  1. Is that 6 months from the claim becoming time barred? If so I will now be out of time, as they only let me know that there was a problem in May.
  2. Thank you becky for you input. I will seriously consider putting in a complaint as I feel they could of handled this better. I've spoken to a few colleagues that have had to deal with my old firm of solicitors and they say that the firm would'nt touch a case if they knew they had less than a 50% chance of winning.
  3. Just a quick update..... I've received the paperwork from the new solicitors and have signed all the contracts. The claim will be for 'Professional Negligence. The new solicitors think the previous ones will state that 'the claim would not of succeeded in any event' and they will deny liability. Would they of strung this out for over 3 years and sent me to Harley St to see a specialist if I had no chance of success?
  4. Just a quick update. Received a letter from my Union HQ stating 'the limitation period has not been complied with and so the claim is now out of time.' They have now nominated another panel of Solicitors for me, so have to wait for them to contact me. Attached letters from my previous Solicitors stating they served a summons but they were 20 days out of date. They say they were waiting on the outcome of various 'test cases' before issuing a protective summons. But having so much to deal with my case got 'overlooked'. I'm hoping the new Solicitors deal with this and not just drop it.

  6. It has been passed on to the union solicitors. I had an interview with the solicitors PA back in November 2009 where all details of the incident were put in a statement. The solicitors have also sent me to see a specialist in London. My employers denied liability. I've had correspondence from the solicitors over the past 3 years. So I'm assuming someone did'nt dot the i's and cross the t's somewhere along the line.

  8. Was'nt sure where to post this thread I had an Accident at Work back in Jan 2009 and sustained a leg injury. A couple of months after the accident I decided to put in a claim as I was still having problems with the injury. I have had numerous treatments, physio, injections, operation, accupuncture etc the leg is still not fixed and recently had another MRI and another possible operation is on the cards. I received a phone call from my solicitor a couple of weeks ago stating that there is now a problem with a time issue. Basically I think she was telling me they have messed up and she said they would probably claim my compensation through their insurers. I've received no paperwork stating this as of yet. Is this a common problem and what is likely to happen? I'm guessing 'time' has run out due to everyone(including me) thinking my leg injury would be fixed by now and everything done & dusted.
  9. No adjustments at all. I get told I need a fit note otherwise go home. Though on the 29th December I told them I was having problems with my leg and they did keep me indoors for 2 days, but on the 31st they told me I had to do my normal work due to no cover. It seems very hit & miss hence me wanting to get this sorted.
  10. I had an accident at work 3 years ago which caused injury to my leg. I've had ongoing treatment since then and 1 operation. I am still having problems with the injury and take painkillers/NSAID's as and when needed. It looks like I may need more surgery. This affects my work quite a bit and I have trouble completing my job due to the pain. I tell my employer that I'm having problems with my mobility. They tell me to go home as I'm no good to them if I cannot complete the outside element of my job. Can they do this? as it goes on my sick record which triggers an attendance issue warning. Surely this injury comes under DDA? if so how do I go about getting my problem acknowleged by my employer. I did fill in the Industrial Injury paperwork back in 2009 and attended a medical. So not sure where to go from here.

J4H's ........it may of been theft but more likely to have been the machinery that has neatly sliced through the top of your envelope allowing the smaller card to drop out whilst going through the machine sorting process. This happens quite often and if your complaint is logged when the card is forwarded to the unaddressed mail unit in Belfast it could be returned to you once they've trawled through the 1000's of items they receive weekly. If that happens I hope you will come back and amend your thread title.
  12. Just a quick update. Its been a while since I posted(forgot I had an account on here). Anyway I had the op on my knee and everything appeared to be ok apart from the pain running down my thigh. Luckily I had cleared all my Stages before I had the op so triggered a Stage 1 on my return which was issued. After re-hab at work for a couple of weeks it appeared the knee was'nt too good and have spent the past year on and off cocodamol/diclofenac. Have had accupuncture aswell. Anyway it looks like I may need yet another op. Still no news on the claim front. I attended an appointment in Harley St March 2011 and still waiting for the consultants report to come back. I did receive the report last summer but the consultant had put the wrong dates in so it had to be returned to be ammended.
  13. Forgot to add the Sony Centre which I purchased the TV from has gone bankrupt so the warranty is'nt worth the paper its printed on. Anyone know where I can go from here?
  14. I have had to resurrect this thread. I did buy myself another TV, a decent one. Sony Bravia for £499 with a 5 year warranty. That now has a thick black line running down the screen after 3 years & 2 weeks. I purchased it from a Sony Centre which has since closed. I have contacted Sony direct and they say the store in question deal with the extended warranty and the stores are nothing to do with them as they are franchaises! I only bought that TV because it had a 5 year warranty and I did'nt want to go through all the grief I had with the previous TV.
