  3. Don’t despair Kerryanna I am in exactly the same position as you with Nat West, I am going to apply to the court to have the stay lifted. There are links on this site which have the correct wording etc, I will look it out and send you the link Don’t give up, keep going Gaz
  4. I have just posted my letter to my MP and of course Mr Brown. Lets see if they fight and support their constituents like they promise to when they want our votes.

HI , i was very interested to read the above as i am at exactly the same stage , i rang my court today and was told that the court has stayed my case , a court decision not at the request of the defence. can anyone tell me can i appeal against a stay ? Also as its stayed can i submit an application to the court to have the defence struck out as an abuse of process ? And further can i quote the actions of another court / judge (ie Juson 4's judge ) in any request to the judge dealing with my case ?
  6. Regarding the Charges that i am trying to reclaim , they are the charges that were made by barclaycard prior to it being moved to the debt collector, ie Late Payment fee and over credit limit fee.
  7. Thank you very much for that information , I appreciate it. Just in case I end up arguing with them what rule or legislation would I be looking at to argue my point ? Also if it gets to the court stage does the judge need to know about the fact the debt was written off by them ?
  8. My very first post . Does anyone know the answer to the following. I had a barclaycard account which i was unable to pay, during the course of not being able to pay i incurred charges for late payment and over credit limit. The debt was taken on by Lowell, i agreed a settlement figure with them which was about £1000 less than i owed. i paid this . That was the end of the matter. If i clamed back the charges i am owed ( about £500 ) can barclaycard agree to refund them but keep the money as the written off debt is more than the charges that would be refunded ? or Because the charges were taken from me at the time of me having the account do they legally have to return the money to me ?
