  1. hi riadom i'm sure i read somewhere that they can not touch your house if you have kids. not sure what to do about mine going to try a settlement over 5 years not for full amount as that would be impossible kel

  3. hi all happy new year got part 18 back today it's all a bit much for me but they did have insurance and claimed £21,009.23 covers claiment only and says it doesn't cover shortfall and the rights of subrogation apply:confused: I have till 28th jan to file defence oh and no copy of deeds HELP PLEASE! many thanks kellie
  4. hi jody thank you very much for help will post letter to hl tomorrow (not that it will get there till after xmas) can anybody help me with the defence part of court claim as i need to post this asap and it states that there should be 'notes for defendant' attached but there is nothing as it is all photocopies i think they forgot many thanks again

  7. hi no payments made 1,possession of property made 21 jan 2000 2,sold on 12 july 2000 for 110,000 3,at date of sale amount outstanding on mortgage was £133,503.60 4,the claimant apportioned the sale proceeds of £110,000 to the mortgage debt in the following order (i) interest (ii) capital. immediatly following the sale in point 2 in the premises due and owing to the claimant from defendant amounted to the sum of £23,503, the aforementioned figure represented capital debt 5,the claimant claims interest pursuant to section 69 of the county courts act (1984) at the rate of 8% per annum for the period of 3 december 2001 and 3 december 2007 in the sum of £11,283.65 6, further, the claiment claims interest pursuant to section 69 ot the county court act (1984) at the rate of 8% per annum at a daily rate of £5.15 to date of judgemnet or sooner 7, the defendent is jointly and serverally liable for full amount outstanding under the mortgage as detailed above 8, on the 17th september 2007 the govenor and company of the bank of scotland was registered under the companys Act 1985 as bank of scotland plc. Also on 17th september 2007, by virtue of section 10 of hbos group reorganisation act 2006, the halifax plc transferred its undertakings (as defined in the act) th the bank , by virtue of section 12(19) of the act ,any legal proceddings by halifax plc may be continued by the bank AND THE CLAIMENT CLAIMS 1, the sum of £34,787.25 pursuant to details in 4 and 5 above 2, interest pursuant to details in 6 above and 3, costs Any help in this matter will be gratefull many thanks kellie:confused:

Hi Can anybody help i am being taken to court over mortgage shortfall of £25K plus interest of £12k back in 2000 all i can remember is the mortgage being £114K minus 5% deposit they took 7 months to sell property for £110k the above amounts seem a bit much and i have no idea how to reply to court summons ANY HELP WOULD BE GREAT MANY THANKS:(
