  1. Hope someone can help me here. Got planning permission in 2002 for small extension to our house and builders started/completed work during 2003. Had inspections done at various stages by building inspector from council. We paid various charges etc at the time we were asked to. 2 months ago (over 6 years later!) we get a phone call from building control to say they have been reviewing their records and notice that we haven't got a completion notice for the extension. So he comes along and spends 2 mins looking around before saying all is ok, he's got around 200 to do as alot of records were not followed up when they moved offices year ago! Now i get an invoice & threatening letter for over £250 for inspection fees, i can't prove that we haven't already paid this but i'm sure we paid everything up front in 2002?! What i need to know is whether they could take legal action for this considering that they have only just invoiced me now nearly 7 years after the builders finished their work? We advised the council at the time that work was complete and heard no more. The inspector verbally told me recently that they have failed to follow up records due to the office move. Do i have to pay this £250 or have i a legal point over the time it has taken them to invoice me? To make it abit more interesting i work for the local council!
  2. Has anyone been sent a copy of their CCA details without paying the £1 fee? The only reason i ask is that i have a dca chasing me and to get them to back off for a short while i decide what to do i told them that they can't harrass me while they haven't provided me with my CCA details which i had previously asked for (even though i haven't ....yet). They have now written to me saying it is on hold while they get the details for me.......
  3. Well the same bloke has come back to our door again but this time made the mistake of 'visiting' when i was at home . He left pretty sharpish when i told him to . I have sent his firm a letter confirming they are not allowed to visit, and our DMP company have confirmed that the creditor who these peolle are acting on behalf of have it on their recors that no visits should be made. Now i'm strongly thinking of taking this further along the lines of the distres caused to our 4 kids who were present on both occasions he called.......
  4. ok thanks for all that (except the troll!!) One question - "Cannot visit you at your place or work" - as i work from home (and my employer deems my workplace as my home address) does that mean that a dca cannot come to my house whilst i am working??!!
  5. Thanks for the prompt replies your two, i will fire a letter off tomorrow to them and see what reaction we get! Think its about time we also send a cca request off as my partner thinks she applied for this one over the net and hasn't signed anything...

Had a DCA at the door late this afternoon (i was out but he was there for a credit card debt in my partners name), nobody answered the door as my partner was busy with the kids but he left a letter saying he had called and for her to ring a number to discuss payment. She is paying this monthly via a DMP company but the original company have obviously passed it onto a DCA. I understand that they are not allowed to visit your home or work place without prior agreement with yourself, is this correct? If so is there a standard letter we can send to the DCA advising them of unwanted visits etc? I have spoken to her DMP company who advise they are allowed to come to your home but i'm sure that i've read somewhere that you can call the police?? Any help gratefully received as my partner is worried sick that next time they will try the doorhandle and walk in, or the kids will answer the door to them.......
  7. Would rather not talk to them as they will want to go through income/expenditure again! Just looking for confirmation that they don't need my signature to note my record of my offer of payment. Haven't claimed back any charges off any of my cards etc - how do i go about that?
  8. Owe £1K on credit card (hsbc) - sent them a letter recently advising i would pay £5 per month towards it as i am on a DMP for other debts (inc others to hsbc). Advised them that they have my income/expenditure details from other accounts with them so can see that £5 is all i can afford (plus its more than they would get on a pro-rata basis if included in dmp). I've now got a letter back off them saying my letter was not signed :grin: and they are unable to deal with the contents due to data protection act. Now i think they are trying this on, can someone point me in the way of a response to them regarding this

Any advise on this - my bank kept increasing my overdraft from the £500 limit i agreed on it as i was going over this limit - they kept writing to me saying they had agreed to my informal agreement to increase the overdraft ( to cover direct debits etc) but i hadn't agreed to anything except the £500 limit, now it stands at £2500 o/d which i am paying back at £5.66 per month via my dmp!! Were they allowed to keep increasing it without my consent, and on top of that charging me a fee for doing so as well??!!
  10. Spoke to my dmp company yesterday as some of my creditors are advising me that they are not getting payments from them?! The dmp company say they are paying them and it must be crossing in the post but even if that was hapening payments should still be on the statements i am being sent even if it is the months previous?! We are struggling to manage the monthly amount anyway so they have agreed to drop it but i'm not sure what some of our creditors will say to that, especially the ones who have accepted our offer. Think i will go this alone, at least that way i am in control of things and i hope i can get some advice from you all out there when things hot up....... Any advice on this from anyone?

  12. Thanks for the comments! Still getting letters and text messages to the main phone saying it is still outstanding and it is being passed over, i'm now of the opinion that they are trying to get me to pay it and close the case even though they know it is not owing - hoping for an easy £80?! Otherwise i'm sure they would have gone further by now. Don't see why i should pay DVLA more money to get a letter off them saying this isn't owed when all the DVLA have to do is tell the DCA what they put in writing to me.......as you said if they want to take me to court i will ask the DVLA to attend for my side!!

I have heard alot about you being able to claim back charges/interest etc on credit cards, how do i go about this as mine are still raking up £100 per month even though i am paying them through a DMP agreement. Do i have to pay for this (very very limited budget left each month to play with unfortunately) or is there a letter template i can fire off to them? Any help gratefully received as i'm not up to speed on these kind of issues (am trying to read as much as i can on this site though )

Currently in DMP with fee charging company (they take about £50 per month) but they don't seem to be doing much for me, think they are waiting for defaults to be registered before they do anything? I am about to cca some of the creditors (some have accepted our monthly offer) to see who can take me to court with an enforceable agreement. We have about 13 creditors owing approx £45K in total. I suppose what i want is some advice as to whether i should dump the dmp company and go this alone?
  15. Well this is still ongoing! Phillips have been passed the case by the dvla office in scotland. I have provided Phillips with a copy of the letter from the dvla and they have sent it on to the dval to confirm its contents. Until they hear from the dvla they told me they will continue to hassle me for the debt.......they have left a few threatening messages on our phone and their system even rang our phone at 5.00am one day - needless to say i was not happy about this. Fuuny thing is now i have spoken to the dvla to ask why there is a delay in them telling Philips i don't owe this debt, now the gentleman on the phone from dvla told me that he could see from their records i don't owe anything and even that the tax on the car was cashed in 2 days after i sold it, though he could'ny say who by (data protection) but it's obvious who took the car from me did that! With regard to the phone calls & messages he told me to report them to Trading Standards and the police!! They would even provide me with a letter stating the tax was cashed in 2 days after i sold it!! All i want though is for the dvla to tell phillips what their records say, any suggestions as i'm getting nowhere with either of them really.......
