  1. you should be able to delay the payment of your payday loan but defering it till next pay day and change the amount you can afford to pay and then do the same thing when your next pay day is near so that they only take a small payment which would be easier to pay off at another new date.
  2. I have a cash account with Lloyds TSB and when I tried to take them through the FOS they were told that as I dont owe the bank any money then I couldnt claim under financial hardship, but with them taking money out for direct debits which may have been a few pounds short to pay them the made me go overdrawn with their bank charges, you obviously cant get them to pay out anything they dont want to.I was in hospital for a week during week beginning 21st June for a knee replacement and I advised my bank of that as I was worried I might not have enough in and wouldnt be able to transfer money accross, luck had it when I got home I had a small tax refund which I paid into my bank and lo and behold when a payment was due for 15.00 they bounced it and charged me 20.00 so I rang them and told them that there was over 500.00 even though they werent cleared funds at the time and on this occassion they refunded me the 20.00,
  3. I would like to warn the general public regarding Provident Personal Credit, I have received a letter from them asking if I want to take out a loan, the public should be warned not to take out a loan with this company as their APR is and wait for it typical 272.2% which is a rip off. They give an example if you were to borrow £300 for 52 weekly payments of £10.50 but the total you repay back is a huge £546.
  4. Re your Visa Debit Card from Lloyds TSB, I have one and I have never had any problems using it in shops and having cash back, you could ask for a new pin number for your debit card and there is no reason for not being able to use it in shops and having cash back. I only have a cash account with Lloyds and I pay all my direct debits and standing orders through this account, maybe there is something wrong with the card itself as sometimes if they are slightly damaged they wont work.
  5. I think this winter fuel allowance is ageisim as I am 60 next month but dont qualify for any allowance till next year to me this is unfair as winter dont start in September so dont see why you only get it if your 60 before Sept.
  6. HI, Im on high rate mobility but had to fight tooth and nail to get it, was turned down twice and got it on the 3rd go. I was lucky to get someone from CAB to help me but on 2nd appeal I managed to go to the top on a mater of legality and the solicitor that was on the panel said it didnt matter how long you can walk if your in pain then distance has no say in it which is why I persevered with it and got mine back dated from the first application. Good luck with your appeal and dont give up, they always turn down a first application.
  7. Hi the only priority debt I have is owing to the Scottish Hydro Board for my electric, I now have a prepayment meter with my debt being paid off at 5.00 per week through my meter so as from now I am putting 45.00 a week into my meter. Fos said there was no financial hardship closure letter only she has decided because I dont owe the bank any money then I have to wait till the test case has finished even though TSB LLoyds agree with that decision as I had a credit balance of 73p in my cash account which pays my direct debits from and 50.00 in my savings account which I use for putting my direct debits into till as such time they are due and then I transfer the money over. I do that because I get my Incapacity Benefit paid every 2 weeks.
  8. Hi Scott Phoned the lady who was dealing with my case at the FOS and it appears what they are saying as I dont owe the bank any money then I'm not in financial hardship so they wont refund any money till the test case has finished.
  9. sorry maroondevo53 my who asked what exactly, im now confused
  10. Ok Scott will email her tomorrow. If I can get an email address from you I can email the letter I received from the FOS, maybe you can advise on what you read from it.
  11. HI Scott Received a letter today from the FOS and they have decided that because I dont owe LLoyds TSB any money using an overdraft facility they are not going ahead with me case unless I can argue that I am in real financial hardship so will have to wait till the test case is over.
  12. Hi, just wanted to update you regarding my case with the FOS which I am claiming under the hardship rules. My case is now with an adjudicator who is dealing with me and Lloyds TSB, fingers crossed it will be sorted out soon. Will update you when I hear back from the FOS.
  13. I receive high rate mobility and have a motorbility car, how is this going to affect me as I would be lost without my own car and have no way of paying for one without the high rate mobility allowance.
  14. Can anyone tell me if the banks are allowed to take bank charges from benefits, my income is made up of 2/3 incapacity benefit and 1/3 part time wage. I recently had a direct debit payment refused for being 1.63 over drawn which I would have cleared the same day by internet banking, yet they were quite happy to make me 18.67 overdrawn for 20.00 bank charges.
  15. HI Dont know if this is of any use to you but I am also getting housing benefit and they claw back the overpayments by reducing the amount over a short period of time. These overpayments are to do with the Councils not updating claims on time as I have had a few overpayments when I have informed the Council of changes in either tax code no or rent increases. Its the norm for Councils to charge the customer for over payments received as it takes them so long to update records
  16. HI, I am in the middle of reclaiming my bank charges under financial hardship as I no longer have the same funds I had when I first joined LLoyds TSB. I am now on long term Incapacity Benefit and a part time wage instead of full time work and Tax Credits. I received the normal letter saying I will have to wait till the outcome of the test case. I decided I would get in touch with the FSO who have written to LLoyds TSB regarding my complaint and I now have received the paperwork from FSO to fill in and complete. Fingers crossed the bank will now look at my complaint seriously instead of just glancing through it. Will let you know what the outcome is.
  17. Hi again , you could try cancelling your direct debits if you dont want them taking more money out of your account than you can afford and just pay however much you can afford using the paying in section of your statement.
  18. Hi JFRA, I was told by my debt advisor at our local Trading Standards Office in order to stop all the phone calls regarding outstanding debts was to change my phone number which I did and now I dont get these phone calls any more. I know its a pest to have to change your number but its better that than dreading the phone ringing. Hope this helps as much as it did me.
  19. Has anyone read in today Sunday Post regarding MP Mohammad Sarwar who represents Glasgow Govan it attempting to cat the amount banks can claim from penalty fees and default charges. He is recommening 2.5 per cent is a fair payment and he has drafted a bill to be put before the House of Commons which, if passed the bill will limited the charges to 2.5% which is a fairer charge. So keep an eye out for this bit of news as it could be in our favour.
  20. HI Scaniaman, I live in Buckie and was told by someone on here to send my letters to the Head Office in Edinburgh Mrs Rice, about a week later I received a letter from Andover who apparently deal with all account complaints. I was given the usual rubbish so sent LBA to Mrs Rice at Edinburgh who sent it to Andover and again got the usual reply. As yet due to ill health and finances I have not as yet sent the small claims court papers, but have since seen on the site that all Scottish claims are being sisted till trial case is over. I have since my original letter had yet more charges stopped so I will be sending another letter then this time it will be a small claims court they will recieve next. I cannot understand what Andover in England has to do with LLoyds TSB Scotland plc, so I did query it with the OFT is it and they told me that Andover does deal with all bank complaints, but my argument is that Scotland laws are different to English laws so how does an English TSB have anything to do with a Scottish TSB.
  21. Hi I sent all my letters to Edinburgh for the attention of Mrs Susan Rice and every letter has been forwarded to their Andover branch in England who apparently deals with all complaints. cilla
  22. HI Suzieblooz, I am having the same problems with Lloyds TSB Scotland plc, their head office is in Edinburgh where I have been sending my letters to, apparently they are forwarding them on to Lloyds TSB Andover in England whom they say deal with all commplaints. Received letter today stating they will not deal with any complaints till after the case hearing. I am just going to send small claims court to Edinburgh and wait and see what happens.
  23. Why are other members of LLoyds TSB using my thread to ask questions, I'm getting confused with what is what.
  24. I have sent a LBA which in turn they replied within 3 days telling me that as I have filed under financial hardship they would sent my letter to another branch to tell me how to handle my finances. Also as my branch is in Edinburgh and all my letters have been sent to Andover which branch should I put down in form 1 and 1a, is it Edinburgh or Andover who supposedly deals with all account enquiries.
  25. OK thanks bigmac will serve papers to the sheriff court tomorrow.
