  3. the local authority have a LEGAL obligation to you. you do not have to go into private rented accomodation, if you do this excuses them of their LEGAL duty to house you and your family. please seek legal advice as soon as possible.
  4. you need an advocate or case worker to take this up for you. have you got an independant housing advice agency near you? how about the national autistic society they have advocates. ireally think you need legal advice from a housing solicitor. i would also contact your local MP make them earn their wages. i know that any temp accommodation must meet your family needs and if part of that is your sons autisim and your continence then i dont think it could been seen as suitable for you to share facilities.
  5. yes it must name all tenants. it must show the landlords or their agents address, it must show what ground they are using. but the most important thing is the dates. when notice is given and when it expires. also the correct date the tenancy started and when it ends
  6. if you do have to go into temp accommadation it still has to be suitable for your needs if you have a disability. have your landlords sold the property already? if not perhaps you will not have to move out when the notice expires. have you got a good relationship with your landlord? could you negiociate to stay until the farm is sold rather than them having to go to court for a possession order.
  7. then at least 2 months notice, if its a section 21. but if their using section 8 it can be 2 weeks. is it a fixed term or periodic. how do you pay your rent? weekly or monthly
  8. Hi it really depends on the type of tenancy you have. Assured, Assured Shorthold or Secure for instance.
  9. Thank you for your help, I went to meet the young man but unfortunately he did not show up. I guess it maybe due to his lifestyle, I will probably see him on Saturday outside Sainsburys, will have a chat to him then.
  10. Hi, later this morning i'm going to a Barclays branch with my local big issue seller to try to get his money back for him and i would really like some help. I'll try to explain. He had a basic account with the Woolwich which has now merged with Barclays. He is transient homeless not street homeless, anyway. He knew the day his benefit would be paid in and throughout the week he would put his card in the hole in the wall and if anything came out he knew he had something for that day. Then his account was moved to Barclays. on his benefit day he went to get his money out and the cash machine flashed, no funds available. he went into the bank to see what was wrong, he was told he had gone overdrawn on his account. Impossible he said not with my basic account. oh yes said the patronising bank employee, you have exceeded your OVERDRAFT. I dont have one replied the Big issue seller. You do, said the Bank employee, we gave you one and now you're overdrawn and you have bank charges to prove it, we have also charged you £5 per day for the last week ansd a bit while you have been over drawn. To cut a long story short he had no money for the next two benefit paydays, he could not pay his way with the people who let him sleep on their floor and the bank would not help him in anyway shape or form. He told me he has spoken with other sellers who had accounts with thw woolwich and Barclays have done the same to them. They told him he should keep a closer eye on his financies. I am so bloody cross, we are going to try to see a manager today and i'm going to try to convince them to give him his money back, so any help or advice would be really welcome. Thanks, Trayday
  11. ok dont shout, i have looked but i can find what i should do next about stopping the case, do i have to notify the court directly or can i stop it on the moneyclaim site. ps have moved it to new account just in case lol
  12. i cant believe it, i went on line to check my account to see how much shopping i could do this weekend and there it was. No phone call, no letter nothing, just £2777.64. when i was expecting about £60.00. i really really cant believe it, i keep looking at my account. thank you so much to dave and co and all my fellow halifax group brothers and sisters.
  13. Well done, we are still going through the process, we have had notification from the court this morning that Halifax are going to defend in full. Can i ask if you had the same notification and if you did, how much later did they settle. What are you going to do with your money apart from kissing the cheque. lol
  14. Hi everybody, I recieved an offer of £750 from halifax last thursday. I am claiming £2700.00, so i called them on friday and spoke to a lovely lady, I thanked her for the offer and politely turned it down. we had a bit of a chat she wondered why i felt i might be entilted to anything more than the very generous £750 so i tried to explain (as if she didn't know). I told her I would pursue the claim as far as I needed to, to get back the unfair and unlawful charges that they had punished me with over the years. I offered to cut out the middle man (the court) and accept the £2600.00 so they wouldn't have to pay my charges or the 8% a day interest. The lovely lady said she would do all she could, but they had "procedures" which had to be followed. Today i had the made you an offer thats it letter. So I have now filed my claim on line. I am so excited and nervous but can't wait to see what happens now. THREADS MERGED
