  1. Not directly. Only communication I've had was the 2 letters saying the account was in dispute and they were waiting for information from original lender. Next letter was the one today stating account was closed on their files and we're passing it back to themselves. Not sure what to make of it to be honest.
  2. Okay so it's been a few months. After sending statute barred letter I've had 2 letters informing me they are still waiting on account details from Santander. Today I received a letter from RW stating that the account in question is now closed on their files. They will pass any documents/information I have provided on to their client for them to deal with accordingly. For my future reference the client can be contacted at following address HPH2 Ltd (ex santander) Blah blah blah. The amount due now shows zero. Considering RW and hoist are same company this letter doesn't fill me with confidence that this matter is over. What do you guys think? Is a follow up in order or just move on?
  3. Yes, that is correct. I've had advice from you before and read a lot of the good advice you've posted in other threads so greatful for u chipping in. Thought all my previous debt problems were behind me. Haven't missed a payment in 6 years, all adverse data has dropped off cra's then this. Typical. Just hope I don't end up with too much of a fight off them. From what I've read they are a nightmare to deal with.
  4. Does the SB letter go to Hoist who own the debt or RW who are collecting. Another thing. They are sending the letters to my next door neighbour. They have a digit wrong in address. Should I just mention this in SB letter?
  5. Got 2 letters today, 1 from Hoist to say they had purchased a debt from Santander and that Robinson way would be collecting it. The other was from Robinson way introducing themselves and asking me to make contact to arrange payment. I've looked back at previous credit reports and see that its a current account with Santander and had defaulted back in October 2008. The account was £1000 over overdraft then cut off when defaulted. My first instinct is that this is well and truly statute barred. I've not had any contact with Santander since Aug 08 and made no payments in any kind. I have had a statement every few years but just ignored them. I'm not acknowledging debt in any way. I know things are slightly different with current accounts. What's my best plan of action?   6. Your absolutely right, its not a store card, was finance on a laptop from dell. My mistake. So i shouldnt worry myself about a last minute Default getting put on there? Im guessing worst case if it did be able to get it removed. Thanks for your help.
  7. There is only one 6 and was the last update on 2/3/2008 showing a balance of £0. Current balance: Settled Settlement date: 25/2/2008
  8. No there's no default date. It was 6 payments late then marked as settled back in feb 2008. Balance showing £0
  9. But can a default be added after the time that has elapsed as I've not had one yet and would like to avoid it.
  10. Hi there, Ive been trying to clean up my credit history and sort out some unpaid debts from a few years ago. My defaults have now all dropped of as 6 years have passed and ive been running my finances flawlessly for last few years. When i checked today my experian score is now 880 which is a damn sight better than this time last year. I now only have one negative on my history which is a store card which is showing settled in 2008, last payment i made was aug 2007. I have never settled this debt and it has for some reason stopped at 6 and not defaulted. Can a default still be added to this debt after 5 and a bit years? Any idea why it might be showing as settled with a balance of £0 Im assuming my best course of action would be to leave it be for the moment until it drops off later this year or would paying it be a safer option?

  12. I held off on the chargeback and paypal claim and sent a formal complaint email pointing them to the OFT website with the section you quoted. They then changed their tune and I received a full refund today. Thank you so much for the advice.
  13. PayPal dispute is already open, I can escalate to a claim anytime but unsure if this would be wise a this stage.

  15. I did call Citizens Advice consumer service but was told that as id used the item my best plan would be to use SOGA. Perhaps I had an inexperienced adviser. Would I be better contacting them through Paypal resolution service or directly by email? Do you recommend i escalate my dispute to a claim sooner rather than later or deal with them directly. The company are stubborn and wont seem to recognise any legislation I quote them, I honestly dont think they care.
  16. Hi there, id really appreciate some help with an ongoing issue im having that is stressing me out at the minute, any help would be great. I purchased an IP Camera from an online retailer for £280. The day of delivery i set up the camera but was very disapointed with the image quality and could not get it to reliably record events every time. If a security camera cant reliably record all motion events then whats the point. I spent the full day trying to get it working correctly and half the following day then packed it back up. I contacted the retailer by email on the day after delivery that i was wanting to reject the goods and cancel the order as not fit for purpose. 3 or 4 days passed and i had no response so I called and was told that my cancellation would be passed to returns department but another 2 days passed with no contact. I called again and was told that again my message would be passed to returns department and within an hour i received an email telling me that they cant accept the item back without manufacturers authorisation and I should take up the issue with manufacturer. Straight away i called back and spoke to someone, I asked why my order could not be cancelled as within the 7 days DSR. I was advised that as i had tested the item the DSR did not apply. I was also told that if i return the item they are unable to test and it will be returned to manufacturer and if they could not find a fault i would be charged carriage both ways and for their time. The guy again asked me to take it up with the manufacturer but i explained that a week had passed with no contact and after the stress of the item and dealing with his company i was no longer willing to spend more time on it. I left the call with ill think about it. I had a look on manufacturers website and the process to get support would take up a lot of time i did not have and would involve more waiting. I sent an email to the company including the following, and opened a paypal dispute as that was my payment method. Within 10 mins i had an RMA number and a courier arranged to uplift goods today (25th). Goods were uplifted and my request for paypal refund was declined with a note that the goods will be tested and if found to be faulty a refund given. Ive got a feeling the company are going to pull a fast one what if the manufacturer can not find fault with unit, am i really liable for all those charges? If the unit is indeed not faulty but just pants and not fit for purpose surely the manufacturer will not admit this and im out of pocket. Really need some advice on where to go from here, can escalate my paypal dispute any time but thought it best to wait until goods have been received back. Sorry for the long winded post but thought it best to get all details in there. Thanks

  18. call 0871 282 4444, enter your ref number, dob etc, i think its option 2, then choose the option to pay your admin fee. Im not sure wether you have signed any paper work yet, if not explain this, and that your in no formal contract with them. It might help to mention you have been in contact with trading standards. Hope all goes well. Does anyone know if this is covered by the distance selling regulations, i know it dosent cover financial but they are merely providing a service and not finance as such, The key features of the regulations are: you must give consumers clear information including details of the goods or services offered, delivery arrangements and payment, the supplier's details and the consumer's cancellation right before they buy (known as prior information) you must also provide this information in writing the consumer has a cooling-off period of seven working days.   19. think this has been resolved, everytime i phoned up, they answer straight away but as soon as you mention the word "refund" you are put on endless hold. Called their collections department, read the law out to them, demanded an immediate refund and that i do not wish to be put on hold, 2 mins later they were arranging to refund my card. Well hopefully thats the end of that, know not to be so gullible next time. thanks for the help
  20. thanks, i really wish i had done a google search now, surely by law i have some kind of cooling off period, the paperwork has not be signed so they have basically took my money with no formal contract. giving me a headache lol
  21. Hi new to the forum, hope ive put this in the correct place if not appologies. My problem if anyone can help is i applied online for what i thought was a loan from yes loans, everything seemed normal and i received a txt on my mobile saying i had been accepted, shortly after i received a call from them to finalise details, in this call i was quoted my loan amount and chose repayments. I was asked for and paid a 49.50 admin fee which i thought ok considering i would have my loan in a few days. Yesterday i received the paperwork and discovered they are actually credit brokers and would try find me a loan within 6 months, ive never really heard of this before and assumed when they told me i had been approved for my loan and chose my repayments the loan was definate or would never have paid them the fee. I feel cheated as their site and phonecalls lead people to belive they are the lender. Ive not signed the agreement and would like my money back, i phoned them several times but was fobbed off. Whats my rights? considering ive not signed any paperwork and they took the fee off me before i received it Thanks in advance callum
