  1. So if I pop along to your house and demand £20k, you're going to pay up without question right???? Especially if I clarify the debt by making reference to a 12 year old debt that you have no knowledge of?

I've got a CCJ for the full amount outstanding on a loan, through those lovely people at LCS (in-house for 1st Credit) "Can't Listen Wont Listen" Before I was really aware, they hit me for the full balance plus charges, not the lesser amount they paid for the debt. I've no doubt this would also include illegal charges applied by the OC
  3. They're in the process of changing the laws to protect people from scumbags doing harm to people in general. If the fella had been a bit more aggressive/pushy, there were women and kids in the house, so with a tiny bit of creativity any tit for tat accusations would have come down very heavilly against him. I wonder how they're going to decide who comes out to my house next? Short straws? I hope they come again at the end of the month, coz Ive got care of my pals Ridgeback for a week, great with kids, but hates strangers:D
  4. Oh, I'm not entirely innocent of having fun at their expense. but when I can't be bothered I just let rip, dont let them win a single point and reply with "No, now ffff off!!" However, At work we have a wonderful telephone system and for fun we often organise conference calls with them, or the mobile phone call centres. We get three or four calls to the same company rerouted to our conference setup, they could be well sitting in the same room, talking to each other. And of course it's all going to be logged on my account, so I'm sure they've got some fantastic notes about me. Should SAR them to find out someday As my old mother often says "if you don't laugh son, you'll cry"
  5. I find giving them a dose of their medicine by effing and blinding at them puts them on their back foot. ie. "who the ffff are you talking to? etc" I appreciate that this is not everyones cup of tea, but they seem to rely on the debtor being afraid of them. I had one caller point out that making abusive calls was illegal even though they had called me and I was bluntly refusing to acknowledge their line of questioningby telling them where to go It isn't illegal to answer your own phone in a manner of your own choice, and they can always hang up if they dont like it

Surely though, simply asking a DCA to prove that they are legally entitled to collect a debt shoubt be taken as "read" As someone else on this forum quite eloquently states, simply sending a letter out of the blue saying "you owe me £xxxx - pay me or else" cannot be a legal standpoint, in many cases without any kind of notice from the original creditor that the debt has been sold/transferred Surely common sense would dictate that the legislation should be stiffened so that a DCA cannot even begin to start collections without first proving that they have the right to do so, ie production of required documents, proof that they are who they say they are, accurate and fair communications methods instead of premium rate telephone numbers and PO Box addresses. Looking at it objectively, it would simplify things for themselves, removing the arguments that many debtors have about the validity of debt

Just to begin by thanking those who have offered me assistance with my recent queries, but I thought this might put a smile on some faces Sitting in my garden this sunny but cold afternoon with a group of friends, admiring motorbikes and swigging lager that they had kindly brought along, my G/f was disturbed by a rat-tat at the door. She answered the door and a somewhat burly "gentleman" said "hello, I'm looking for "********" unsure who this "gentleman" was but since he had used my first name, she told him to go around the back garden where he would find me tinkering with my bike. if I may, I'll elaborate a little. I have worked as a doorman for a little over 25 years and due to a recent extremely acrimonious divorce I find my income cut by two thirds and unable to honour my debts, I do pay what I can afford, but not a lot more. Needless to say I am a fairly large chap with a serious expression, at six one, and 18 stone, I am one of the smaller people in my peer group This afternoon, a group of Nine of my colleagues, all doormen, or former doormen were gathered at my house to drink to the memory of a late friend, himself a doorman and also an overly keen biker. so another Burly chap at the door didn't greatly surprise my G/f who incorrectly assumed him to be one of the lads. The man came around to my back garden and after I opened the gate, without identifying himself he instantly began his speech about how I owed ex amount and he was here to arrange collection, his words trailed off when he realised the sh*t he was in. I wish I had a camera to show many on this forum who have suffered at the hands of these monkeys just how meek and mild this "gentleman" became when he realised that intimidation wasn't on his side. he left a lot quicker than he arrived. It just goes to show, that no matter how big they are....they aren't too big to scare off

I also have a DCA (the wonderful 1st Credit in the name of LCS) who recently obtained a CCJ against me (before I was aware of this site) I now pay an affordable amount each month, (Even if I won the lottery it'll still take them over 40 years to get their dosh) after reading a number of threads on this forum my paranoia nerve is twitching like a mad thing. Question: Can they sell on this debt to another DCA? Can this *new* DCA increase the monthly amount? Will the CCJ stay on my file until paid? Can I, at this late stage dispute the validity of the CCJ down to the ownership of the debt, ie. if they dont own the debt, they dont have the right to have a judgement against me. To all purpose saying that they "deceived the courts to gain financial advantage" - accusing the DCA of Fraud I know they have a letter of assignment, because MBNA sent me such a document informing me of the transfer, I havent CCA'd them, I fell for the whole "we're gonna take your house off you - if you don't etc" line and didn't consider when defending their claim, any action other than that of restricting the financial burden they wanted to place on me
  9. I haven't S.A.R'd them yet, although I'm starting to feel more like the victim from reading a lot of the threads. I did approach Halifax by phone a small while back on the subject of charges to my credit card, they've hit me with £12 charges basically every month for the last year or so due to a clash in dates (I get paid after the due date and they wont change it) Their eventual response was a nice letter stating that no refund was due as they feel the charges are legitimate and in line with current guidelines. It sort of took the wind out of my sails a bit. As barclays simply refunded 90% of my charges after a simple phonecall there and then I think I may have to have another look at it tho,
  10. I pay one by standing order and the other by cheque, so at least I got something right. but at no time did I even think to aske if they were entitled to collect. It's only now that they're insisting that I increase my payments that I'm seeing the less positive side of their methods
  11. Just reading through a couple of other threads on the forum, it's obvious what I should do, I'll CCA them and see what happens
  12. As I have already had communications with these people. Have I backed myself into a corner? If I have already paid them monies does it constitute acceptance of "the debt"?
  13. I have been paying Mooroft for about a year now on two separate accounts, they periodicallysend me letters instructing me they have increased my payments. are they allowed to do this? To date there has been no court action on either of these accounts and I (foolishly) took them at face value as being the legitimate owners of the debt. I have read a number of threads on this forum referring to CCA and that I should have asked for the copy of the CCA before I began paying them, can this be done retrospectively? ie. after I have paid them monies
