  1. I contacted the above company regarding a credit card. I owe around £6k on the card and they have said that the have carried out an audit (presumably of information I have given them) and they think I have a claim for PPI refund and unenforceable agreement. As far as I know they have not seen the agreement as there was only a few days between them reciving my letter and them completing the audit. It seems risk free as they promise refunds etc if their solicitors do not take the case on and to be honest I'd pay the £400 they ask for to get rid of the debt and get a refund of PPI with no hassle to me. How can they have carried out the audit without the agreement. That's what I do not understand? Their websites are here.   3. When the T&Cs are sent as part of a request under the CCA do they have to be the ones that were in place at the time the agreement was entered into? If they do and the T&Cs received are different, and can be proved to be different, what are the repercussions of this for the creditor?
  4. Some advice would be appreciated please. I have received a copy of my credit card agreement from provider. What gives the credit card provider the authority to vary the interest rate? Does it need to say anything specific as per any schedules? Have they missed a term or a prescribed term? All mine says having stated the introductory interest rate for 9 months is- "In working out APRs we have ignored any charges we make to the interest rates, handling fees or any other chargeswhich we introduce or vary at any time by giving you notice under condition twelve" Perhaps interestingly there is no condition twelve. Does the omission of an explicit condition make it unenforceable or can I use it to my advantage in any way? It does not say what the interest rate will be at the end of the term nor does it say what it is at the time the agreement was entered into. Thank you. Lapis.

  7. The Courts will not hear any cases in respect of excessive charges and neither will the Ombudsman. This has played neatly into the hands of Barclays who are adding £200 in interest each month to an £10k overdraft. We know that this case with OFT is likely to go to appeal whoever wins and that may be say 2 years away by which time the overdraft will be around 15K. The have said they will transfer it into a loan but of course that means that I will lose any right to reclaim charges they have already stuffed me for. It's worrying me sick and any advice would be appreciated. I can not believe how the Courts and Ombudsman inaction has been turned to the advantage of the banks. Thanks. Lapis
  8. I had a computer from PC World funded by them and it had PPI cover. I have paid the loan off now but could I lodge a claim for refund of PPI do you think?
