So this is my response to their Letter what do you think? Dear xxxxxxxxxx Thank you for you recent correspondence regarding my payment protection policy complaint. After receiving the letter from you back in 2009, I contacted you to enquire whether I had any payment protection on my loan and I was told I did not. This was because the loan had been refinanced. So I took no further action. Firstly I would like to draw your attention to the second to last paragraph, where it states: “If we have not heard from you by (response date) we will assume that you are satisfied with your policy. Please note that this does not affect your right to raise any concerns at a later date.” Now this does not mention anywhere that I only have 3 years or it will be “time barred”. It clearly says at a later date. This is because FSA guidelines about contacting customers regarding the miss selling of PPI did not come into force until 2010 so the “time Bar you mention would not cover the letter from 2009. Secondly I would like to draw your attention to the statute of limitations which as I am sure you are aware has no bearing on PPI, as the clock does not tick until i am aware of the 'mistake' . The loan account number xxxxx refinanced by XXXXXXXX had outstanding ppi so i expect further rolloover interest & sec 69 int until loan 2 was settled. Based on the two points raised above I would like you to reconsider your decision and refund all outstanding money including 8% interest. I have also enclosed a subject access request and a cheque for £10 Yours sincerely Mrs Leicesterlad

So reading the 2 links you have put up. because they wrote to my wife in 2009 and we did nothing about it we can no longer make a claim? I remember her getting the letter and checking her current loan and it did not have ppi so we did nothing. It was only down to having a clear out we found an old settlement letter with a statement showing she did previously have ppi.

Hi My wife has tried to claim for ppi from a loan that ended in June 2007. She has recieved a letter today stating that the case has now been closed because they wrote to her in 2009 to say she might be entitled to something if she contacted them, which she never did as she was unaware she had payment protection. as the restructured loan did not have any ppi attached to it. They are now saying because its been over 3 years since they wrote to her and she did not respond it has now been time barred and the case has been closed. Any advice on where to go next?

Hi No it doesn't say its their final offer. it does say that "this plan is not an insurance product" but they say their applications department did call me and they would have also fully explained the the benefits of the repayment option plan. and it would have been on this call that i would have agreed to to the plan. it goes on to state that it would have been included in my welcome pack and has been itemised on my monthly statement since 2006. Where should i go from here??? -

I have had a response from them that states it would have been mentioned in my welcome call and as it has been on every statement since i had the card they will not refund my premiums. any ideas on how top proceed -

Hi All just wondering if anyone can help. my tax code has been 172L since April, a colleague saw it and said it was very low? and to call the local tax office, which i did and they re adjusted it to 393L and said i would get the difference back. my question is how will i get it back in my wages or as a cheque refund and how much am i likely to get? thanks in advance

Hi all i have had a vanquis card since 2006 never had a problem or a charge from them other than a high interest rate!!! i have though only just noticed that i have a "repayment option plan" which is costing me up to £20 a month. i rang them and cancelled the plan and asked for a refund. they said they would dig out my welcome call to find out if it was all above board and was sold properly. i applied for the card online and as far as i can remember i never recieved a call from them. what is the likelyhood of getting anywhere with them as regards a refund and as the application was done online in 2006 what are the chances of the agreement being enforceable thanks for looking leicesterlad

and not all motortraders own forecourts and glass fronted showrooms. some sell from home and most of the photos are taken in the same place, i would suggest this is a sole trader working from home with a website supplied by autotrader. edited sorry for the respose -

it is a legit site set up through autotrader/tradermedia they set up a website for you for a monthly fee must be vat reg to hold an account check out Kmcarsales.co.uk - Km Car Sales most independant traders set up these websites as its cheaper and easier than doing it yourself and the beauty is when you upload your advert onto your website it automatically uploads onto the autotraders website. i personally think it gives the trader more credibility rather than a small advert in the paper witha mobile number. imean ffs he is giving his home address.....
