  3. I still have both! There was no mention of anything closing or being removed. ITs a small amount in the grand sceme of things, so I wasnt concerned. If I claimed again then It may be a different storey!
  4. Well, the bank entered a defence. I recieved a letter one day later offering a partial refund, I declined and told them i would only settle for a full refund. Sure enough, a full refund is now on its way to me and the court case is being dismissed.
  5. Excellent post. This will come in handy with RBoS as well. What responce did you get from your part 18 req.? Were they able to provide any evidence of manual intervention?
  6. Does this mean we should begin to send copies of the terms and conditions to the courts as well as the breakdowns of charges?
  7. OK, I received my return and hearing dates now see sig. Little bit worried by the thread in the scotland forum http://www.consumeractiongroup.co.uk/forum/scotland/13879-i-am-going-court-4.html It seems they ended up in court as they didnt attach the terms and conditions of their conracts, Would this be worth sending to the court do you think?
  8. You're right, you cant. Check the sticky at the top of the scotland forum for the relevant paperwork.

Ignore the OFT thing, thats only a recent addition to our arsnal, the one you need to be concerned about is that any charge not reflecting actual loss is therefore punative and so agsints common contract law. Now it doesnt cost them £10 to tell you you went over your OD and send you a letter. Yes I am claiming for these amounts, you should too. I'm also route 21.
  10. Claim Filed!!! Oh eck. Now we await my defence and hearing dates... What generally happens with RBS? Do they enter a defence and then fold a day before court? Does my thread need to be moved to the scotland forum?
