  2. thankyou for your help,altho how would i word the letter,i have used the sar template letter,but im unsure how to inlcude the parts of wanting the original documentation etc?
  3. hey again,i was just reading through the national debtline advice and i wanted to ask something,earlier you said.... The current account doesn't come under the CCA in the same way as loans/credit cards do. However if you are likely to have any unfair penalty charges ie overlimit fees, unpaid cheque/DD fees etc then yes you do need to send a Subject Access Request. The link is below. If you have a loan with the bank or building society, the full monthly instalment will usually be taken from your current account too.This may mean that you do not then have enough money to pay priority debts such as your mortgage, rent, Council Tax, gas or electricity. You should deal with the overdraft and bank loans like other credit debts, and make an offer of payment you can afford. they are saying treat an overdraft like you would any other credit debt??? im abit confused
  4. i did send off for copies of my statements to reclaim bank charges,but it didnt show anything but fees,overdraft charges etc,i dont bank with lloyds anymore,so the sar request would be the way to go? and another thing,i put in a claim to get my bank charges back,but i dont think i put the correct amount down,i think it should be alot higher than i put...so yea,do i put another claim in once i receive the documentation back from my sar request??
  5. i dont remember asking for the ppi,and i was employed at the time,i just think the date is abit dodgy,im sure i took the loan out before the date thats on the agreement

  7. i will upload the agreement abit later,i personally think its enforceable,just im abit curious about the date,i swear that i took the loan out a couple of years earlier than the date thats on the agreement...and also,who do i send the sar to.scm who are acting on behalf of lloyds,or do i send it to lloyds themselves?
  8. i have posted exactly what they sent,the only thing is..i was thinking about the actual credit agreement that they sent me,im pretty positive that the loan agreement was taken out before the date that is on the actual agreement,so could or would thay of changed the date?and do i now send off a sars request??
  9. hi all i hope someone can help me,a while back i sent off for a credit agreement from lloyds tsb,as scm were hassling me,anyway,i get a letter today,they do include a credit agreement for a loan i took out,which was for £2000,but they have also included a current account which has no agreement and it is for £4000,the letter i received to day goes as follows.... our client lloyds tsb account number ********** £4259 loan agreement ************ £2000 further to your recent request,we hereby enclose a copy of the credit agreement.(yes they have included one for the loan account) the current account application is no longer available as it is more than 6 years old and not subject to the consumer credit act. we await your repayment plans. can anyone tell me what to do,i fully accept the loan agreement,but they dont have one for the account???

  11. hi all again,its been a while since i posted about this,anyways ...... hi all,i was wondering if anyone can help me,i had a debt with barclaycard,i requested a cca from them over a year or so ago,it then got passed onto mercers and then calder financial,and each time ive requested a cca,as of yet ive not received anything other than an application form.... so today i get another letter,this time from aktiv kapital saying i can repay the debt with a £415 reduction,meaning i would owe £277,but they are saying i owe £693 which is what i dont understand,because the debt i had with barclaycard with added interest and charges etc was a little over a £1000,so can anyone offer me any ideas as to what to do next??
  12. hi all,i was wondering if anyone could help me,i have a capital one credit card and i owe £1100 on this,and as to which i can not afford the monthly repayments no more,the card was taken out after april 2007 so i know i cant do the cca route,so,do i ask them to reduce monthly payments,or do i just let it go into default and offer which ever credito its sent to a £1 token payment...i do already have 2 defaults against me

  14. hi all,i wrote to credit security asking for a cca twice now,and both times have been totally ignored,today i receive a letter saying...unless they receive payment by noon 9th july a claim will be prepared for issue in the aylesbury county court for the debt....so is there anither letter i can send to these people,as my cca requests have been ignored???
  15. is a cca only applicable if you had a credit card before apr 2007? so for example if you took a credit card out in sept 2007 would they have to supply you with a credit agreement or not??

  17. hi thanks for the reply,but it appears that ive already sent this letter back in september,as to which,they sent me the agreement which i showed you earlier...and i sent a further letter,and again,they sent me the same agreement....any ideas?

  20. well they did send me the agreement thing a few times,but each time it was on its own,then this time around they sent it along with the terms and conditions etc,and time line would be about 8 months,in those 8 months ive had to deal with mercers/calder financial,im still waiting for the next letter i should send,,a template if anything....even tho barclaycard said that this was the final responce
