Hey diskmandave, yes im the keeper and thats why they have FPN'd me just becouse im the RK not becouse im the offender!! All they have done is informed me that im the RK of my car, and new to this whats pepipoo???? thanks

But i was just driving down this road it may well have came from the cars infront??? first ive heard of this was when i recieved the ticket shouldnt they have more proof than one of there own??? I dont smoke in the car so it couldnt have came from me, yes i no most people will say this but im acctually being genuine! is that really all the proof they need?? one of there own workers believes that i may have caused an offence in my vehicle? id be more than happy to pay this FPN if they could prove this was me as i no it wasnt Aaaaahhhhh confused im going to have to pay a fine for an offence i truley believe i didnt do?? thats just not fair???

Hi all, can anyone help me? I came home today to find a FPN from my local council stating "I have reason to believe you have committed the offence of.... on the above date/time the below vehicle committed the offence of littering by throwing a cigarette out of the drivers side window." offence code P05 which is S87, S88. I have read the environmental protection act and find it all a little confusing. I find it outrageous that they can send me a FPN without even asking if I have littered never mind informing me that my car has littered... I dont believe this is true as im very strickt on not smoking in my car or my house as I have two young chilldren. Also the time of the offence was 14:51 I collect my chilldren at 15:00 and believe they have mistaken the time allthough i dont dispute I was driving along that stretch of road at around 14:45 as to get to school on time (As i do everyday of the week). But im possitive i wasnt smoking or throwing ciggarettes out of my car. And as this is a highly busy 40MPH main rd I find it hard to believe that even if I had (which i didnt!!) thrown a ciggarette butt out of the window how would he have seen this wouldnt it have been to small to recognize??? I believe this is the local council recouping monies lost to them due to these hard times!!! Ive read that the onus of proof is on them? is this true? Im unsure of exactly the best way to word my reply to them without making things worse for myself. Any comments or suggestions will be greatly appreciated Many Thanks:-x

hello, Well its been a while scince my last post needles to say i havent had much to say. Ive just been collecting my 4weekly letter of were still investagating. I have been on to the fos but there a bit slow at the moment too. Untill friday when i had a reply saying that they were prepaired to refund my ppi only upto the time i first asked for it to be canceld (aug 07 ) and they would re do my loan with out it. ( not bad to say ive only got 4 payments left!!) i could only accept this as a "full and final settlement". Now i can see that there trying to fob me off with the old final settlement thing becouse i had acctually asked to cancel the ppi and refund ALL my ppi payments as it was missold. Now im in a catch 22 i cant accept the canelation which i have asked for becouse this will prevent me reclaiming everything that they owe me in ppi they have also sent a sepperate letter saying that there investingation does not find the policy to have been mis-sold? Im vary unsure of how to continue from here id hate to mess this up and play into there hands any advie would be grately recieved:D :D boobop

HI Ive spoken to the omsbudsman who ive sent copies of letters and a full account of events. but havent complained to anywhere eles, not really sure how to and didnt know if it would make any difference after going to FOS. you see they havent put in writing that they wont cancel it there just investigating it and whilst there doing that they wont do anything eles. Its pathetic

Hi guys Checked the tracking num and they recived they letter of aceptance today! I wonder how long they now take in actually sending any money or should i expect this amount to just randomly appear in my account? does anyone no how they usually pay?? or if theres a time limit? Im hitting them hard at the min not only im i ongoing with the charges issue im also claiming back mis-sold ppi which they have messed up so badley the omsbudsman has had to try and sort it out!! Im affraid im not there most favourd customer but i must be doing somthing right:D

Quick update, Well so far still NO cancelation of ppi after writing to the head office and being completly ignored i made an official complaint, which was at least acknowledged. and then it started i ve ended up in the loop!! every four weeks for the past 3 months ive been sent a letter saying we are still looking into your case please bear with us.. needless to say i am not happy i am now letting the omsbudsman have a go. hopfully they will have more luck as i seem to be the only person in the world who cannot cancel there ppi. Is this the norm??

Thanks for the reply caro:D I went into my county court today with the letter from the bank the girls behind the desk are brilliant nice and helpful. after they ran off with my letter they came back with this.. So far no stays have been lifted in my area yet! And as far as the letter states i have nothing to lose in accepting this offer as part payment and it will also help me at my hearing in showing that i am prepaird to work with the bank. They also said that they expect the oft hearing to go on for a long time so somthing is better that nothing. I only had untill tomorrow to accept so i have. Ive kept the original letter which states its a good will jesture ( just incase!!) I can only assume that my hardship issue's touched a nerve somewhere. Ill Keep you all updated;)

Just a quick update! I have recieved a offer from the bank!!! Its an ex gratia payment not admitting liability on there part and not a full and final settlement deal, its a goodwill jesture from the bank... (half of what i wish to claim) it also states that accepting this offer will NOT affect my rights to seek the difference owed when the test case is decided. Infact if it finds in my favor they shall automatically hand over the difference owed. Has anyone else had this kind of offer? my removal of stay is due on the 10th is this the banks way of looking good for the judge?? I have to say this has come completely out of the blue for me. advice needed:)

Yes i still have a loan im reclaiming the ppi as it was massively mis-sold to me! and after 2months of constantly trying to cancel the ppi as its void and repeatedly being told NO your not allowed but refusing to put that in writing ive had to make official complaints to cacel it and have it returned as the whole issue is a joke from start to finish. Its worth a try to get info sent by going in your old branch though as the staff are not as wise as the head office and they tend to give things up quite easily. Ha Ha:D :D

I Sent my SAR to YB to get the same info and only recived bank statement. so i went in my branch and politly asked for copies of my loan account as i had misplaced the originals and was getting my documents in order, and the next day i got my credit aggrement and ppi aggrement with all details of payment interest and ppi. allthough i have sent the second letter requesting all my information along with my original letter to requesting the SAR as i was very presice in what i wanted them to send. I got this letter from "hellhasnofury" it seems to be working on them so far maybe you can ammend it see what you think!! I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization: -Full copies of all contracts, credit agreements which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same. - A complete list of all transactions or statements relating to ALL of my Loan Accounts with your organization. _ All Payment Protection Information held to include price of premium, interest applied, total cost and term that it ran for. -Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information. -Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me. - Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction.
