  1. Thank you to both Louis and Slick for your advice. My apologies for the the late reply....on top of everything else I have incurred a PC prob and was not able to get online......I need to read the stuff recommended and could have done with out the PC probs. Many thanks guys
  2. Back in August I paid my MBNA CC in full albeit 2 days late and incurred a £12 late payment fee... they have put the fee on every month and it has now accrued to £67.74. I sent them the template letter stating their charges as unlawfull and giving them 14 days to respond. Received this response-: MBNA response to legal action.doc I'm not entirely sure of the next course of action; they are sticking to their guns and saying they are above board with all charges levied. My case is perhaps different from those that have already paid out and look to reclaim their money back, as I have not yet paid them and don't intend to. Because of this, will it still be acceptable or necessary at this stage to take the issue to court in order to get the charge cancelled? (They indicated in an earlier letter I would be also be subject to adverse credit rating if an ammount was not paid.) All advice will be most welcome as to the next step recommended.
  3. Thanks Steven 4064 for all your advice to date. I'm starting the thread as suggested, hopefully I've got it right! please forgive me if it in the wrong sector, I tried to open thread from my email link but an error on the page prevented it....can't seem to find the MBNA link again! Just to re-cap... mbna credit card europe imposed an initial £12 late payment fee for a fully paid up cash amount that was 2 days late in clearing their account back in August. I wrote to them requesting they cancel the late payment charge. Each following monthly statement showed that they were adding a late payment fee. I received a letter from in Sept, to say they would investigate the matter. then another letter to say the investigation was taking longer than usual and they would definately reply by October.....Nothing received untill I called them upon receipt of my last statement. It showed an amount of £54 had accrued in fees. Finally received a letter from them on 12th December dated 21 October.....saying they would not cancel the fee and I will have to pay it. Called the Ombusmen as they suggested and was advised there was nothing they could do as I did not maintain the account and that MBNA were in their right to add the fees and insist on me paying them. My next statement will be 30th December and I need to initiate some form of action. They havn't been paid the money yet, so i guess I'm not in the position of reclaiming anything in the true sense of the word. I am concerned the situation could get out of hand and wish to to take some sort of immediate counter action....if there is the risk I will have to pay them, I have to consider doing so before 30th.... Please advise as to the immediate steps that I should take, as the last thing I want is a mounting debt situation many thanks :-|
  4. Thank you for that Steven...There dosen't seem to be a new thread button on the page that has come up on my screen....I have the note saying errors on page so perhaps thats the reason. I will re-boot it and see if I can get it. As things stand I not paid em anything in charges yet. So I guess I need to word it as alleged payments owing. They won't close the account untill the amount
  5. Many thanks Steven that bit of re-assurance really helps. They will obviously hit me with another charge on 30th December so I guess I need to initiate something meanwhile....not sure what though, other than write...I not quite certain what to say though. Any suggestions will be most gratefully received. Your help is really greatly appreciated thanks once again...I feel I'm not so much out on a limb.
  6. Hi Steven, thanks for the welcome and positive words of encouragement. I most certainly will read the threads and look into the possibilities. At present I'm of the understanding that I entered an agreement on the late payment fee when taking up the card....however will read the threads and get back. Many thanks.
  7. MBNA in my opinion are the greediest low life on the planet I just posted on here but I think it went to the wrong thread...albeit MBNA rip off issue...please read...as if you didn't know about them already. However if anyone like me has received a back dated letter from them .... can only think it a purposeful delay to accrue interest on interest!!! It would appear the Ombudsmen are not so impartial as they advertise...I even formed the theory they may be on the MBNA payroll!....mad rantings ...still seething at their legal rip off...But the question is: What can people do to strike back? their arrogance and failure to respond to letters ...their lies when they promise to call you back...The Inland Revenue and Tax Bailifs have better ethics and codes of practise.... than pond life MBNA...yet we are supposed to be customers! They use a hard sell to sign you up...but the niceties soon drop when they employ the above **** tactics to legally extort your cash into their account.. greed greed and more greed...They even have the audacity to form a department called 'customer satisfaction' dept I will write again to JOANNE JOHNSON the CUSTOMER ADVOCATE OFFICE MANAGER I urge everyone else to find time to do so... just tell them what you think of them...and tell them to have a look at this site. Perhaps some their employees will read this site get a better insight to what kind of company MBNA really is....
  8. Hi ...just joined Just been legally ripped off by MBNA Europe credit card ploy; they are the lowest of the low. Purchased a product in August paid for it in full and cash at bank...but it didnt make their account and was two days late bank holiday weekend! The next statement in Sept showed a late payment fee of £12...so I wrote and asked for pity and queried the account ....they replied to say they would look into it....heard nothing...another statement arrived with interest added to the interest I wrote back and said what about the reply to the September issue...then got a letters saying sorry for delay will send one by 21st October. That never arrived....finally got the December statement with £54 interest accrued....still no reply ...so I called them....they said they would respond with a letter......I finally got a letter on 12th December with an October date on it. Joanne Johnson Manager of the hard hearted customer Advocate office. The Charge stands and thats it ...if not happy contact the financial Ombudsmen. Was told by the ombudsmen they within their rights...unless you can prove the letter of December was back dated...tough. Called them and was told a manager would def call backin 48 hours....heard nothing. called them 3 times in all finally one called to say tough get intouch with the Ombudsmen if you not like it. I can swallow the fact I should pay £12 ....but £54 is just robbery. I was under the mis apprehension they were looking into the query on the account when infact it was a delay in the name of legal robbery... They could have just written and said the interest would accrue on interest....In my stupidity I thought they were a company that treated you as a customer. So Be warned. If anyone else has received a back dated letter from MBNA or had similar dealings please let me know....I still seething, been a long time clean and green customer...but will never ever use them again.
