  1. I think I will pay this months payment plus the £50 off the arrears. They have said they will look at the letter I sent them as respond by 16th Dec. I think I will send a SAR request to them anyway. I can get most of my phone calls to them via work as where I work record telephone coversations but we don't have the initial phone call for the loan. Will probably be £10 well spent. I'll get the PPI cancelled but I'm struggling to get the payments reduced due to the arrears. I've e-mailed the Finance & Leasing Authority who they are bound by so see what they say but I've not received any response yet. I don't think I should be paying for something I don't have (PPI) and the courts have sorted out the arrears repayment but FirstPlus seem to think differently Kaz
  2. Hi everyone I'm bumping this as I'm about the send my letter off cancelling the PPI and I want a valid "argument" as to why they should lower the payments. Anybody got any ideas, I don't think I should be paying for something I don't have !! Kaz
  3. Are there any legal people out there. We have suspended the repossession order that FirstPlus wanted. I'm going through my finances to get everything in order and make sure we don't get in this mess again Anyway as per my previous post I've found my agreement from FirstPlus as we have 3 dates 1st is 28th Feb 07 - Charge registered with the Land Registry 2nd is 1st March 07 - Agreement signed by myself & husband 3rd is 6th March 07 - Agreement signed by FirstPlus. This is also the date on the PPI policy Surely a charge cannot be put on the house before any agreements are signed Kaz
  4. I am having problems with FirstPlus and PPI. We are in arrears and have just got a repossession order suspended with the help of Ell-enn on the repossession board The judge as agreed to the normal contractual payment plus £50 off the arrears. No problem with that. We have contacted FirstPlus to cancel the PPI they will do this and refund us a percentage back but they won's reduce our monthly payments as we are in arrears. As far as I'm concerned the arrears have been dealt with by the courts. We may even be in a position to pay more of the arrears if they where to reduce the monthly repayment along with the PPI, I'm not telling them this. When I cancel the PPI why should I pay for something I don't have ? Any advice would be appreciated Kaz
  5. Thanks what's happened to us. It's a joint loan, only covers myself not my husband and on the questions & answers form they supplied (I did the loan over the telephone) I've stated that my I'm covered by my employment if unable to pay and they "recommended" the policy. I've just managed to stop them getting repossession - they wouldn't listened to anything we suggested, in court the judge accepted our proposal straight away. The judge also mentioned that PPI policies are more trouble than they are worth as there are so many exceptions you can never use them and it would be best to go for misselling of the policy.
  6. We have a secured loan with FirstPlus. We are having a few problems with them and we are at the repossession hearing stage - that on other thread. We've got the paperwork showing what their solicitors are going to use in court and also the defence papers. The defence papers and also the land registry report state that Firstplus put a second charge( first is with Nat West) on our property on 28th February 2007. We didn't sign the loan agreement until 1st March 2007 and then it would have been posted to them. Is this legal, surely they cannot put a charge on the property until we have signed the agreement confirming we want to be legally binded to it Kaz

  9. Thanks for the quick reply I'll get on with the forms. I've done a few photocopies so I can have a "practice run". I've contacted Payplan who run my DMP and they said they will work with me whenever I need them. I've just contacted FirstPlus although they now answer as UK Secured Loans. I didn't say who I was but I blagged my why into a few questions about cancelling the PPI. Was told that I would be sent a letter detailing the new payments that I would need to sign and return. I asked what if I had arrears - answer they wouldn't reduce the payments until the arrears where clear but once they where they would take into account the overpayments and the payment would be less than the stated one. We were told that they couldn't/wouldn't tell us the new payments until the arrears had been paid off. If we had known what the new payments would be and any overpayments would be taken into account we could have stopped all this. When we first asked about cancelling the PPI we were only 2 months in arrears. Kaz

  13. I've e-mailed the courts to apologise for not sending the paperwork in. Sorry about not replying earlier but I can't remember my password to post anything and I haven't got access to my e-mail address for any reminders. Luckily my PC at work stored the password so I'm online whilst at work The problem is we cannot really afford any extra payments. I'm on a DMP with PayPlan, maybe if I have a word with them and see if I can reduce the payment to them as put that towards the arrears. I've advertised as a home based proofreader and typist to see if I can get extra income but up to yet if not had much, in fact nothing since March. I'm also going to have a clear out at home and sell a few things to try a raise a bit of extra cash. I've just changed my job, same company different department so when the financial situation eases I should be in for a payrise. Would it help if I could get that confirmed by my employers ? Kaz

  15. Yes, there was nothing on the form to say it needed to go back !!, supposed I should have worked it out though I don't know whether I'm coming or going at the moment. I work days my husband works nights so we hardly see each other. Kaz
