How nice.
I'm going to knock up a letter to send but I would also like to add a paragraph about their threats to register details of my account with a credit reference agency. Because as they have no agreement, they do not have my consent to process my information.
Can any of you peeps point me in the right direction of a template letter?

I have a flexi loan and the Credit agreement seems unenforceable

And on the very same day that I get a letter from Barclays virtually admitting that they have no credit agreement I get an answerphone message from Mercers!

6 weeks have now passed since they cashed my £1 cheque.
I received this letter this morning -
"Thank you for your patience whilst our investigations continue. As we investigate your concerns you will be kept fully advised of developments and we will contact you again by 20th December 2007"
Should I just hang fire?

I see what your saying tiglet, it just doesn't seem right to me.
When I sign a credit agreement I give the original creditor permission to search my credit record and to process information with credit reference agency's. Wouldn't It have to state on the agreement that they reserve the rights to pass on my details to DCA's, who could then continue to process information with said agency's.
just thinking out loud, maybe someone with more knowledge could answer this, but I will do a bit of my own research.

Surely a DCA is not allowed to search your credit file without your consent!

Egg have responded today and they seem quite positive toward my offer. They just want a few more details with regards to my income / expenditure but I think they will go for it.
I have been reading up on the banking code as suggested by sequenci, and I can recommend it to anyone else in a similar position to myself.

TIP - If you have a lot of creditors and are going to send CCA requests to them all at the same time, make sure you have the time to deal with all the paperwork and invest in a good filing system!
