Just reading their WS and at the top headed in The Northampton County Court, Sam said earlier it has been transferred to his/hers local court. I'm pretty certain that Athlea Hamilton is working off templates because the Skeleton Argument she sent me was also headed in the Northampton County Court but her previous WS was headed in my local court!! My point being that allot of claimants moan about defendants using the net and templates from it yet they seem to case by case do exactly the same.

Is that their WS? all 5 points? I think HSBC think they have this in the bag. No mention of the DN!! Sam, can you go through CB's points and answer them

Sam have you contacted DG sols yet? Because if your case is to be heard at 10am then you have no prospect of waiting for the post and getting your WS to counteract theirs. Is there anyway you could get DG to fax it to you today?

I think they will fax it to the court today. That's what they did with my case for the WS and the Skelly. What time is the hearing tomorrow? Problem being is that if they post the WS will you get it by time of the hearing? Ring DG first thing and come back to us with what they say. This might be a good thing as it mirrors what happened with my case. They faxed the WS to the court the day before. My new WS that mirrored their points with answers was put in the day of the hearing explaining this was because the claimant had submitted the WS to me the day of the hearing. My case was set for 30 minutes and the DJ said the claimant sols "Do you expect me to read 2 WS and decide on a SJ within 30 mins?" I know your case is going to be heard for 45 minutes but if 2 WS get put in between now and tomorrow I doubt the judge is going to have time to read them both and cover the points within 45 mins. Case was relisted to be heard over 2 hours.

come back to us as soon as you have spoke to dg about their WS, if they have sent one to the court are you able to go get a copy?

When you say the 26th are you meaning this month? As in this Thursday? Did you reply to the pack they sent in 2009? From what you wrote here exactly the same as mine going for SJ. Seems HSBC are doing the rounds on old cases hoping you aren't going to defend? Catch you off guard. Firstly can you post a copy of the DN up with details hidden? Also can you put a copy of the template up too. Just want to see if they are exactly the same. They won't expect you to have the original.Im guessing the DN will not allow enough time to remedy the breach but lets get as much fire power as possible Just to clarify the account still has PPI on it? What will probably happen as it did with my case for the original hearing for SJ and strike out and what we should be aiming for is to get the judge to say that 45 minutes isn't long enough to hear the application of SJ and strike out. This is where I won with the case because the judge wanted to a skelly from each side but they had to get theirs in first and serve it upon me and then me write mine in response to their's. We need a copy of their WS which I know they will fax to the court the day before or tomorrow. If they haven't sent it you need to ring them tomorrow and ask why they haven't sent it. They will give you a load of sh**e but will send you one.

Didn't want to put too much on the forum but I have spoke to DG sols. They wanted to haggle on my costs of £681.20. Offered me £196. Basically said get stuffed. I offered to reduce the amount down to £550 on the condition that she had an answer back for me by 3pm and this was resolved today, failing that the amount i wanted for costs would be £681.20. Just rang her back and she said she would be writing to me today or tomorrow. Simply put it to her that this wasn't the condition and that I would be putting my costs to the court now for £681.20. So next step is putting my costs in to the court. She tried to go over old ground during the call and said that I have to realise that there is a debt outstanding here. I just simply said "no there wasn't, nothing was ever signed for". At that point I stopped her dead in her tracks and said we are talking about costs and lets leave it at that!!
