  1. we go to court on this next week and i would appreciate someones response on it......have been ill in bed for last 4 weeks so unable to come o forum
  2. sorry to everybody who has helped me for not responding unfortunately i have not been too well lately with my back injury annd everything was put on hold!!.... am trying to get back to things now.....so i will write to LLoyds informing them that not enforceable agreement.....can anyone advise me which templete letter to use??????????????????
  3. i totally agree its a case of 'i'm alright jack pull the ladder up'' - anyway we were in court today for an interium hearing order and set aside......the so judge was very nice but he has adjourned the case until 2nd april so that all matters can be dealt with in one go.......needless to say HFC did not turn up...... but the judges comments were 'if i make the judgement now they will only appeal so i will wait until 2nd april and deal with all matters together'..........my husband and i hope this means good news for us as the judge was not happy that today and at the previous hearing they didnt show.
  4. thank you all for all your help i really apprecciate it - i have today received a letter from barclays offering me £1325 as settlement for my claim for unfair charges for my old business account - i calculated they owe me over £7500 so i will have to take further action as you guys have given me the will to 'fight' them all the way- thank you for all your help. we have 21 creditors in total! :o i know its totally digusting - but we are now trying to get our life back on track and these animals seem to want to bring you down once they get their claws in you - i was a high earning executive with 3 business until i was struck down by a brain haemorrhage then worse still when my husband retired to care for me we went on a cruise in florida to celebrate that i was 'still here' and when i went to go and have a massage on the pool deck the plastic chair broke beneath me (i am overweight but not grossly - about 14stone) and i know also have 2 herinated discs in my back to contend with!.............you can imagine the total change in our lives..........that was all bad enough but with the love we have in our family we have survived all of that.....but our debtors are terrible and causing so much distress and fustration it is unbelievable. sorry i didnt mean to go on......just wanted to give a little back ground information........ anyway we are at court tomorrow for set aside/re determination/charging order etc with beneficial bank.......we are arguing no CCA produced even after CCA request back on 24.11.07 and CPR18 request 4 weeks ago.......hopefully judge will throw it out!
  5. thank you penfold - we have about £15,000 on each account - one for me and one for my husband. We have written to Lloyds several times as we are having financial difficulties due to my serious illness and they have not bothered to respond to our letter etc., and have threatened to take us to court to get a ccj and a charging order on our home. i want to fight them all the way for the way they have treated us - we had financial problems about 4 years ago (nothing like now) and went to the bank, they gave us 2 loans of £25000 each and 2 credit cards of £15000 each - i feel they encouraged us to get into terrible debt and should never have given us such a huge line of credit. thanks for all the help soo43

  12. i seem to think there is something in the banking code guidelines - will have a look later or tomorrow - we were encouraged into similar position - we had a loan with lloyds and lots of over debtors several years ago - we went to the bank for help and a review and they gave both myself and my husband a £25.000 loan each, plus a credit card with £15000 limit each and NEVER made us pay off the other creditors - now we are in worse debt due to their so called 'help'!!!!

  15. yes that is entirely correct - not sure what we can do with this one - just annoyed they went for a forewith judgement so that they could apply for a charging order against us.
  16. surely these are 2 different documents - i think i would let them get to court and then state that they have 'emblished the truth' (lied!) about the document they sent to you and see them worm their way out of that.....surely any judge would see them for what they are?
  17. thanks for your kind words davey - we actually wrote twice to the companies aksing them to consider a write off as we felt our circumstances were exceptional due to my illnesses - we didnt even receive responses from most and just sorry we cant write off from a couple - i am writing back to them all asking why they are not abiding by the banking code and "taking each case on its merits" as i just get standard bog off letters - this has caused additional stress and i was actually in hospital about 3-4 weeks ago had to have a lumber puncture to rule out another bleed - the headaches etc were all due to stress.

I have had several of these texts from MBNA one from someone call Alex - this frightened the life out of me initially as i thought a friend of mine called Alex was ill!!! also had postcards from MBNA stating they were going to call me on such a date and time (all in plain view of the postman!!!) also can you believe it keep getting information for MBNA for taking out another loan!!!!
  21. thank you to all for moving the information to the correct place for me - i get very confused due to my illness sorry. do you know if the agreement is enforcable??? the fact that we didnt receive the default notice does that make any difference to our case?

Thank you for this car2403 - can you tell me which is the best way to approach this as we have a court hearing - they got a forewith judgement against us (trying to make an unsecured loan a secured loan) - i need to sound as if i know what i am talking about when we go to court. I will argue the above point re unsecured v's secured i wish to argue your point also but need to fully understand what i am saying - could you point me in direction of a letter i could send either the creditor or judge pleaseeeeeeeeee - btw what does IMHO stand for?????
