  3. TAlk TALK are a nightmare!!! Ive spent 2 months trying to gain a letter advising i owe no money and my account is zero. They ignore letters and only reply to threats. I had to threaten them with Trading Standards to get mine corrected. They work like Telewest/Virgin. they bill you in advance and then re credit, my argument has always been they can not bill you for a service you never received. As long as you have paid for the service received to your premises then thats fine. Have you got on line billing, can you still access it, if so it means they are not canceling your account have you got proof of a letter sent to request cancellation and what date cancellation would kick in , its usually 30 days. After that time if the service continues you do not have to pay for it, its their loss. Why these companies haven't been kicked by the OFT by now is beyond me, there ways of doing business is so wrong. Hope this helps, don't worry as not much they can do as long as you have your side of everything documented and you are sure you owe no more than the usage and service's as paid for in full last month.

  5. Hiya razor sorry to here your problems with Welcome Finance. Ive been reading through different sites the last few days, and Welcome seem to be the company that all members hold the greatest evidence for illegal practice. Shame all cases couldn't get heard together for a mass complaint. Best i can offer on the thread is, Never ever think Welcome will be doing anything to improve your circumstances , as they do not and never will. They rewrite purely not to let you fall off their monthly income sheet. Stick to your guns and don't let them wobble you one bit, they are bullies and nothing more. Fuzzy:)

  7. FOS strike again, they want to know mums financial position now and are over looking her financial position then. Mum has just been allocated benefits and yes she will be better off, a bit.. Wants I&E from mum for her status now, not then i said i will send both. Advised any new benefits are untouchable, FOS replied Ive never heard that before? oh well see where we go from here. Was very interested as to why loan still active and not frozen in Dispute, and also the charge for the loan late payment. Not to interested in how the overdrafts were left to rise in the first place. just have to see what happens, i understand both sides have to be treated fairly, but not taking her status iat the time of the loan or inability to read the T&C is something I'm feeling very unfair. Fingers crossed they come back with a fair result, my last interaction with FOS was an absolute nightmare and far from fair. Fuzzy

If you can prove that the money paid from your bank was defiantely to clear in full and final the balance outstanding prior to the default being applied i would have thought you could present this info to the credit reference agency. you need to cross match those payments with your statements from voda and get it all dated to match up. legal action well it seems these nor the banks care much about legal action, and as it stands we dont have much rights left with any back bone in them for us to use. Don't forget to make copies of your statements to write on, silly me never did so now i have to send scribbled ones off every time
  9. Its possibly this was a front loaded insurance sale, im sure there was some issues with these, try researching it. Insurance on loans now, you pay an amount amonth, and do not pay interest on the Insurance in bulk. What lloyds may have done is sold you insurance from them selves added the money on to the total of the loan, getting more interest out of you , the policy is with them selves , ( how convienient) and say you can not cancel, probably due to the policy being paid up front. Definately research this as im sure some were reclaimable. Fuzzy.
  10. PS don't wait for them they can take up to 8 weeks to resolve this and after that the FOS will do bugger all if they don't , so keep them on thier toes. And don't take crap from collections, they rant all types of junk over the phone. Strictly hard copy now which creates evidence for use as and when.
  11. Hi GM any update on This, you need to do a S.A.R - (Subject Access Request) on Lloyd's. You will receive all the notes from the collections center with this, if not then scream hard until you do. Place your loan in dispute send them a CCA letter from this site. And contact the FSO when you have gathered as much evidence as you can for this. You could give a little more info if possible, did you have a direct debit set up with them, is this still active, when was it closed get a print out from your bank of proof of origination and closure if its applicable. How much was the loan? When did you take it out? over how long? what was your monthly payments? how much was the early settlement? 2 lots of six thousands is a lot but you wouldn't benefit that much from a short settlement on a loan over £12,000 so my guessing your short settlement could only have been around £10,000 as Lloyd's are as tight as a ducks arse. The SAR should reveal alot, and are you now six thousand over drawn.? Fuzzy Wuzzy:)
  12. OK got photo bucket working on this form, all the ticks above the lats one were made by the salesman. The last one is questionable, it refers to the direct debit authorisation, the direct debit guarantee is on the back. The salesman's pen is all over this form apart from mums own signature which was done in a second pen. This form is so easy to confuse customers with, it must have been made this way on purpose its so unfair. Mum has explained, she remembers signing this form in the belief it was for the Direct Debit Authoristaion only, also had no ideal what the rest of the form held until i told her. she has no ideal what the Consumer credit act is then or now, so she could not of ticked the boxes above to their full meaning and i feel the salesman well and truly knew this at the time. http://i59.photobucket.com/albums/g313/bls-photos/mumloanchecklist.jpg Does anyone think i should report this for to the OFT?

  14. grumpy they are terrible, they say as they do not have to send defaults them they do not keep a copy of them, and sadly they are in thier rights. i do hope Ryan has luck as voda relay are a nightmare, got very good advisers to. Best way to loose the default is Bartering on payment.
  15. Like to know what happened any updates? If you brought from vodafone can only deal with them, not like you have a store as a middle man. They have different coding for different products some will be money refund or stright replacement product, this is often on goods around £30. Personaly i think best you will get is they have to have the oppurtunity to repair it, which is a shame as if you brought it in woolworths or tescos , with in the first six months the shop can ring the manufacturer get a code from them and replace it instore. Dont think Voda will even give you that oppurtunity, not with out a fight, Doesn't always pay to go to the top:(
  16. This is the first fob of package from voda phone, you will need this info later but what you want is your statements for each month in detail. They will tell you they do not keep them but they do and they send them when you persisit and threaten FSO OR Information Commissioners Office. They also fail to enclose a list of abbrivations which is also a necessity under your S.A.R - (Subject Access Request) for you to adequately read the notes as above so Push for this also. and out of interest if you requested from your bank a list of direct debits that have been active on your account it will show date originated and date closed, if you have this im not saying it will be the end of your problems buit at least its something to show they had the oppurtunity to take it. When I deal with issues I collect any type of discrepancey no matter how small, just so I get my argument stacked that little bit higher and ive been amazed at how many times they've come in usefull. It does seem it is a trait of Vodaphone to happily let overdue debt sail along unmanaged, ive been told i agreed to pay back in an installment of 3 payments and i did no such thing,they realy are in a world of thier own. Regarding the statement you have to go up one step and back down a step when the payemnt kicks in, ive never seen such a poor statment and mines the same. the payemnt is allocated backwards through the statement once its made.   17. Hi maggie Thankyou for your support they do indeed have a lot to answer for and I will not give up untill this miss sale is exposed. Archer i wish it was the case but no they have the I&E report nice and close to thier chests, just have to find out if we have any right to it and if it is classed as paperwork that they have to keep with them the length of the loan. I have actually been advised by ISA that it is always kept in branch and we could have had a copy of the I&E that very day we had an appointmnet with the Branch Manager. never mined i won't give up ever, and as for not placing it on dispute absolutely disgusting, this is a pensioners income they are playing god with....
