  6. This lot are a bunch of charlatans. I got a ticket from them which stated that I was parked 'on regent street' in a disabled bay without displaying a blue badge. I wrote to them highlighting the fact that there are no disabled bays on Regent street and it is a public road monitored and enforced by the local authority. They rejected the appeal on the grounds that the 'ticket was correctly issued' I am now waiting for court papers so they can explain to the court why they are issuing tickets where they have no legal right. I don't think they will bother.
  7. Would it be fair to get a parking ticket issued by a CCTV camera for parking quite legally? I am a disabled driver who parked legally in a disabled bay and clearly displayed a blue badge but the local council still issued a ticket on the basis that the CCTV operator had seen me park but not display a blue badge. I appealed and it turned out that the CCTV camera was at the REAR of my car and so would never see anything displayed. The council also gave me a ticket for parking in a 'loading only' zone where waiting was limited to 20 minutes. The ticket issued clearly stated that the vehicle was observed from 10.01am to 10.03am.. so parking for 2 minutes whilst getting goods loaded constituted a 'contravention' The appeal stated clearly that the Council had been over zealous and that both instances were incorrectly issued and not valid. There are more illegally issued PCNs overturned at appeal because the Council only see the motorist as a cash cow to make up budget deficits.
  8. I suffered a TIA (minor stroke) whilst in Berlin.. paramedics were called and confirmed what had happened to me but I refused to go to hospital. On my return home I was in such a state that I was unable to decipher fact from fiction and was overdosing on tablets which caused hallucinations etc. I was due to attend an ATOS medical but did not do so due to the condition I was in and was duly marked as 'fit for work' as I was too ill to attend. The reason for not attending, ie the TIA, was deemed not a valid reason for not attending, even though I visited my GP after and the effects were still present and I was admitted to hospital. I appealed and was turned down as the judge refused to accept my medical condition at the time, the interaction of drugs I was on etc and now seems to refuse to give me a written explanation of the decision and without this I cannot take it to the second chamber. The entire system has been designed to ignore illness and disability which it supposedly there to assist. What a joke.

  10. Contact the council and send copies of the repossession order which show that you were not resident for the period they are claiming for. They can only hold you liable for debts incurred up to and including the day of eviction/repossession. Hope this helps.
  11. Thanks Sailor, I am already lodging complaints with trading standards. Mark Ovenden, Managing director of Ford UK had one of his minions reply to me stating that it 'does not matter what the specs in the paperwork state, the spec you receive is dependant on the production date' What utter tosh!! Misleading advertising and breach of contract me thinks. The dealer has tried to get it all sorted for me but it is Ford UK who are digging their heals in and saying that it is not and never has been standard equipment. Warning to all people looking at buying a Ford, you may not get what you pay for and no one at Ford cares once they have your money
  12. You also should check the Road Traffic Order (RTO) as Leeds CC have a habit of enforcing where they have no authority. If where you parked is NOT written in the RTO for the area then they cannot enforce. I had a 2 year battle with Leeds CC about incorrect RTOs and they finally admitted that although the area was marked on the map the wording did not refer to it and so could not enforce. You may also want to look at the signage, including road markings as they are often not legally enforceable. Where did you park and what was the offence?
  13. Question: When is a piece of standard equipment in a Ford motor car not a piece of standard equipment? Answer: When Ford UK decide it is not despite ALL publications and websites (including independent ones) saying that it is. I recently purchased a Ford Galaxay and ALL the brochures, web sites and independent assessment sites for the car clearly stated that Galaxy came with a tonneau cover as standard. fine you might thnk but when it finally gets delivered there is something missing. The STANDARD tonneau cover. When queried you are told that although it states it is standard equipment it is in actual fact an OPTIONAL EXTRA!!! Ford UK seem not to understand the difference between these two phrases. Even if you take this to director level, Mark Ovenden contact him via email on movende1@ford.com, you are still told that the web site and brochures are out of date and has not been standard equipment since early 2010. Despite sending them copies of the website in 2011, 2012 and picking up the 'new 2012 brochures' ALL which state it is standard, Ford UK still insist that it is not. Ford's new slogan - More as Standard.. should really read....... 'More as standard as long as you pay through the nose for the standard equipment which we will class as optional extras even though we clearly state it is standard. Complain and we will ignore you and tell you that you are wrong and did not understand, and we will treat you like the **** of the earth as we have your money now so we dont care..' Not much of a slogan for increasing its customer base I know but at least it would be accurate.
  14. Hi Rebel1 - Thanks for that ... I am aware I can appeal and it is now at the stage where it is going to the ombudsman rather than an adjudicator. I did find out that the original case was closed early as the adjudicator 'had to clear her workload due to going on maternity leave'. My experience shows that the FOS should invest any money they have in teaching their adjudicators to read. Oh well I will wait and see what they say and post the replies here.
  15. I lodged a complaint with the FOS after Newcastle BS (NBS)did not honour payments on a prepaid credit card issued to me by my company. The reason NBS gave me was that the payment was £2 over my available balance. I checked the on line statement and it clearly showed that the last time I used the card, three moths earlier, it left a balance available of £197.50. Before issuing the payment I checked again and found it exactly the same as three months ago, £197.50 I issued this amount in payment and NBS refused it. NBS stated that there were 2 £1 'security' transaction which reduced my balance to £195.50. I checked with the retailer who took these ;security transactions' and they confirmed that they took the payments and refunded them back to the account 2 minutes later. That was over three months prior to this transaction. NBS did not note this on the visible statement I had access to and did not credit the money back until I contacted them. The FOS decided that the T&Cs stated that 'recent transactions may impact on available credit' which is true but I argued that these 'recent transactions' are ones I KNEW about not ones happening behind the scenes. I also pointed out that the T&Cs also stated that if payment were made which took me over the available credit then NBS reserve the right to demand payment in full within 14 days' The FOS strangely seemed to ignore this and advised that I would have been aware of the transaction. When I asked the FOS how this would represent itself they blatantly told me that it was on a 'back office system to which customers have no access' but I should have looked at my statement which showed these transaction. I asked them to highlight these transactions on the stement available to me and surprisingly they could not but yet the FOS seem to think that it is my fault for not chasing NBS earlier for transactions I knew nothing about? To add insult to injury, NBS closed the account without notifying me and several months later and several months after that accepted a credit back to the card from a retailer to whom I had returned goods. On contacting NBS I was informed that I could not have the money held by them as the account was closed and I should go back to my employer. I asked if my employer had been sent the money and was advised no. I wrote to the FOS to add to the original complaint just to be told that I need to lodge NEW complaint. I did this and got an email stating that both complaints have been merged. Talk about the left hand not knowing what the right is doing. The FOS is a joke and they are only there to serve the interest of banks. I may be missing something here, so I will ask for any advice you may be able to give... How can it be deemed MY fault for not checking a back office system to which I have no access and how is it MY fault that I issued payment for the full available balance as displayed for over three months without knowing that NBS are grossly inefficient and cannot process automatic payments? Also why is it MY responsibility to chase my employer for funds held by NBS when NBS have never sent those funds to them? I think the answer lies in the furry little non reality world that is the FOS.

In-Trouble....If you find yourself in this position then the easiest thing to do is contact someone like Payplan, they offer free advice and will negotiate with your creditors and work out a realistic affordable repayment plan. If you do need short term borrowing then it may be better for you to seek out your local Credit Union. Hope this helps
  17. Just send a simple letter/email to McKenzie Hall stating that the account is in dispute and that you expect them to act within the OFT guidelines. You also need to state that if you receive any further communication from MH the this will be deemed as breaching the OFT guidelines and will be dealt with accordingly. (see S2.6 h) of the oft guidance (h. ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment)
  18. I have just had dealings with Quickquid and it has taken FIVE days, FOURS HOURS of phone calls and TWO complaints emails to finally resolve the problem. What was the problem? Paying off the loan early...seems to be the most heinous crime in their eyes. The fun started when I called to pay the outstanding and the operator took card details adn 'processed the card' and even after confirming details I was informed that the card had been declined due to 'an address error' so whilst I had her on the phone I called my bank and was surprised to find that Visa declines at my bank had now issued TWO payments to them with authorisation numbers. I told Quickquid this and was initially told that the bank were lying to me then I was told that I was lying to them and was not relaying the information correctly. After much argument the operator started with the 'I cannot hear you' routine, despite the fact that I could hear myself talking to her through her headset. Ultimately they hung up. I checked with the bank and funds had been transferred back to my account as 'canx by originator', even visa declines and the bank say they very rarely see this. I called again several days later just to find that because of this 'address error' additional interest and charges had been applied to the account. I disputed it and was told that as a UK customer I was not aware of how the international banking system worked. I did point out that this had come directly from my bank and the mouthy yank at the end of the phone told me that they were in error. Talk about arrogance. He then hung up on me. On calling back I got an even more arrogant (if that were possible) woman who immediately started playing the 'I cant hear you game'. Again they hung up on me. On the final call I was told that I had to divulge personal details about the person making the payment and I refused, this resulted in 20 minutes of arguing, after which I was put through to another surly yank who told me that the person I had spoken to originally could not process the payment as had 'no authority and could not access the payment system' strange state of affairs to have as I contacted the collections department. Collections not being able to take payments? Only in America. Again I was told that I had caused the problem by 'not co-operating' but when I pointed out that I had introduced the person making the payment as ...Mr....etc how does that constitute non co-operation? I was told that they needed the full name and address of the person making the payment so they could confirm his identity. I pointed out that as long as the name on the card, the number, security code and address details matched with the banks details then that is all that mattered, to which I was told that it contravenes their policies and procedures. Another 2 hour argument ensued once they told me what payment they were wanting to take.. finally they backed down and only took the original payment they should have taken 5 days earlier, which they did TWICE and then returned it to my account. DO NOT DEAL WITH THIS BUNCH OF CHARLATANS AS THEY ARE NOTHING MORE THAN MONEY GRABBING LEACHES WITH NO REGARD TO CUSTOMER SERVICE. My advice, if you need short term loans then look up your local credit union as they offer loans at near bank rates and wont rip you off.
  19. I am having on -going problems with Leeds City Council Parking Services and wonder if anyone else is suffering the same. I live in a block of flats which has its own private car park which has permits issued by Leeds Parking Services. The problem is that they issue PCNs state that the car was parked on the road at the side of the car park. I have asked for the RTO governing the car park and they cannot provide it. I queried it with the housing management office and have been informed that there is no RTO in force for the car park as it is private property belonging to the flats and there is no current agreement in force for parking services to enforce PCNs in this area. They even issued a PCN for parking in a disabled bay (yes I do have a blue badge) on the road and not displaying the badge, only problem with that is there is NO disabled bay marked on the road. Every ticket issued (so far 15) has been appealed and initially rejected until I inform them I want to go to NPAS then suddenly the appeal is allowed. Strange that they dont want to go to appeal and be told that they have no legal right to issue PCNs. Checked today and they have issued a PCN for not displaying a parking permit and actually put the ticket ABOVE the permit that the driver was allegedly not displaying. Is anyone else suffering this level of harassment and would be interested in joining a campaign to get this budget boosting illegal action stopped?

Even though there is no clause in your contract stating you have parking rights under contract law by allowing you park there and taking no action they have in effect agreed to you parking there. Any changes to that contract clause must be agreed to. You say that each flat has a parking bay, eg 17 for flat 17, how is that notified to you?   21. The DVLA has a left hand which does not know what the right hand is doing. I recently SORNd a vehicle at my local DVLA office, got a receipt for it and still managed to get a fine. When I pointed out that I did it in the office and got a receipt they told me that this was not acceptable as evidence that they had been informed correctly. A few weeks later I got a letter from the DVLA stating that my vehicle had been SORNd but ALL the wrong details on it. It turned out that I had been sent details of a man in Liverpool who SORNd his motorbike in December. I rung the DVLA and told them what happened, they used the old chestnut of Data Protection and would not talk to me about it even though I gave them all the info off the letter they sent. When I asked why I had got a letter stating the details of another persons vehicle I was told that I must have a similar name/reg/address. When I pointed out that the name was completely different, the reg completely different and the towns nearly 100 miles apart, the excuse was oh it must have been a computer glitch. Despite knowing that their computer system is severely flawed they still insist on saying that I would have to pay. After I spoke to a manager they agreed that an error had been made. Keep on at them and dont speak to the people on the phones as they are only Capita semi trained monkeys and read off scripts, ask to speak to someone who actually knows what they are talking about.

  23. Hi there Can anyone out there help? I purchased a JVC DVD recorder from Miller Brothers several months ago but the retailer ceased trading and the recorder developed a fault. I contacted JVC who advised me that they would replace the faulty unit as they 'had major problems with this model and they all had the same fault' They exchanged it for an identical model which worked well for s a few months then developed the same fault. At the point of agreeing to the exchange I was advised that all the 'swap out' stock had been rectified and the problem resolved. Again I contacted them and now they are refusing to do anything about it as their 'swap out' stock has been depleted. They say I can get a chargeable repair done but they would not refund this cost. My questions are: 1. How does the Sale of Goods Act work when a retailer ceases trading and are my rights under the Act then forfeit? 2. What responsibility does the manufacturer have once they have replaced an item knowing that it has an inherent fault? 3. What legal redress is open to me? I would be grateful if anyone can offer any advice on this. Thanks

Thanks for that, I have already asked them to provide me with photographic evidence of the PCN on my screen and was told that the PAs do not take photos, they hand draw a sketch instead which they use in evidence. Needless to say I am not accepting this at all. Can you shed any light on my original query though, if the lines are not clearly visible and have eroded away and are not in compliance with the road marking regulations, can they be enforced? Thanks in anticipation.
