  1. Chalk up another for the customers, didnt bother with a thread on here, but just settled for the sake of speed of pay out for roughly 85% of of my total claim. Cheque arrived this morning, no conditions whatsoever. As a note the claim was charges, contractual interest and s69 interest on top. I basically surrendered my court fees in accepting a reduced amount.
  2. Hoorah and Hussar!! We have success. Cheque on my doorstep this morning. Well over the last 12 months I have taken every bank/card I have dealt with to the cleaners, alll because when I was in trouble they took advantage. Final score Petmidget £12,400 Banks £0.   3. Court system still grinds very slowly. But we have movement. I have just spoken to High Court Enforcement (my chosen bailiffs firm) they have this morning received the High Court Writ of Fifa and will be paying LTSB Head Office in London a unannounced and probably quite unpleasant visit tomorrow morning As this may be my lost post on this subject I would like to give a big thanks to Reidnet who has been most helpful in this forum and may he spend much time filing papers at Dundee to his hearts content.

  5. I have a default registered in my credit history for a seriously piddling sum of £60. It is not doing my history much good and if possible I would like it removed. It stems from moving house and forgetting to pay a bill, total accident. Once I spotted it on my history I paid it, which was about a year later. I have placed a notice of correction on the entry explaining its nature. I have asked the company, Telewest to remove it, they said nothing to do with them now, though that I find hard to believe. In fact I am even a customer again so doesnt bother them much. It will be there for another 3 years or so, and I dont like the idea of a my history being screwed up by something so insignificant. I had no contact from Telewest once leaving the address, I left in a hurry for personal reasons and didnt have a forward in place. So never received a deafult notice, neither did they attempt to trace me or if they did they failed as I was back on electoral roll within 6 months or so, certainly wasnt hiding from anyone. Do I have any recourse? Ideas or examples eagerly awaited ta
  6. Getting excited now the High Court Writ (cor dont that sound official and scary) is being issued on Wednesday. Then the buggers will get a knock on the door from a Sheriff's Officer (wonder if he will look like Keith Allen or Tony Robinson) pay up or we loot the place. It might even be worth a trip to Swansea (i guess they will go to closest branch for convenience) just to watch it all kick off.
  7. I cant see anything in that which says I need to justify my reason for moving the collection and this was done on the advice of a certificated bailiffs. And I would say that a large UK Plc having been ruled against and still not settling in nearly 3 months later is enough justification to get the big guns out. quote "If a creditor has a county court judgment against you they may be able to transfer the matter to the High Court for enforcement if they want to use 'execution against goods' to enforce the debt. This means they use sheriff's officers to try to take your goods and sell them to pay some or all of the debt. From April 2004 sheriff's officers are known as enforcement officers. If the county court judgment is for an unregulated debt then the following applies. If the debt is for more than £600 and less than £5,000 the creditor can choose to transfer the judgment to the High Court for enforcement. "

  9. Process takes about 5 days to transfer to High Court, so with a bit of luck I will have my own merry band of heavies come next Monday. Feel like Robin Hood, take from the rich and give to the ... well ME!!!
  10. Hey we move on again. Spoke to a pal who is a bailiff and got some valuable information. I have applied to have the judgment moved to the High Court and then I can appoint my own baillifs, my pals firm of course. This has several advatanges, 1 a professional baillif firm will be considerably more tenacious in collecting than the employed baillifs of the CC system and 2 I can recalc my s69 interest since date of judgment which is an extra £20 or so. Maybe at last we will start to see movement
  11. I am finding to my cost that the County Court system is over loaded with work and things are quickly grinding to halt. I have a judgment for a sum in the order of £3k and have done since mid December. I gave the bank in question more than adequate time and several prompts to pay up, they havent. I took the step of issuing a Warrant using CC baillifs, but problem is they are woefully slow, warrant is 6 weeks old and they have done square root of nowt so far. A conversation this afternoon with a friend in the debt collection industry turns out you can apply to have the warrant moved to the High Court (£50 fee) and then appoint a baillif of my choice, ie a professional being paid (by the debtor) and therefore keen to collect and probably not overloaded. So I am off to do the paperwork and hopefully I will eventually get my cash. So if you have a warrant and the collection is dragging I recommend this change of tack, the fees are paid in addition to the debt and will no doubt get you a quicker result.
  12. The T&C's can say what they like the debt is not secured and as such ranks pari passu with all other unsecured debts in a IVA or bankruptcy. The key to an IVA is getting 75% of your debt holders by value to agree to the payment plan, the other 25% have to comply or risk getting nothing. It is no doubt just an additional pressure tactic, if you make it known to them you intend to get an IVA they will point you to this to scare you, fact is they cant enforce it. And if you are that far down the line they will default you anyway and end up having the get a court order to enforce payment, which of course will be set at the level the court thinks you can afford.
  13. Just to resurrect this old thread. Thanks for your queries, this is still rumbling on. Total ostrich approach by LTSB. Unfortunately not helped by the fact the CC system is so overloaded actually gettting the bailiffs to do anything is a nightmare. Took 3 1/2 weeks for them to even write a 7 day letter, I dont know if that has been replied to yet, I certainly dont have the cash. I have gone back to LTSB to try and persuade them that baliff doing a walking possession in their head office isnt going to be good publicity. Maybe this letter they will acknowledge. but maybe not. Also asked court to tell me when WP will be carried out, I thought I may as well do a bit for the cause and see if I can arrange a reporter or 2. I was on BBC2's Working lunch as a guest a few years back, this stuff is right up their alley, could find the producers email somewhere.
  14. Not entirely sure they can levy on the cash as it belongs to customers and not the bank. Dont care if bailiffs actually walk into LTSB and start levying on stuff with the ensuing publicity (in fact would certainly not like the publicity personally), I just want my legally rightful cash. The judgement is now just short of 2 months old and I have been more than reasonable. It isnt hard to track down 1 of the largest companies in the UK they have branches on every high street. I accept that a letter is generally written but after that it has expired, it has to be the easiest warrant to enforce in history. Bailiff goes round, shows the warrant to a suitable official, a few phonecalls to legal, who say pay up. Job done It isnt much but can I claim additional interest for my extra 2 months wait. Its about £40 roughly.
  15. I suppose this is posting from the other side of the fence. I have a CCJ against a bank, they have ignored the entire process. After various letters since gaining judgment requesting payment I instructed county court bailiffs to chase, this was more than 2 weeks ago. As far as I can tell, they havent done a thing. When i phoned the court concerned they asked me to fax a request for an update, this I did immediately and havent heard a thing since. I have a friend who runs a bailiff company (dont throw things, he is a nice bloke and his firm acts within the rules) but I believe I cant appoint him as only CC bailiffs are allowed to chase CC debts
  16. Good call, the union reps (assuming Egg dont ban unions which they probably do) would go absolutely off it. Good start for Citibank, a staff walkout for Egg disclosing sensitive and personal information re staff to the general public.
  17. Another week in. I have issued enforcement notice to be actioned by London and City county court bailiffs at LTSB head office. tee hee cat pigeons etc Only wish I could be there to see it. Bet they pay up on receipt of the 7 day letter they are to receive rather than bailiffs turning up. Pity I could quite fancy a piece of LTSB head office corporate art in my house, a Turner maybe!! Getting bored of this now dragging on, I have plans for this money, bah humbug.
  18. It rumbles on... LTSB are now playing the proverbial ostrich and ignoring me and the court. 2 letters, 3 weeks since judgement and no sign of cash. Even wrote to their solicitors to see if they could lean on LTSB. So court are sending me a enforcement pack to sent on the bailiffs. That should be a laugh. Just as well I am not desperate for this money.

I totally accept the argument of misselling, misleading customers as to what this insurance does and doesnt do, the inference that your application will be looked at more favourably if you agree to the insurance etc. What i cant believe is that if someone gets a loan/cc and signs an agreement not requiring PPI and presumably know the length of the loan and payments (your 2 most important questions to ask) then it simply "appears", this would throw your payments out of whack and if a loan i had agreed at say 300 then started being taken at 340, i would be on the phone immediately. I personally think a lot of the "appearances" are people simply not reading whats in front of them. They may not have asked for PPI but the company may have an opt out rather than opt in system, so double check the total amount payable less the lump sum you borrowed, does this stack against the quoted interest rate. I realise this calculation may be beyond a lot of people but it doesnt take much to say £9000 over 3 years at 10%, that is roughly £900 in the 1st year, £600 in the 2nd and £300 in the last. If your total payable is significantly more than £10,800 then start asking questions. And when applying online check the hard copy agreements against what you asked for, its the paper that is legally binding. No offence taken and I hope my wider position illustrates I am not saying "your fault" but saying "dont trust them, read everything, if you dont want PPI make sure you dont get it"
  20. I dont get this. I find it hard to believe that even Egg (and we all know they are sneaky sods) would add on PPI to a product without authorisation. I certainly wont defend them, will be going after them next as it happens. But I have used Egg since they started and have had 2 cards and a loan with them, none with PPI because I never asked for it. And surely most of their applications are online, so if you tick the box you get it. Its not their fault if people dont take the time to read whats on screen in front of them. Plus before you actually get the card/loan you get hard copies. You should always read these to make you are signing for what you asked for, as processing errors do happen. And if you sign it without reading it then you have no real argument, as only a fool would sign a contract without reading it.
  21. Judgement entered this morning, right LTSB pay up. Xmas has come early baby!! A little over £3k, should pay for a lot of mince pies.

I have made and successfully won 3 claims against LTSB and they hav not retaliated in any way but they do drag their heels, though my finances are in a much better state now then the period for which I was claiming most of the charges. And they dont learn and never remove charges willingly. I had another 1 this month (2nd this year on all accounts, I am a good boy now), the reason. £7 over my limit for 1 day. How the hell does that justify £35. I wont be going to the bother of reclaiming that, seeing as I they have very kindly given me in the region of £7000 this year.
  23. Argh another couple of days to wait. Processing backlog means my judgement request sent off tuesday wont be processed until tomorrow at earliest.
  24. The letter was on the wrong case. So hope and pray I will have judgement on monday. Oh happy days, that will make xmas a lot lot nicer. How to spend all that lovely wonga.
  25. Well this is proving more awkward than all my charges ones put together. Patiently waited for Court to catch up, even though that gave LTSB further opportunity to delay things, and of course it would be nice to have this money for xmas. Now court tell me there is a letter dated 7 December detailing that the sum has been settled, purporting to be from me. I think I would have remembered writing that or receiving the money. They are looking into it, but cant get back to me until tomorrow. In the meantime my judgement cant be actioned. They think it has possibly been put on wrong case. Personally I think LTSB have written it as I have claimed for charges on the same account. However should they have not filed a defence for that (an erroneous defence which I mentioned earlier, where do i stand?) rather than a letter. So will i get a judgement tomorrow, not likely, maybe monday? This is taking the mickey. On the upside it appear to have totally passed LTSB by, so unless the dragon wakes up I will get my judgement soon.
