  1. Has been 4 years since my last post on this thread, and tonight I got a call from Argos Card Services. I told them I would not discuss anything over the phone and they would need to write to me, so they said, we will write to you and tell you to phone us. I said "no, I will be doing everything in writing" This is easily Statute Barred by now

  4. As mentioned on another thread. Upon checking my wife's credit file, Barclays have changed her status to deceased ???? This seems to have been done back in 2009 The account will become SB'd in May next year, so not sure if I want to rock the boat
  5. Upon checking my wife's credit file, Arrow Global have changed her status to deceased and the account settled ???? This seems to have been done about a year ago, how can they do this without evidence? Barclays have also done this to another account on her credit file

  7. Fast forward almost 3 years and I now get a letter from DLC acting on behalf of Hillesden Securities (Formally Lloyds TSB) offering £10 a month or pay 50% and write the rest of it off. Am still waiting for my CCA request from over 4 years ago !!!!! Also there is no trace whatsoever on the credit reports????
  8. Apparently my wife is dead !!! That is according to the latest letter we got from Phillips & Cohen on behalf of Britannica Recoveries S.a r.l- Arrow Bunch of numpties probably think we will phone up and say she isnt dead, but will let them think what they want!!

  14. A new shower of you know what has this now. They are called Ruthbridge Limited and I got a phone call of them because I have been ignoring their letters. The lady on the other end of the phone got frustrated as I refused to go through security until she gave me her name, first line of her address, her postcode and her date of birth !!!! She said it was none of my business and I said neither is her asking me those questions as they have no authority to and could be attempting to steal my identity !!! Was good fun and put a smile on my face. I got another letter off them today saying they would offer a 50% discount, and that they are sending someone around to discuss the account. Normally I would send a doorstep letter, but I would prefer them to send someone for me then to laugh at in person !!!
  15. Almost a year on and Pinnacle have sent me the first letter that appears in post 80, but with updated dates. I will await the next one in a few days time

  17. Link/MBNA are taking my wife to court and so far we have had to submit a N244 application to force Link to provide the documents they mentioned in their POC. They replied with a copy of the agreement (that I now have several copies of), a reconstituted DN, the NOA and DOA. If or when it does go to court, they have to produce the original documents. How can I find out, if they actually HAVE the originals, or they are just trying to blag me with file copies. I have searched all over but not actually found an answer, or is it just as simple as asking them in writing?? Thanks
  18. Had a reply from Link today with the following: They then go on to say that I have until x date to submit my defence, as stated by the DJ in the ruling of my application. Straight away, there are a few things I noticed, so will deal with them in order: a. The credit agreement is the same one they sent me ages ago (Post 18 ) , that is clearly a microfiche copy, and I cannot read the terms on the second page again. The separate terms and conditions have no relation to the agreement, but it states "Please refer to your credit agreement for conditions 8 & 9" which are impossible to read. The DN also made reference to sections 1b and 8. There is no 1b on any document. b. The reconstituted DN they sent me, has different dates on it compared to the one I received in post 48 and also the reference number are different. Where it states the Reference Agreement Number, on the original is shows Link's ref number and on the new version it shows the MBNA agreement number. They claim the DN was issued on the 18th September 2008, but the original shows as 22nd September, and the date to remedy as 7th October 2008 as opposed to 6th October 2008 on the original. They have in both cases failed to request the arrears but instead request the full amount. I don’t know what the law says about reconstituted DN's, but the one they have done has many mistakes!! Also, in the POC they say a default was recorded on 30th July 2007, a default was recorded, but the DN was not sent until a year later. I don’t understand this properly, but someone earlier in the thread said it could be down to the banking code. The account was terminated on or after 6th October 2008 according to the DN, so therefore there is no agreement. How can they enforce a terminated agreement? c. The Deed of Assignment, is basically a letter from MBNA explaining the Offer of Receivables and the second page is just a list of names, amounts and account numbers, all blacked out except ours. d. The notice of assignment they claim to have sent, has a date of 28th August 2007 on it, mine says 23 Feb 2009 (over a year later) and another from 25th October 2010 (3 years later!!!!!) and all have different amounts on them. There is no letter from MBNA. I think I have covered anything, and advice on what to do next would be appreciated, as I have 5 weeks to submit a defence. Thanks
  19. Quick update Letter from the court today to say that Unless Link comply with my CPR request by 4pm on 2nd May, the case will be struck out Tick Tock !!
