  1. I recently sent a CCA request to Red Debt Collection Services / Lowell Portfolio for a debt with 3G Mobile. I had a contract telephone with them. I've had a letter back from them, and they've returned my cheque. The letter states the following: My question is, what do I do now? In addition, I also sent a CCA request to Connaught Collections, it's been over 12 working days since the request was acknowledged, and cheque cashed. Where do I stand on this? Many thanks in advance for the advice.

My father-in-laws financial advisors have been dealing with Morgan Cole on our behalf, they've given Morgan Cole our statement of means, copy of the will, statement of the estate etc. and in a conversation with them on Monday, Morgan Cole agreed to the stay of execution. The financial advisor has said that we should go to court tomorrow as a matter of course.
  3. The court date is tomorrow, in the meantime my Father-In-Law passed away, so with the inheritance we can clear this debt. Despite offering to clear the debt they are still bringing it to court, and from what I gather want to charge us £50 per month for a stay of execution while the probate is sorted out, as well as the daily interest. Can they do this?

My husband and I have a secured loan with Nemo Personal Finance, we got into some arrears, which was made worse when they increased our interest rate meaning that we had to pay an additional £60 per month. The arrears are about £4000, and we've had various payment arrangements to try and clear this amount. We were sent a letter from their Solicitors Morgan Cole accusing us of doing nothing to pay back the arrears, and that they would be taking further action against us. I replied to them via e-mail: I've received a letter from Morgan Cole this morning that says: I can't believe that after making an offer of repayment that they are proceeding with a resposession. I have 2 small children, and my disabled sister also lives with me. I will of course return the questionnaire promptly, but is there anything else that I can write to them to voice concern over the way that this has been handled. Any tips or advice would be welcomed.
  6. Consumer Direct confirmed that we are covered by SOGS which means we are entitled to reject the sale and be entitled to a full refund. We have recieved a cheque for £150 from the seller after receiving this e-mail: On advice from Consumer Direct we sent the following letter before cashing the cheque. I will be sending a LBA on Monday if necessary. Just posted this to keep you updated.
  7. Just found this info on eBay: Sale of Goods Legislation The most important piece of legislation relating to the sale of goods through eBay.co.uk is the Sale of Goods Act 1979 (as amended). The Act provides that wherever goods are bought they must “conform to contract”. This means that items sold through eBay by business sellers must be: of "satisfactory quality"; "as described"; and "fit for purpose". Therefore goods sold by business sellers must not be inherently faulty at the time of sale, must match any description given to them and, allowing for factors like price, they must be fit for their purpose, defect free, safe and durable. Where the seller is a private individual, the goods must be “as described”. The goods are not legally required to be of “satisfactory quality” or “fit for purpose”. The item description stated "All the glass and ceiling panels are undamaged." which was not the case, the seller has now stated in the re-listed version "All the glass and ceiling panels are undamaged except for one panel that has a crack in it."

  9. Jonchris have you read this thread? I have NOT accused him of anything and I did NOT report him to eBay, davethorp did - so please bear this in mind when you advise me against making 'accusations' All I want is a refund of my money.

Jonchris I haven't said anything of the sort, so I'm not sure why you're saying I've accused him of being a thief - I am perfectly entitled to reject an item under the Sale of Goods and Services as it was not fit for purpose due to the damage. Could someone please just give me an idea of how to respond to the e-mail rather than telling me what a mistake I've made - it is an unfortunate situation, and the first time this has happened to me in over 7 years of buying and selling on eBay.
