  1. hello again, update on whats happened, it took lloyds from the 20th July 2007 to the 5th november 2007 to send the credit card statments, Im off to file witht he court using an N1? total is just shy of £2500 for the current acc and the credit card the same, have had a response for the current account telling me to whistle. ive send both the letters to both and the deadlines have gone. Now with the FSA vs the banks legal battke and from what i have read, all claims are on hold (the bank also said this) , i am on a low income and this money would come in handy, i believe that the court makes an individual judgement on the individual circumstances, am i right in thinking that? im off down the court on monday morning anyways!! any further info would be gratefully received
  2. right i need to send the letter off asking for the charges to be refunded, who does that get sent to? thanks again for the help! also my partner is actually on a low income, will that effect the stay in court do you think
  3. ok, i have added up the charges for the account, just one thing, there are charges for account usage which is £7, im not sure what these are for? anyway. i have a figure and the 8% interest thing has but another £500 on top of the initial figure so im pleased that we can claim interest. just one thing to point out, when i got my statements, in it i got a letter stating that as the oft are looking into this, then all claims will be held until such time, shoudl i send all the letters as normal and hope for a full settlement out of court as it seems people are getting this recently!

Update on claim, 40 days wer up so i sent a $hitty letter saying it was illegal, addressed to chris brown at the copy statement unit. received 2 copies of the same current account statements when i asked for one current account and one credit card account. i have written another letter to chris brown telling him he has 7 days or i will proceed with sueing them for withholding info etc, Now the total amount on the statements for all charges is £2390 on the current account. There are loads of unpaid DD fees for silly amounts like 4 charges of £120 each! do we claim for everything on here, also am, i right in thinking we do the 8% sat interest on a yearly basis so all transactions from 2001 add 8% then multiply it by 6 (for the years) making sure to included the previous years interest! any help would be grateful so we can get the ball rolling asap with the first claim. thanks
  5. hi and thanks for the response, #barty: i havent sent them yet, they are heree on my desk, i was wondering if i should send them recorded delivery so they cant fob me off saying they havent got the requests, i am in the early stages but am preparing all paperwork for it and getting as much info as poss so i am prepared for the legal jargon. Once they are sent, (i was told on the phone when i got the address) it usually takes within 21 days to get a copy of your files but can take up to 40 which is fine. the card is not usable any longer and lloyds state the account is not available to use, a a recent statement, it says available: 0 credit limit: 0 its been like that for years so we would like a big fat cheque for the amount! it will be a rocky road by the looks of things but pretty straightforward. as this site is invaluable, the first thing i will be doing is making a donation to the site as i was gonna get stung by a compnay wanting 30% when i can do this myself (with you guys help of course!) i will keep you posted and i am off to the post office now to get them sent off.

Gumbo: i don't think you get the whole thing with claiming back charges, they are not just for going overdrawn. they are for many different charges. people are only try to help, the law and peoples views often differ and maybe what patdavis said was an opinion and not 100% law. Most things you read about can not be taken 100% gospel unless there is evidence to back this up. A couple of questions though: 1: did you inform the local police the car was there and explained the situation, becuase for all they know, it could of been stolen and left on the road, and giving where it was. "COULD" of been causing an obstruction which gives the police grounds to move it anyway. 2: Did you leave a note in the window or something stating, broken down be back at such a time, i know loads of people who have done this and their cars still there when they go back to collect them. 3: Not as to get a bee in anyones bonnet here but, do you know the road well, is there any speed cameras on it, if it is unlit, then the 40MPH is bound to be broken and the police realise this enforcing a speed limit doesn't mean that it it kept to by every driver on the road. 4; did you leave any hazard lights or warning triangle on display to make other road users aware it was there. Once we know the details above, we can pass judgment and summerize the situation to hopefully help you further.
  7. hello phil, my sister is in herts constabulary and she said that the car could of been causing an obstruction and was removed for the safety of the general public. she will have a word with traffic when she is back in work but she seems to think that you can go to the pound where its kept, produce your docs and explain the situation, you will then need to pay and then appeal and dispute, some pounds are different as to how they work but hope that helps
  8. Hello all. we have recently stumbled across this site after deciding enough was enough with paying bank charges and other charges. Basically my partner has a credit card with lloyds tsb, she has had it for 9 years and the limit was originally £1000. Eventually it was maxed and minimum payments were being made. most of the time payments above the minimum payment was made and cut the card up to stop spending, she has made payments on average of £50 per month since 2001. her current outstanding balance is £2100!!! now she has asked for a settlement figure and been told that they wont accept below 98% of the balance. I explained to her that some if not all of her charges can be claimed back, we contacted a company which shall remain nameless, they said they would do it but if successful, they kept 30%. Upon checking this i found out we can do this oursleves and keep all the money. so the point we are up to is. We have used the template supplied on the site to write to the bank asking for a copy of all trans for the last 6 years, a couple of questions. 1: should we sent this via recorded delivery as from what i have read, the banks sometimes dont receive the letters as a way of trying to get out of supplying info. 2: We are claiming also for bank charges with the current account, this account has been held for over 10 years and there is a hell of a lot of charges been issued on the account and recently there have been £251 in charges for paypal trying to take direct debits, we dont have paypal anymore and they have no reason to take money from us, but the bank say tough, so the account remains in the red. are we being too cheeky, claiming both credit card and bank charges back fro the same branch, we have a joint account with natwest and we use this for our main banking anyway and the lloyds hasnt been used in a while. 3: from what i read, the bank charges from the current account, can be claimed back but what exactly can we gain from taking the credit card people to court? will we get the balance reduced, will be be refunded all charges or just some? we are just starting the process of claiming the charges back and will keep everyone posted of how we go. your thoughts and advice though would be brilliant many thanks advance colin and lucy
