  1. The issues surrounding clamping seem to be the companies that act unscrupulously. They've had their chance to act reasonably, but the SIA is a complete failure. I've no problems with a ticketing system if it was to operate in exactly the same way as council PCN's ie. standard signs and conditions, 'private' off street parking orders, a central funding pool as we see with landlord deposits and an appeals system run by PATAS/TPT (not the BPA).
  2. Excel lose on inadequate signage You'll have to grit your teeth at some of the poor journalism, but still a useful result because we all know how tiny the text is on Excel and VCS's horrendously designed signage.
  3. The bill doesn't explain anywhere near adequately what the keeper would be liable for, let alone how liability would arise. The BPA want to be the independent body who oversees appeals, which looks unlikely considering the government won't fund it, and considering the BPA aren't neutral or independent in the slightest.

  6. Sit tight and only respond to stuff from the court. Watch your back and make sure the hire company don't try it on.
  7. With the ongoing one they have sued the keeper, who wasn't the driver. Last I heard Trethowans were begging the court to order the keeper to name the driver. Civil Procedure Rules do not contain grant such power to the court however.
  8. Norwich Pharmacal Order. I doubt they've bothered with one of those, they're too expensive. I've seen Trethowans ask the court to make an order to name the driver when they've been stupid enough to sue the wrong person. But the court has no legal powers to demand the information through only civil procedure rules. To me it sounds like: • Trethowans sue the hire company • The hire company have ignored and been given a default judgment • The hire company has woken up and tried to set the judgement aside by naming you at this late stage Or have Trethowans amended their own claim? Are you getting this paperwork through the hire company? So at the moment it still has nothing to do with you. Wait until the court claim actually drops on your doorstep. Your dad doesn't have to go to court, he can submit evidence and ask not to appear because of his condition. The issue is whether the hire company is suddenly going to pile loads of unauthorised charges on your card. I would ring the bank and instruct them not to accept any debits from this company and to treat them as fraud.

  10. Thanks for that. Reasonable is undefined. The DVLA charges £2.50 for their administrative expenses when selling registration details for example. I'd still bet nothing would come of it if you didn't pay the £26. I see no mention of the £10 'penalty'. If you were Midland Expressway Limited, would YOU take anyone to county court if they had failed to pay £20?
  11. What are the two contraventions? tell us word for word. Even better, scan in your letters.
  12. I'd pay them the £5.30 (or whatever) + 46p for their stamp. They're just a limited company and so have no special powers when it comes to payment. Expect some threatening letters from debt collectors and the charge will go up and up, but they'll go away after a few letters. I suspect you may end up having an argument if you go through the toll again in the future because they may have your numberplate on record, but they can't actually do anything.

When NCP work for a council, they tend to operate under the NSL umbrella (they like to keep the unscrupulous ticketing activities of NCP separate from their legitimate council Penalty Charge Notice business). Unless your NCP or NSL ticket states the 'Traffic Management Act 2004' on it, it should be ignored.
  14. He blamed the defendant for not informing Devere they were not the driver (as if it would make any difference) and stated that the charge would have been due if they had been the driver. To quote "he seemed to have no idea about contract law". I think the defendant thought it was best to just get out of there as soon as possible.
  15. Court claim dismissed today because the registered keeper wasn't the driver. Devere didn't bother turning up again. I believe this was heard by Williams's best buddy who was a bit miffed he had to dismiss the claim
  16. What choice have you got? Even if you pay it won't go away - PPC's are well known for pursing payers and much as non payers. If they find someone who has fallen for their con they often send more letters demanding more money in the hope they'll send another cheque.
  17. Just ignore them. You don't owe them a penny and they;ve never ever done court anyway. Tell the keeper to just expect some junk mail from Central, Roxburghe and Graham White and that they will go away if ignored.
  18. The issue isn't about breaking the rules - this is all contract law. There are no powers in law for private companies or citizens to 'fine' people for breaking whatever rules anyone feels like making. Otherwise they could attempt to extract £100,000 from every person driving a blue car. These people are still in business because not everybody is as clever as you. A lot of people never bother to Google when they get one of these tickets and have no knowledge of contract law or what a debt collector is.
  19. What county are you in? If PCSOs have traffic warden powers in your area it sounds like a job for one of them.

  21. By that reasoning, why shouldn't the hospital hire out deckchairs in the waiting room? Why shouldn't patients wait in the rain outside until they're summoned inside? Where do you draw the line? This is 2011 and transportation by car is the norm for the majority. It's not about funds being diverted away from healthcare to fund parking - it's about squeezing every penny out of everything, whether or not it makes life more difficult for patients before they walk in the door.
