  1. Hi, My Mother has had her car insurance renewal through from Direct Line. She has had 5 years no claims (for over 30 years!). About 4 months ago, he car door was nearly taken off by another car, whilst she was getting out of her car on a supermarket car park. The other car was speeding and cutting across parking bays to exit the car park. This case is still going through solicitors to decid liabilty. However, my mothers renewal now shows she has lost 2 years no claims ! How can this be, when the case has not even been resolved yet ? Thanks. J
  2. Do you know if Itrum Justita can file a mark against my credit reference, even though I owe no debt ? That is the thing that worries me the most. If so, do they just do this, or do they have to inform you first ? Thanks.
  3. I sent all the information above to Intrum Justita, recorded to their Head Office, and to their correspondence PO Box. This was sent on 08th March. I told them that this debt was cancelled by Paypal, and I owe no debt. I even sent a copy of the apology email from Payapl, and a screen shot of my balance. I included in the letter the info I found from this site. Namely that they can't chase for a disputed debt without investigating first, and if they didn’t I would report them etc... Today, I have received a letter from Irwin Mitchell Solicitors (on behalf of Payapl / Itrum) saying that if I don’t pay in 7 days, the "May" take legal action etc.... I don't know what else to do now. I have sent proof that I don't owe this debt to Intrum. All they need to do is check with Paypal. What else can I do ???? Do I have a case now to file a complaint with the FSA / Ombudsman , or do I need to request a formal complaints procedure from Intrum first ? I’m not worried that they actually will start legal proceedings. I’m sure they won’t , and if they did, I really do owe no debt at all ! I just want to put this to bed once and for all. Any help much appreciated.
  4. Thanks, Do you think I need to send it recorded delivery? Or should the letter, with a print out of my paypal balance and a print out of the email apology I received from paypal suffice? Do they have a legal obligation to investigate my dispute once I send a letter? As they have completely ignored the fact I have told them that I owe no debt by phone.
  5. Hi, I am being chased by Intrum Justita for a Paypal debt that has already been cleared by Paypal. To cut a long story short, I was conned by a fraudulent web site which resulted in me doing a chargeback to reclaim my money. Paypal then put my account into a negative balance, and gave me 3 months to pay. Since then, and after 20 odd emails, I managed to get Paypal to reset my balance back to zero. However, I believe the timing of this meant that it was at roughly the same time they passed the debt to IJ. I have explained several times on the phone to IJ that this is now cleared and Paypal have apologised, but they just don't want to listen (or don't believe me). I have now received a letter from them, which I have been asking for, for over 2 weeks now, so I can respond. Funnily enough there is no return address, and the registered office address in such a small print, I need the Hubble telescope to read it. Can anyone please provide me with a template letter for this kind of scenario? I have found a disputed debt template, but this seems to be more based around CCA request and does not meet the same circumstances as my problem. Any help much appreciated.
  6. I've now been told by the letting agency that as neither of us can agree, it needs to go to arbitration. However, they have told me that it's up to me to find an arbitrator to sort the issue out. Is this the case ? Why do the letting agency (who are currently holding our money) not appoint an arbitrator? Or as it is by law still our money, why is it not the landlords responsibility to appoint an arbitrator? Any advice greatly appreciated.
  7. Hi, I logged a dispute with Paypal, and as the seller did not respond, so it was awarded in my favour. The "seller" had cleaned out his paypal account, so Paypal will not refund. Google checkout (who offer the same service as Paypal) on the other hand have refunded everyone. Funny how Ebay (who own Paypal) will not allow google checkout as a payment method, as it is "not yet proven to be safe".
  8. Bump... Can anyone advise, has Paypal have set a precedence by refunding some customers in cases like these (due to watchdog), and should this go to court, what my chances are? As I have never received any goods, would this hold up ? Thanks.
  9. Hi, Just before Christmas, I ordered a TV for over £600 from a website. The payment methods offered were Paypal and Google checkout. I paid via Paypal as I already have an account, which deducts the money as a direct debit from my account. The company turned out to be fraudulent, and no one received their goods. This affected hundreds of people, who have started a forum on this issue. I contacted my Bank, who advised they could do a chargeback on the direct debit, so I said fine. My money was back within 3 days. Since then, Paypal has restricted my Paypal account, and put my balance into -£600. They have done this with other paypal "customers" and are now threatening the debt will be passed on to collectors if the balance is not paid. A few weeks later, BBC watchdog did a story on an exact same scenario, where by the company was fraudulent, and no one received any goods. They spoke to paypal, who agreed to drop the action against its customers who never received the goods, and had done a chargeback. With this in mind, have they not set a precedence by doing this? Should they not do this for ALL customers in the same situation? I refuse to pay this as I have not received any goods. Paypal are spending their time coming after the people who were conned, not the criminals (and there is a police crime reference number for this due to the scale of the fraud). Google checkout have refunded everyone, yet paypal are sending out debt collectors ! If I refuse to pay, will/can the debt collectors take me to court ? and what would be my likelihood of winning ? If I dispute the debt, can a debt collection agency add adverse credit to my credit rating? Thanks for your time. J

Hello , My mother recently moved out of rented accommodation (via a letting agent) after about 1.5 years, and we have now been told the Landlord is withholding £150 for damage to the living room carpet. I am absolutely livid about this for several reasons. 1. The carpet was in such a bad state of disrepair when she first moved in, that she called the lettings agents in the first week and asked "Would the landlord meet her half way to paying for new flooring / carpet?". The carpet was very old, worn, and filthy. There was no response from Landlord. 2. I have spoken to the lettings agents to find out if the previous tenants had their deposit withheld for the carpet. The answer was yes. I then asked why the carpet was not replaced then ? They couldn't give me an answer. 3. She has had to move from the flat because the landlord very rarely fixed any faults with the property. These included: A. The gas fire was condemned. It was leaking carbon monoxide. This was reported and yet he did not replace the fire. This meant for the last 3 months of her tenancy, my mother had no fire during the winter. She was informed it would be replaced, so in the mean time, used a portable electric heater. This meant her final electricity bill was £150 more than the previous quarter! The fire was never replaced. B. Cracked windows in the kitchen and bedroom, some of which could not be opened as they were that old and/or the keys were lost. The landlord said this was not a health and safety problem C. The hot water did not work for 4 months (over separate periods). Initially she was without hot water for 3 weeks in a row as the landlord was on holiday. Once fixed, it continually broke down again. I have told the letting agent I will not be paying the landlord a penny. The landlord has subsequently knocked £50 off and is now asking £100, which I still refuse to pay. I realise £100 is not an earth shattering amount, but it is more to do with the principal of the matter. My question is as this will probably go to arbitration, what are our chances of winning? Also, do I have any case for recompense due to the fact my mother was without hot water for long periods of time, and no fire for 3 months during the winter. Rant over. Many thanks in advance for any advice you can offer. J
