hi all
i haven't been here for a while still having crap with these people sometime in 2019 had another letter want to review your account, sent them a nice letter explaining that this was being paid through the courts and not to contact me again as i was going through cancer i did not need the stress
then in dec 2019 then i got a call from a lady from lloyds about the complaint i had raised i told her that i do not want any more calls because off all the stress i was under with my treatment, she said she was going to make a note to say i was receiving treatment for cancer which i thought that would be the end off this matter, i received a letter from lloyds bank thanking me for taking time to speak to me about my complaint
here goes
Im sorry for any upset or inconvenience you have experienced I understand you are concerned about the letters you are receiving from moorcroft you want the letters to be stopped as you are making regular payments per month agreed by the court
My Decision
im holding your complaint on the service provided
My findings
i can confirm we have contacted moorcroft and the have explained the reason you have received the review letters is they were not aware the variation order was still in place with the court
they have confirmed they will be writing to you to confirm the payments are being received as agreed with the court
if i have any queries with regards to your account you will need to contact moorcroft direct which i never heard anything else till today
hounding me again with one of their review letters
we now you are making regular payments, we want to ensure this remains appropriate any change to your financial or personal circumstances
if there is no change there is no need to contact us at this time
they're still hounding me
the'rey lucky to get payments at all as i lost my job last year

im going to keep paying lloyds per court order telephone calls have started now

we do not appear to have received any contact from you in relation to our previous letter
we have now taken over the administration of the repayment account on behalf of lloyds bank plc
(they said that in the last letter )
we understand that you previously had a plan in place and we can confirm that we are happy to continue with this arrangement( yeah right) please contact us in the next 7days so we can confirm the repayment details and discuss your prefered method of payments
we must point out that we are committed to attempting to help you re-establish your previous arrangement or to agreeing an alternative arrangement that you can afford and maintain
How ever if you do not contact us you may leave us no option but to recommend to our cleints that they consider taking further debt recovery action against you ( they already have taken this to court )
which we will involve us making further attempts to contact you via letter and telephone calls please do not ignore this letter if you need assistance please contact us

well another letter arrives today from moocroft:-)
we acknowledge receipt of your recent payment against the above debt which we note was made direct to our client,
we would refer you to our recent letter which informed you that we are now responsible for the collection of your account and would therefore ask you to contactact us within 7days of the receipt of this letter with an offer of payment
it is inportant that all future payments are made directtly to us in order that we can ensure that your account is adminsterted correctly
this will assist in ensuring that no further collection activity will recommence
any payment must be attached to this letter and made payable to moorcroft ltd alternatively please contact deatails below

hi andy i am ok thanks i now it looks as if its starting all over again

well it as arrived letter from moorcroft telling me to get in touch cancell all standing orders the account will be managed by moorcroft and not lloyds they want a new payment plan

hi all need a little bit of advice again on this above
received a letter supposed to be from lloyds bank saying they have passed this account on to Moorcroft
this was taken to court in sept 2009 which they won
i have been paying instalments ever since and asking for the full amount can they do this?

Hi Dorabell,
Barclays were slow to post the default marker which should have been made in mid-2008, not March 2010.
However, regardless of the content of their letter, you say the marker has already been removed by them, in which case, there's no need for further action.
Keep an eye on your CRA for a while, just to be sure.

This letter is to let you now we have finised our investigations into your complaint and to tell you your decision i would like to assure you that we,ve looked in to your complaint very carefully:-)
About your complaint
your complaint was in summary
you have been reveiwing your credit history with the credit history with theCRA you have noticed an entry placed by barclayloan on the xx november 2001 you would like to now why this is still being reported on your credit file it defaulted on july 2008
you would like to now if barclays are aware that we are not allowed to report this to the CRA after a period of six years as seen by the date it is event it has been over six years and barclays are now in breach of this
you require to this to be removed
Our Decision
having search our internal records i can confirm that the default on your barclayloan was registered on march 2010:| as you have correctly mentioned
this will report on your credit file for six years from the date of the default has six years have not yet passed:???: there has been no error in this currently still reporting on your CRA as such i am unable to agree with this complaint:lol:( it has been taken off since )
if however you still beleive your CRA is still reporting incorrect information please supply us with a copy of your SCF this will cost you £2 showing this negative data and forward this to us i will be happy to open your complaint up again we will refund if action is have effected your credit file:| i do hope this has answers your complaint fully thank you for taking time to complain to us and hope you feel confident in letting us now again in the future

please get in touch with us if you would like further explanation of our decision if there is any thing you think i have not consider and you have more information to share with me let me now right away and ill be happy to look into this again
or i have the right to refer my complaint to the FOS free of charge you must do this with in six months of the date of this letter if you do not refer your complaint in time the FOS will not have the permission to consider your complaint and so will only be able to do so in a very limited circumstances

That's Barclay's for you ? They do have 8 weeks in which to respond to a complaint and it looks like they are going to take every second of that 8 weeks.

This has been caused by an apparent system fault at Barclays.
Old defaulted accounts and accounts that have been satisfied by Full and finalicon settlements have been getting reported once again to CRAs.
Barclays say they will be contacting all those affected by this problem.
You'll possibly be in line for some compensation as well.

Debt should only be on record, if there is a continuing credit arrangement you are continuing to pay. Even then the default incident which is over 6 years old should not be on there.
