  1. thanks shieldblaster. Not sure about uploading the document as when I tried, it told me the jpg was too big and when I resized it to the recommended 620 x 280 the image looked too small. It posted them as thumbnails so I deleted them Any help appreciated
  2. not sure the best way to upload these doc to ensure they are not too small for reading. Is it better to upload them as Jpg or some other format?
  3. Hi can anyone give me some advice please Since the original thread I have now got my daughters partners documents on the said Cabot matter. As I stated I am concerned about the legality of the 'deed of entitlement letter' raised in 2006 as explained in original thread. For security reasons I have blotted out the address on the photo. If this is meant to be a true representation of the letter sent in 2006 then it has the wrong address on it for a start as this is his new address which he only moved into a month ago. It does not even look like a letter from BOS. So we have miraculously managed to get a 2006 letter with a 2008 address on it. As for the CCA well it appears there is a part missing as it goes from para 3.2 on the bottom of fax page 8 to para 10.3 at the top of fax page 9. Not sure how legal it is either as there is nothing on it that ties it to the original application and was not attached to the application either. Help and advice on what to do next would be very welcome

  5. My daughters partner applied for his CCA from Cabot. The orignal credit card was taken out with Bank of Scotland in 1998 Cabot replied to him within 8 working days that they would go to the original lender for this information. After a further 2 weeks past they sent another letter stating that the original lender was having difficulty retrieving it form the archives but were still actively looking for it. On the 30th working day the posted out the copy f the agreement plus statements and deed of assignment. Basically when the documents arrived they were over the time limit. The first thing I cannot get my head around id the Deed of Assignment. Cabot have sent a letter from supposedly the Bank of Scotland (original lender) and along the top of the letter written in pencil it states " Representation of letter sent 06 July 2006" Now heres the rub; the address on the alleged deed of assignment letter is my daughters partners current address and not the address he lived in at the time Cabot took over the debt in 2006. In fact Cabot were only informed of the new address just one month ago, So my question is; how can this be a true copy of the 2006 Deed of Assignment letter with his new 2008 address on it. Not only that it is signed by someone in the Bank Of Scotland supposedly in 2006 At a guess it is like someone in Cabot has typed up this letter and put the Bank of Scotland logo on it. The letter does not have any Bank of Scotland addresses or registered company information in the header or footer of the letter. It all together looks like something has has been cooked up. As for the agreement, well the application is there in two pages with the abridged Consumer Credit Act 1974 and signed. The actual Credit Agreement came as unattached and to be honest there is no way of telling if this belongs to this application or not; there are no names, address or anything to indicate that this is a copy of the original agreement applicable to his application and it could be long to anyone. Would like to hear comments about the Deed of Assignment letter and tell me what your thoughts are on it. Cheers Trickyricky
  6. Hi Spacehopper. That is a typical welcome from welcome that you got! When I asked for a SAR on behalf of someone else, first of all they were late with it and then parts were missing. I wrote back asking for the missing parts are they were essential. Two weeks later I received the exact same pack from them. I wrote again with various threats etc and then they sent a smaller pack but still the essential agreements were missing. I wanted to give them enough rope to hang themselves so I wrote again outlining the parts that were still missing and 3 weeks later they sent only bits and bobs of what I asked for and still the parts I was looking for did not arrive. This is an ongoing thing with Welcome at the moment and I know full well why they have not sent what I am looking for and the reason is that the main signatory on the agreement was only 17years old at the time when the loan was taken out, his partner who was second co-signatory (but not the main) was 18yo. This at the moment is a minefield of mistakes and coercion into taking loans out that they obviously could not afford. Not only that, they had a PPI added to their loan for £999.00. This is only part of a very long story and it is going to take a bit of time to unravel it all. However once I have got some of it sorted out I will write it up on here. To be honest, someone in Welcome should be taken out and shot at dawn.
  7. I agree with Hellhasnofury. Send a non-compliance letter asap. I have had several run ins with Welcome on behalf of others, and I have to say is tha my experience is that Welcome are not the most organised bunch. Sometimes this is to our advantage. Good luck and keep us posted

Hi Squirrel My daughters incident was different as it was Welcome Finance that supplied her with the Experian credit files as part of her S.A.R - (Subject Access Request) which disclosed all of the various details. It is horrifying to say the least and I have taken Buzby's advice and sent a letter to the Information Commissioner
  9. Hi Buzby, sorry for the late reply I have been a way for a few days. I also apologise for not making my original posting more clear. Thank you so much for your input and I have taken up your suggestion and have written to the Information Commissioners Office with regards to this breach. I have to say it does make my blood boil that Welcome could be so careless with such information. Thanks once more I will keep you posted as to what happens.

  11. Hi there folks, I would like to ask a question about an overdraft situation. I used to run a small business about 8 years ago now I was a sole trader not a Ltd Company. I had my personal and business account with RBS. When things were going good money was being thrown at me by the bank. I needed a newer car at the time and I telephoned my business manager to see if I could borrow £7000 to purchase the car. He told me that he would give me it as an overdraft for now and to come into the bank and he would issue me with a bankers draft for the car dealers. I went into the bank to collect the draft which was duly ready for me, my business manager told me that to prevent heavy charges he would convert the £7000 into a loan for me, however that never happened Unfortunately due to illness my business had to be closed and I was left with this overdraft to pay back. The bank of course who were so willing to help in the good times were being pure sods when it came to helping me during the bad. I never signed for any overdraft and as I say the loan never materialised. I got so hacked off at them I agreed to pay a meagre sum of £11.00 per month and have been paying this over the last few years. They of course they continually moan about it and try to get me to pay more. I am not paying any interest as this has stopped. Can anyone tell me where I stand with regards to this overdraft or do I have to bite the bullet and continue to pay. Thanks

Thanks for your explanation My daughter and her partner were not married and they were both on the agreements therefore a credit check would both cover my daughter and her partner at the various addresses. What is still making me furious is that Welcome Finance revealed all this information through the SAR whereas I would have expected that particular info that reveals other peoples credit history etc to have been suppressed. Surely, she should not be privy to her partners parents credit history. Remember it is Welcome Finance that have requested the Info from Experian at the time of application and have obviously held it on file, and now they have past this on to my daughter as part of the SAR
  13. My daughter had cause to ask for her S.A.R - (Subject Access Request) from Welcome Finance. She and her previous partner split up a couple of years ago and she has been left with the debt ;that is another story for now and one that is not the main concern. she has received the SAR but was surprised to see that as part of the pack it contained Experian Credit reports. Although she has her own home now, at the time she took the loan out she and her partner were living at my address. My daughter let me see the Experian report and it contained all her, credit history which is fair enough but it also contained me, my wife and my two sons history as well for our address. It also showed her partners details his mothers and her estranged husbands details as well. I have to admit I was quite surprised at Welcome including that information or at least I would have expected it to be censored so that it only showed her and her partners history. It means that I know for example her partners parents credit status what loans they have had etc etc. Maybe this is unavoidable and it just has to be accepted but as I am unsure I thought I would ask you guys for an opinion.
