  2. Debt (Default) is for a loan but that is to come to its 6th year next month. Hopefully, this should be resolved?

  5. Thanks for your reply. I am concerned about the Default as the DCA is just keep increasing the payments. The payments they ask for are beyond my means but I am making them because I am just sick of them sticking their nose in my personal financial affairs. What could be done about it? You said that the default should just fall of Credit File after 6 years but if I made any further arrangements to reduced payments, will that give DCA an opportunity to put the Default back on the file?
  6. A few months ago, I canceled my telephone/broadband services with NTL after my contract had expired. However, there were some extra charges on my final bill which I contested and decided not to pay until a new final bill was issued. They never responded to me but then they added a Default notice. I was very annoyed because instead of dealing with the complaint they just put the default notice on my credit file. I couldn't get any joy from them so then I decided to settle the account but now I am stuck with a default of £97 on my file for complaining. It is satisfied but it is an adverse information as it is new. I cannot recall them sending me any default notice. Is there any way I could have this default removed?
  7. I have a CCJ which I had been paying but then the debt was sold on again and the new DCA wants to have my Income/Expenditure to make a new agreement. But I am sick of providing personal information every time they sell the debt on. I find it very annoying so this time I wrote back to them and told them that I will continue with the payment that was agreed in court. Now they are threatening to send field agents and their charges will be added to the debt. My questions are; Can they add more charges to a CCJ? Do they have the power to ask about my financial details? I am not hiding anything but I hate them to intrude. In fact, I am paying them more than I can afford. Can they legally ask for bank statements etc?
  8. Hi, I had a CCJ over 5 years ago and a default nearly 6 years ago, both with RBS who have sold these debts several times. I am paying regular monthly payments but I wasn't aware of Limitation Act. I heard that the limitation act applies if no contact was made between lender and debtor for 6 years. However, if the debt was sold several times then I believe the situation is not the same even though I kept in touch with the lender? Am I right? My questions are; Default: Default debt is reaching 6 years next month. Will CRA remove the default automatically? Can the same debt be put back on the file if I missed my regular payments? If after 6 years had passed (next month) and I decided not to pay them anymore. What actions can they take, bearing in mind that the debt was sold several times? Can they take Bankruptcy or Court route in these circumstances? CCJ: I believe that CCJ does not come under Limitation Act 1980 but can the DCA add their charges to the debt as they have threatened to do so but I am told it is illegal as Interest and further charges cease with the issuance of CCJ. What is the correct position? Will the CRA remove CCJ automatically? Can the CCJ be put back on again if defaulted in future? Cheers Jay
