silver Fox, can I ssume then that Lowell will just keep pestering me for this debt but through there other sub companies? Is it possible that they can default me on this even though they are not the original creditor and it is over the6 year statute barred rule? Is there not some form of action I can take under the CCA that once the debt is statute barred it can no longer be sold to other companies?
  2. Hi, I've recently found a letter from Lowell for an old debt from June 2002. I am certain that the debt is statue barred and have a letter ready to send off to them tomorrow by recorded delivery. How long do they normaly take to reply if at all? Where do I stand if the debt is sold on or passed to another division of the group as I am aware Lowell has many different sub companys? Is there something I can include in my letter in order to stop repeat letters coming from other DCA for the same statue barred debt? I have included the PLEASE NOTE THIS LETTER IS IN NO WAY AN ACKNOWLEGEMENT OF THIS ALLEGED DEBT TO YOU OR ANY COMPANY YOU REPRESENT. I have also not signed the letter only printed. Is there anything else I should include? Many thanks.

  4. As I suspected I have received a CCJ from Banatynes fitness from 2007. I have recently been having problems with obtaining credit and after a credit search found three defaults and a CCJ. To my knowlege I never received any paper work from Banatynes or the County Court regarding this. Although I did have a period abroad from late 2007 to 2008. As far as I am aware I completed my year contract and was under no obligation to renew my contract with them. Please could someone advise me as to my next step regarding this CCJ as I understand laws regarding CCJ's are different. If I find the debt is correct is it possible to remove the CCJ (upon settlement) or am I stuck with it regardless of payment. I am under the impression that if I didn't receive the paper work there are legal avenues I can persue to remove the CCJ. I currently have about 6 months off work due to injury and so can devote a large amount of time to this matter. Any help would be appreciated.

  7. Hi all, back in April 2009 my contract was up for renewal with Vodafone so I opened negotiations with them regarding an upgrade and possible new contract. After speaking to Vodafone I decided I would probably leave and go to O2 as I wanted the iphone. I have been a Vodafone customer for over 5 years. After a few days I was called by Vodafone and I notified them I would be leaving and defecting to O2. I was asked if there was anything they could do in order to retain my custom, my main reason for leaving was that Vodafone did not offer the iPhone. (they can spend 50 million on F1 but can't win the original iPhone contract nor provide me with a signal where I work. Orange, O2 and TMobile can.) After a few futher days I was contacted by the "people thinking of leaving Dept" I was then offered the HTC magic phone and free insurance etc. I informed them that I would consider it out of customer loyalty. After yet another call from the same Dept I decided to save all the aggrivation of PUC codes, disconnection etc I would accept the upgrade (HTC Magic) and sign another 12 month contract on one condition. This is the important part "SHOULD THE IPHONE BECOME AVAILABLE ON THE VODAFONE NETWORK IN THE NEXT 12 MONTHS OF MY CONTRACT (APRIL 2009-APRIL 2O10) I WOULD BE UPGRADED FREE OF CHARGE WITH NO EXTENSION TO MY CURRENT CONTRACT." After being placed on hold I imagine for the customer services guy to speak to a supervisor I was informed that this was OK and they were happy to go ahead with the upgrade/contract renewal. I then asked for the notes on my account to be read back to me to double check the conditions. I was happy with what was written after a few minor adjustments and proceeded with the new contract/upgrade. As I'm sure you are aware now the iPhone comes to Vodafone in Late January. I called them to ask about my as promised upgrade per the conditions of my last contract. Only to be informed there was no notes regarding this on my account and I would have to wait until April in order to get the upgrade. As you can imagine I was not impressed and asked to speak to the original person who I spoke to. I asked to be called back but received no call so after 5 days I called Vodafone again. Someone again went through all my notes and found nothing and I was then spoken to by a supervisor who abruptly told me that no such condition would ever have been agreed (in affect calling me a liar) and there were no notes relating to the iphone on my account and I should wait as in his own words "its only a few months anyway until your entitled to the upgrade". I have to admit I knew the O2 exlcusive deal with Apple was coming to an end although I didn't know when. But I still feel I have been treated appaulingly by Vodafone and basicly I've been called liar and decieved into accepting a contract, I would otherwise not have. If Vodafone would have not agreed to my condition I would not have taken on the new contract. Sadly I did not get anything in writing. I'm considering just paying up my contract with them and taking my business to O2. Any help pointers would be appreciated. Although I don't hold out much hope.
  8. Hi, I am in the process of looking to remove defaults and possibly one CCJ (from Bannatynes). I understand the 6 year rule regarding Statute Barred etc. What I would like to clarify is that "IF" I submit a SAR or CCA request does this mean I am acknowleging the debt and so resetting the clock on the 6 year rule ???? All of my debts are pre 2007

  13. I have a debt demand from an O2 account which is £100. This O2 account was terminated in the 28 day period and O2 have confirmed this to me over the telephone. I asked for this in writing but they refused to offer me any sort of customer service as my account had been sold to Lowell/Red. I have spoken to both O2 and Lowell/Red recently (a mistake I now know) In the summer of 2006 I spoke to O2 before I was aware of the account being terminated in the 28 day period and agreed to pay £60 to settle the matter. I asked for in writing this agreement but this never arrived. The account has since been sold to Lowell/Red and a further £40 added, which they assure me are not their charges nor O2's???? I offered to pay the original agreed £60 to Lowell/Red, but they refused and only offered me a 10% discount if paid the same day. I asked them what the extra £40 was for and they could and would not give me any information. I contacted O2 who then informed that the account had been terminated in the 28 day period and they could not see any outstanding debt ???? (confused) I asked for O2 to confirm this in writing which they said they had no obligation to do! I originaly would have been happy to pay the £60 as agreed with O2 but now they inform me the account was closed in the 28 day period and there is no debt? What do I do? Advice please!
  14. Hi everyone this is my first post and it seems after reading through the other threads its best to start my own thread regarding my current situation. I have today received a letter from Red debt collection regarding a Capitol One Debt for £1500, my original balance on the card was £750. I have not spoken to Capital One, Lowell or Red Regarding this debt. I can not remember how long ago this debt goes back but I thnk it is at least 4 years since I had any contact with Capital One. Todays letter is a "Statutory Demand Processing Unit" Please could anyone advise which steps I need to take in order to resolve this matter and have the debt removed. I also have another case with Red regarding an O2 account I had, which I will start another thread in order to hopefully have some help with. Direction and help would be most appreciated.
