  1. Thanks for the reply.No they havent ben at my home or made a levy. I think I owe in total around £2000. No charges to my knowledge have been added.As I say, since I stopped paying I heard nothing (since end of November) so I thought I would write to them and ask for a little time.I'm worried when I call in the morning hes going to say he wants it all now (which I havent got) or hes coming to my flat.

I had come to a arrangement with Phoniex with regards to outstanding council tax and I was paying until the end on Novemeber.I had written to them asking if I could have time to catch up by mid February - as I am really struggling. Its for 2 years of council tax.When I stopped paying I heard nothing - thats why I wrote - to say I understand but can they help.They have written back saying you need to call the baliff asap and tough.What can I do if I havent got the money and they want it all now.I work but my wages arent brilliant.Thanks.

    This was a sofa he was ordering. The goods had not been dispatched. Just paid for - straight away the retailer realised the error and called him.

     

    Sofa was advertised for 995.00 on the web and he paid 695.00.

     

    I think his point was, the salesperson agreed a price on the telephone ( by all accounts a inexperienced salesperson) even though the website had a higher price. Directed him to a area of there website which allowed adhoc payments - he paid and then received a automated receipt and then a call from the internet sales dept to say this was a price error.

    My friend purchased something online today. Its a small retailer, He saw the advertised price on the web (could have bought direct online) but instead spoke to a sales person who set up a area for him to pay online - price difference was £300 discount!

    Anyway he made payment and received a email confirmation - and then had a call from the salesperson to say they had made a mistake in the price (should have realised with the price online) and could he pay the difference - he said no - you have sold me the price and I have paid for it, so that should be it

     

    The retailer pointed to there terms and conditions and said they have a right to cancel and refund any payments if errors are made.

     

    My friend also said he had previously checked with another branch of the same company who had quoted him the correct price - so when he had spoken to the sales guy who made the mistake - he thought his luck was in.

     

    Where does he stand with the retailer - even if the retailer has verbally give him a price and he then paid?

  5. well it seems like Capquest must have bought a job lot during the summer.That letter you have written sounds good - someone else with more experience wll also give it the once over.

     

    Anyway , another letter arrived today - a notice of assignment from Halifax dated July....Mmmm funny how as I have lived at this address for years on the electroll role etc , never had any correspondance.Also have had dealings with Capquest before and paid them!But not with this one , seems they are blowing against the wind.

     

    Question is , why have Halifax held my details for this long?if I owed them money - why leave until now too come after me - 15 years or so?I have been checking my credit records now for a few years and no sign of any debts from these?

     

    I thought that after six years any info was gone?

  6. thanks - I am sending a s.a.r to Egg. But , is the account classed as in 'dispute' ?so can Capquest carry on adding interest?

  7. just a little help again with this ongoing Capquest dispute. I have just recieved a cca from them - which looks correct from egg. No statements though - and nothing about insurance etc? I had written back to Capquest reminding them of this and they have replied saying they are chasing up but ;

     

    1.they will not freeze any interest(I thought when account is in dispute they couldnt add interest?)

     

    2.they are reminding me that if they can not come up with all the paper work - they will still chase me.

     

    3.do I S.A.R. the original creditor or do I wait for Capquest to come up with the paper work?.

  8. Thanks for your replies so far! So as I se it I would need to -

    1-do a s.a.r. for her to ABBEY.

    2 -write to ABBEY and tell them she is disputing due to charges .

     

     

    and then quote the hardship , and then offer the repayment which she originally offered?

  9. Not sure if this is the right place...(mods can you move if need be?)

     

    My friend and neighbour is in her 60's and her partner is terminally ill. She retired late last year.She has banked with Abbey for over 20 years , and in February they give her notice that in a couple of weeks her overdraft was going to be cancelled from £1000 to nil. As far as I can gather she had never been over , but had probaly lived iin it some-months as only her pension was going in - at the same time she battling with the local council over benifits due to her.

     

    With everything else going on , she dug her head in the sand after trying to reason with Abbey- to no avail.As soon as the overdraft went the charges started to spiral - the council paid over £600 in her account to what she was owed - but this was lost 'into the old overdraft'. She went to Abbey , tried to get hold of this money and offer a repayment plan of £10 a week - and to ask for the charges to be stopped.They were not helpful and said no.

     

    I have now opened another bank account for her , she has offered Abbey £10 a week again , they have refused and now threatening to default her.She now owes £1600!

     

    Any advice please??

  10. wonder if any one can help . A friend of mines, little girl cut her head open so they rushed in the car to hospital , when they arrived they quickly parked and ran in where she needed a couple of stitches .

     

    They forgot to pay and display in the hospital car park - came out and found they had received a ticket. Is there any right of appeal on these as we cant see on the ticket . Also the parking atendant had entered the wrong car registration number then crossed it out and wrote the correct one - it doesnt seem fair as it was a genuine emergency.

     

    any advice pelase?
